7. Conditional Use Permit - Accessible Space, Inc.REPORT TO: Honorable Mayor and City Council FROM: Tom Jentz, Director Myrt Webb, Interim City Manager SUBJECT: ASI - Conditional Use Permit for 23 Unit Senior Housing MEETING DATE: July 6, 2009 BACKGROUND: At the council's June 15th meeting they discussed the conditional use permit request from Accessible Space, Inc. (ASI) to construct a 23-unit apartment building to serve very low income senior citizens on Grandview Drive. Among other issues the council revisited the discussion of requiring ASI to make a payment in lieu of taxes to the city to cover the cost of anticipated services from the Fire and Police departments. It was noted that staff was moving forward with a recommendation for a formal policy on PILT and that this policy would be formally discussed at the July 6, 2009 council meeting. After further discussion, the council elected to table the main motion to conditionally approve the conditional use permit until the PILT issue for the City of Kalispell was finalized. Specifically the project was tabled until the July 6, 2009 meeting. The project developer, Dan Billmark, in an attached letter dated June 23, 2009 has now requested that the conditional use permit discussion be continued until the July 20 city council meeting so that he can be in attendance and respond directly to any questions that the council may have. RECOMMENDATION: Council should remove the item from the table and then vote to continue discussion of this item until the July 20, 2009 city council meeting. ALTERNATIVES: As suggested by the council. I understand that certain issues were raised at the June 15, 2009 Council meeting that could not adequately be addressed at that time, resulting in tabling of the Conditional Use Permit hearing to the next regularly scheduled Council meeting on July 6, 2009. Unfortunately, I am not able to attend the July 6t" City Council Meeting and, therefore, respectfully request that the agenda item be moved to the July 20, 2009 meeting.
