Waatti and Northwest Investments Partnership, LLP has applied to the City of Kalispell for a conditional use permit to convert a video rental store and pizza shop into a casino in Westbrook Square. The Kalispell City Planning Board and Zoning Commission, after due and proper notice, on January 15, 2002 held a public hearing on the application, took public comment and recommended that the application be approved subject to five conditions. After reviewing the application, the record, the Tri-City Planning Office report, and after duly considering the matter, the City Council of the City of Kalispell, pursuant to the Kalispell Zoning Ordinance, hereby adopts Tri-City Planning Office, Conditional Use Report 4KCU-01-10 as the Council's findings of fact, and issues and grants to the above -described real property a conditional use permit to convert an existing business in Westbrook Square into a casino in the B-2, General Business zoning district subject to the following conditions: SECTION I. 1. The proposal will be developed in substantial conformance with the approved plan and the Kalispell Zoning Ordinance. z002043ft-0y30 2. That the proposed use comply with all local, state, and federal regulations which may apply to the construction and operation of a gaming facility. 3. That no neon signs, accents, embellishments or other treatment shall be added to any portion of the building, canopies or existing signs that could be seen from a public right-of-way. 4. That an updated site plan be provided to the Kalispell Building Department prior to any work being done on the building. 5. That the conditional use permit is valid for a period of 18 months from the date of authorization or until such time another casino is established and put into use within 300 feet of subject property.
