Ordinance 1284 - Zoning - Thompson, Noble & McKinleyORDINANCE NO._1284 AN ORDINANCE TO AMEND SECTION 27.02.010, OFFICIAL ZONING MAP, CITY OF KALISPELL ZONING ORDINANCE, (ORDINANCE NO. 1175), BY REZONING PROPERTY OWNED BY GLEN AND MILDRED THOMPSON, CECIL AND ISABEL NOBLE AND CATNERINE Mr-KINLEY, LIVING TRUST, KALISPELL, FLATHEAD COUNTY, MONTANA, (PREVIOUSLY ZONED R-3, RESIDENTIAL AND RA-1, RESIDENTIAL APARTMENT DISTRICT), TO AN RA-3, RESIDENTIAL APARTMENT/OFFICE DISTRICT, IN ACCORDANCE WITS THE CITY -COUNTY MASTER PLAN, AND TO PROVIDE AN EFFECTIVE DATE. WHEREAS, Glen and Mildred Thompson, Cecil and Isabel Noble and the Catherine McKinley, Living Trust, hereinafter Applicants , the owners of property more particularly described as Assessor's Tract 6BS, 6BN, 6BQA, 6BQB, 6BI, 6BIA, 6BH, 6BHA, 6BG, AND 6BGA, in Government Lot 1, and Lots 1,2, and 3, Block 1, Underhill Subdivision, in Section 7, Township 28 North, Range 21 West, P.M.M., Kalispell, Flathead County, Montana, petitioned the City of Kalispell that the zoning classification attached to the above described tract of- land be changed to R-5, a Residential/Professional Office, under the City of Kalispell Zoning Ordinance, and WHEREAS, said property exists as property surrounded to the North by R-3 classification; to the East by R-3 classification; to the South by R-4 classification; and to the West by R-3 and R-5 classifications, and WHEREAS, the petition of Applicants. was the subject of a report compiled by the Flathead Regional Development Office, #KZC- 98-1, dated February 2, 1998, in which the Flathead Regional Development Office evaluated the petition and recommended that the zoning map amended to rezone the property from RA-1 and R-3 to RA- 3, and WHEREAS, the Kalispell City -County Planning Board and Zoning Commission issued a report recommending said property be rezoned as R-5, Residential/Professional Offices, and WHEREAS, after considering all the evidence submitted on the proposal to zone said property R-5, Residential/Professional Office, the City Council adopts, based upon the criterion set forth in Section 76-3-608, M.C.A., and State, Etc v_ Board of COUnLY j;\wp\ord\thompson.wpd 1 1 11 573 the findings of fact of FRDO as set forth in Report No. KZC-98-1. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION 1. Section 27.02.010, of the Official Zoning Map of the Kalispell Zoning Ordinance, (Ordinance *11751 is hereby amended by designating the property described as, Assessor's Tract 6BS, 6BN, 6BQA, 6BQB, 6BI, 6BIA, 6BH, 6BHA, 6BG, AND 6BGA, in Government Lot 1, and Lots 1,2, and 3, Block 1, Underhill Subdivision, in Section 7, Township 28 North, Range 21 West, P.M.M., Kalispell, Flathead County, Montana, as RA-3, Residential Apartment/Office District. SLCTION TT. The balance of Section 27.02.010, Official Zoning Map, City of Kalispell Zoning Ordinance not amended hereby shall remain in full force and effect.
