Ordinance 1321 - Parking - Police Vehicle - Police Bikes on SidewalksORDINANCE NO. 1321 AN ORDINANCE AMENDING CHAPTER 17, MOTOR VEHICLES AND TRAFFIC, KALISPELL CITY CODE, SECTIONS 58 AND 114, BY AMENDING R.O. 1947, SECTIONS 368 AND 923 AND DECLARING AN EFFECTIVE DATE. BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA, AS FOLLOWS: SECTION I. That R.O. 1947, § 368 (§ 17-58, Kalispell City Code) is hereby amended to read as follows: "No person having charge of a vehicle ordinarily drawn by horses shall allow such vehicle to remain in any public highway, unless such vehicle has horses attached thereto, nor shall any person having charge of a trailer allow such trailer to remain in any public highway unless attached to a vehicle by which it may be propelled or drawn; provided that in the case of accident, such vehicle may be moved to the side of the highway and if a good and sufficient red light signal be displayed at both ends thereof during the hours of darkness, may remain upon the highway for a period of not exceeding twenty-four hours, pending removal for repairs, except that such vehicle shall not remain upon any of the highways where standing or parking is limited, for a longer time than is necessary to effect its removal. This provision shall not apply to the parking of authorized law enforcement vehicles, left unattached along any public highway in the city as part of a law enforcement activity." SECTION II. That R.O. 1947, § 923 (§ 17--114, Kalispell City Code) is hereby amended to read as follows: "It shall be unlawful for any person, other than authorized law enforcement personnel, to ride a bicycle along or upon the sidewalk of any street or avenue within the corporate limits of the city." SECTION III. That this Ordinance shall take effect thirty (30) days from and after its passage and adoption by the City Council.
