07/20/92 City Council MinutesN77 477 A REGULAR MEETING OF THE KALISPELL CITY COUNCIL WAS HELD AT 7:00 P.M. MONDAY, JULY 20, 1992, IN THE COUNCIL CHAMBERS AT CITY HALL. MAYOR RAUTHE PRESIDED. COUNCILWOMAN KENNEDY WAS ABSENT AND ALL OTHER COUNCILMEMBERS WERE PRESENT. Mayor Rauthe called the meeting to order and led the Pledge of Allegiance. CONSENT AGENDA Approve Minutes -July 6, 1992 Approve Claims per Payables Register Pledged Securities -June 30, 1992 Moses moved to approve the consent agenda. The motion was seconded. With a vote the motion carried. ADDRESSING THE COUNCIL No one addressed the council. BUSINESS FROM MAYOR & COUNCIL Parking Advisory Board Appointments Mayor Rauthe recommended Ed Gilliand and Dick Volstadt be appointed to the Parking Advisory Board. Collins moved Ed Gilliand and Dick Volstadt be appointed to the Parking Advisory Board. The motion was seconded. BUSINESS FROM MANAGER Anderson Theatre Proposal City Manager Williams explained the proposal received from the Anderson Theatre Company to purchase Lots 11 2, 3, 4 and 5 (portion), Block 36, Kalispell, Montana and to build thereon a Movie Theatre complex consisting of 3 auditoriums seating approximately 154 persons each, together with restrooms, concession stands, and supporting facilities. The elements of the proposal were discussed at the last work session. Among the items were whether or not the Andersons would be able to fulfill the parking requirements as outlined in the zoning ordinance. Some of the options were discussed. Since the work session City Attorney Neier, Larry Gallagher and Steve Cervantes have had the opportunity to draft a proposed development agreement that would include, among other things, how those parking requirements could be met. Additionally the specifics of the Anderson proposal to purchase that property. He asked Larry Gallagher to explain the parking provision of that draft agreement. Larry Gallagher explained after more research it was discovered there are only 2 alternatives rather than 3 concerning the parking issue. He explained the alternatives as set forth in Article 3 of the agreement. This allows the Anderson Theatre a shared use of 58 parking stalls, an agreement not to protest and an agreement to contribute $4,000 approximately annually to the Parking Special Improvement District and in lieu of those two things happening, a cash contribution of $67,000 to the creation of public parking that will benefit their project. City Attorney Neier made some grammatical and editing changes but the substance of the agreement is the same. This has been presented to Mr. Hines and the Anderson Theatre Company and they have agreed in principle thus far. Williams asked for council feedback so he would know if to proceed or not. 0478 478 Atkinson and Rauthe spoke in favor of the concept. There was discussion and the consensus was to proceed. Adopt 1993 Preliminary Budget Williams explained by law the City Council must adopt by July 20 of each year the preliminary budget. He requested the council consider adopting the city preliminary budget as presented in the amount of $14,881,327. This represents a formality, and there is still three weeks in order to complete the work on the budget. Atkinson moved council adopt the preliminary budget for 1993 fiscal year. The motion was seconded. The motion carried with a vote. Schedule. Public Hearing on Budget Under Montana law council is required to hold a public hearing. The public hearing date is scheduled for August 3, 1992 at 7:00 p.m. Set Special Meeting A Special Council Meeting will be held on August 10, 1992 at 7:00 p.m. in order to adopt the FY 93 Budget. Immanuel Lutheran Home Hearing On August 3, 1992 a public hearing will be held for the Immanuel Lutheran Home Refunding Bonds.
