Performance Bond Reminders: There was lengthy discussion regarding the cash in lieu of parks
and SIA for completion of the bike path/sidewalk for phase 1 of Fox Trotter Meadows. The
developers have decided not to file the final plat of phase 2. There is a subdivision improvements
agreement is in place for the path, which is $2,500 and the cash in lieu of parkland is approximately
$5,000. The parkland that was dedicated with phase 1 is not directly adjacent to the 1 lot subdivision
and will not be developed so they have been in negotiations with Parks & Rec to pay cash in lieu
instead. Fincher said if they are not going to move forward with phase 2 the cash in lieu will be
accepted. Fraser will bring in a letter with the check and Fincher will write a letter of acceptance.
Castles said the lot is within the city yet they have no city services and Jentz said they have police and
fire protection. Burnham noted without water there is no fire protection and they discussed the need
for a hydrant or at least a tank to be installed on site for fire protection. Haas said the Fire
Department has ordered a water tender for properties within the city like this but the tender won't be
here for a few months. Further discussion was held regarding the city's inability to add conditions
onto a subdivision that has already been approved; de -annexing the property; and current fire
protection capabilities.
Burnham noted the cash in lieu of parks money can be used in other areas but the SIA funds for the
sidewalk has to be used for this subdivision. Jentz suggested if the property is sold to another
developer there could be a deed restriction with a waiver of right to protest an SID put on the
property to ensure the sidewalk and roadway improvements along Stillwater Road includes lot 1 of
Fox Trotters Meadows. Public Works will meet with Mike Fraser to discuss the deed restriction for
future development or the sidewalk has to be built. Burnham said when this property comes in for
development it will have no connection to the original phase 2 and will be a brand new development
and Jentz agreed. Castles suggested adding to the deed restriction the language "the improvements
will be completed to the standards that are in affect at the time the preliminary plat is approved" for
both the phase 1 and 2 frontage.
OLD BUSINESS: Spring Creek Apartments Phase 2 — Sorensen asked if there were any updates
and Burnham said they dropped off some addendums to the plans for this project this morning and
Public Works needs to review the addendums and send them a letter with the city's comments.
Sorensen noted he still has not received a lighting plan and Burnham said they did not receive one in
their packet.
Montana Club — Sorensen stated the building drawings were received for the Montana Club last
Friday and Clawson said Public Works and Parks received a copy and the copy for the Fire
Department is ready to be picked up at the Building Department. Burnham noted there are still some
issues with the site plan that were not addressed. Sorensen planned to ask for additional information
on the berming which is a 2 foot high berm that tapers down to about 1 foot and the city will ask for
more solid screening. Sorensen added the lighting plan is also needed for this project. Burnham said
the sidewalk location along 13th Street East has been resolved but there are still a few issues to
resolve and they have been notified. Sorensen asked Public Works to check to see if they have
obtained a stormwater management permit. Fincher said he spoke with Aaron from JCM Architecture
and faxed him the city's boulevard tree requirements and Aaron said he would send Fincher
something soon. Haas said he had no comments for the Fire Department until he has a chance to
review the plans. There was further discussion regarding the requirements for boulevard width.
Bojangles — Sorensen said the owners of Bojangles are waiting to see if they could hook in with the
bypass drainage. They are looking to complete this project by this summer. Burnham suggested they
resolve their stormwater issues with the assumption that they cannot connect but they may be able to
connect in the future. There are some other issues with landscaping and buffering that needs to be
resolved. Castles added for new parking lots Public Works would require installation of a water
quality system but this may be part of the negotiations with MDT.
NEW BUSINESS: None.
PLANNING OFFICE ITEMS: Jentz spoke with Hubert Turner regarding a 2 phase plan for
Ashley Heights and the first phase would include the lots on the east side of the road. Burnham
thought that would be a problem because the west side would not be developed and cause problems
with dust, weeds, etc.
Jentz added he also spoke with Turner about the property they own along Highway 2 which will
serve as an access to Highway 2 from the Willow Creek subdivision when developed. Turner is
planning a 30 lot subdivision on this property with a submittal this fall. Jentz told Turner to contact
Parks about a trailhead design as a park.
Willow Creek will be amended to reduce the number of lots to approximately 420 and he will be
coming in for a review of those changes. The round -about and condos are no longer being proposed.
Castles noted the road will still have to go through from Foys Lake Road to Highway 2 in phase 1.
Additional discussion was held regarding the bypass and sound walls on the Willow Creek property.
Jentz reported the developers of Northland Subdivision are looking at coming in this fall with Phase
5 at the end of Northridge Drive. MDT will install an earth berm along the bypass adjacent to this
phase.
OTHER REPORTS: Steve Herzog from CTA is working on a proposal for the possible location of
a new Flathead County Library on the corner of 3rd Avenue EN and Center Street. Herzog noted
storm drains run through the site and he will check with Susie Turner on that issue. Further
discussion was held regarding the following:
• Environmental clearance on the property and Jentz noted the city has been awarded a grant
that could help defer the cost of part of the environmental studies.
• It is unclear whether the street that runs from 3rd Avenue EN to I't Avenue EN along the
north side of this property is a city street or private road easement and Jentz said the railroad
deeded that R/W to the property owners some time ago. Public Works will check on
ownership of the street.
• The Quonset huts would be removed from the site.
Further discussion was held regarding sidewalks, curb & gutter, previous uses of this property,
access, impact fees, the benefits of completing a traffic impact study, and the other sites that are
proposed. Herzog added the transit system would be incorporated into this site as well.
Sorensen reported he will be meeting with Tammi Fisher, who is an attorney representing Bob's Bail
Bonds, tomorrow — July 3 I't at 10:00 am. Representatives of the Building Department and Public
Works will attend the meeting. Fincher is unable to make the meeting but Park's position is if there is
a sidewalk trees will have to be planted and if not no trees would be required. Fincher said if the
sidewalk has to be shifted towards 13th Street and there is no room for a boulevard trees would not be
required either.
Burnham asked the status on the WalMart building permit and Sorensen said the bid was awarded
but the city has not yet been informed of the contractor who was awarded the bid and the permit has
not been issued.
