Ordinance 1293 - Salary OrdinanceORDINANCE NO. 1293 AN ORDINANCE AMENDING ORDINANCE NO. 1277, FIXING THE LIMITS OF THE SALARY AND COMPENSATION OF THE CITY OFFICIALS, SUPERVISORS, AND EMPLOYEES PURSUANT TO TITLE 7, CHAPTER 4, PART 42, M.C.A., COMMENCING ON THE DATES INDICATED HEREIN, REPEALING ALL OTHER ORDINANCES IN CONFLICT THEREWITH. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, AS FOLLOWS: SECTION T The salaries and compensation of City Elected Officers for the period beginning January 1, 1998, are hereby established as set out on Exhibit "A", attached hereto and which, by this reference, is made a part hereof. Appropriations shall be made to pay same when due. SECTIONqTprTTON 11. The salaries and compensation of City Appointed Officers, Supervisors, and Employees for the period beginning July 1, 1998, are hereby established as set out on Exhibit "A", attached hereto and which, by this reference, is made a part hereof. Appropriations shall be made to pay same when due. SECTION TIT, Longevity increments and medical insurance premiums shall be paid as provided by law, contract or as directed by the City Council. The annual service anniversary date for all Employees is July 1st of each year; however, an Employee must have at least six months continuous employment by the City before being considered to have one year longevity. SECTION -Ty. This Ordinance shall be in full force and effect as regularly provided by law; salaries and compensation provided for under Sections VI through IX shall be paid retroactive to July 1, 1998. SECTION V. All prior salary and compensation ordinances of the City and any ordinance or parts of ordinances in conflict herewith are hereby repealed. WHEREAS, William Hammer, DDS, the owner of property described above, petitioned the City of Kalispell that the zoning classification attached to the above described tract of land be changed to B-4, Central Business, and WHEREAS, the property as described exists as property surrounded to the North by Residential, B-4 classification, to the East by Multi -Family residential, RA-1 classification, to the South by Single family residential, RA-1 classification, and to the West by Single family residential, B-2 classification, and WHEREAS, the petition of William Hammer, DDS was the subject of a report compiled by the Flathead Regional Development Office, #KZC-98-3, dated August 4, 1998, in which the Flathead Regional Development Office evaluated the petition and recommended that the property as described above be zoned B-4, Central Business, as requested by the petition, and WHEREAS, the Kalispell City -County Planning Board and Zoning Commission issued a report recommending the property as described be zoned B-4, Central Business, and WHEREAS, after considering all the evidence submitted on the proposal to zone the property as described B-4, Central Business, the City Council adopts, based upon the criterion set forth in Section 76-3-608, M.C.A., and State, Etc. v. Boharski, Mayor ATTEST: eresa v�hite Clerk of Council 1 0 I 1 U ORDINANCE NO. 1295 ADOPTION OF CODE AN ORDINANCE OF THE CITY OF KALISPELL, MONTANA, ADOPTING A REVISION AND CODIFICATION OF THE ORDINANCES OF THE CITY OF KALISPELL ENTITLED "THE CODE OF THE CITY OF KALISPELL, MONTANA,- PROVIDING FOR THE REPEAL OF CERTAIN ORDINANCES NOT INCLUDED THEREIN, WITH CERTAIN EXCEPTIONS, AND FOR OTHER PURPOSES HEREINAFTER SET OUT. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA: Section 1. There is hereby adopted by the City Council that certain Code entitled "The Code cf the City of Kalispell, Montana," containing certain ordinances of a general and permanent nature as compiled, consolidated, codified and indexed in Chapters 1 to 27, both inclusive, of which Code not less than three copies have been and are now filed in the office of the Clerk of Council. Section 2. The provisions of such Code shall be in force and effect on and after December 7, 1998, and all ordinances of a general and permanent nature adopted on or before October 19, 1998, and not contained in such Code are hereby repealed from and after December 70, 1998, except as hereinafter provided. Section 3. The repeal provided for in the preceding section of this ordinance shall not affect any offense or act committed or done or any penalty or forfeiture incurred or any contract or right established or accruing before December 7, 1998; nor shall it affect any prosecution, suit or proceeding pending or any judgment rendered prior to December 7, 1998; nor shall such repeal affect any ordinance or resolution promising or guaranteeing the payment of money for the City or authorizing the issue of any bonds of the City or any evidence of the City's indebtedness or any contract or obligation assumed by the City; nor shall it affect the annual tax levy; nor shall it affect any right or franchise conferred by ordinance or resolution of the City on any person or corporation; nor shall it affect any ordinance adopted for purposes which have been consummated; not shall it affect any ordinance which is temporary, although general in effect, or special, although permanent in effect; nor shall it affect any ordinance relating to the salaries of the City officers or employees; nor shall it affect any ordinance annexing territory to the City; nor shall it affect any ordinance naming, renaming, opening, accepting or vacating streets or alleys in the City; nor shall it affect any ordinance adopted on final reading and passage after October 19, 1998. - Section 4. Whenever in the Code adopted by this ordinance or in any other ordinance of the City or in any rule, regulation or F:\wp\ord\codes.wpd 1 order promulgated by any officer or agency of the City under authority duly vested in him or if any act is prohibited or is made or declared to be unlawful or an offense or a misdemeanor, or the doing of any act is required or the failure to do any act is declared to be unlawful or an offense or a misdemeanor, where no specific penalty is provided therefor, the violation of any such provision of such Code or any other ordinance of the City or such ' rule, regulation or order shall be punished by a fine not exceeding three hundred dollars or imprisonment for a term not exceeding ninety days, or by both such fine and imprisonment. Except where otherwise provided, every day any violation of such Code or any other ordinance of the City or such rule, regulation or order shall constitute a separate offense. Section 5. It is hereby declared to be the intention of the City Council that the sections, paragraphs, sentences, clauses and phrases of this ordinance and the Code hereby adopted are severable, and any phrase, clause, sentence, paragraph or section of this ordinance or the Code hereby adopted shall be declared unconstitutional or otherwise invalid by the valid judgment or decree of a court of competent jurisdiction, such unconstitution- ality or invalidity shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance or the Code hereby adopted.
