It would serve as transitional housing while they are attending local schools and pursuing employment opportunities. The property is located at 1005 8th Avenue East and is a part of Chrysalis Schools of Montana, based in Eureka, Montana. Under federal and state law, group homes of this size have certain protections. The conditional use permit cannot be denied, although reasonable conditions may be placed on the facility consistent with conditions that might be placed on single-family homes. The property can be more particularly described as the North 1/2 of Lot 1 I and the West 30 feet of the North 1/2 of Lot 12, Block 256, Kalispell Addition 8, as shown on the map or plat thereof on file and of record in the office of the Clerk and Recorder, Flathead County, Montana. The Kalispell Planning Board held a duly noticed public hearing on June 9, 2020, to consider the CUP request. Staff presented staff report KCU-20-03 providing details of the proposal and evaluation. Staff recommended that the Planning Board adopt the staff report as findings of fact and recommend to the Council that the request be granted subject to five (5) listed conditions. Six written comments were received prior to the meeting and one comment was provided at the public hearing in addition to comments from the applicant. The public hearing was closed and a motion was presented to adopt staff report KCU-20-03 as findings of fact and recommend to the Kalispell City Council that the conditional use permit be granted subject to the five (5) conditions. Board discussion concluded that the request was appropriate, and the motion passed unanimously on roll call vote. RECOMMENDATION: It is recommended that the Kalispell City Council approve a request from Chrysalis Schools of Montana for Conditional Use Permit KCU-20-03, a conditional use permit for a youth group home for eight or fewer girls with five conditions of approval within the R-3 Zoning District, located at 1005 8th Avenue East and more particularly described as the North half of Lot 11 and the West 30 feet of the North half of Lot 12, Block 256, Kalispell Addition 8, as shown on the map or plat thereof on file and of record in the office of the Clerk and Recorder, Flathead County, Montana. BOARD DISCUSSION None. PUBLIC HEARING Diane Wiggin — 1009 8rh Ave E — concerned with increased traffic and parking. Corey Hickman — Executive Director for Chrysalis Group Home — gave a brief overview of the types of students who come to the group home, they are young girls who suffer with severe anxiety and depression who have gone through initial treatment at their main location in Eureka and are now transitioning back into high school and getting jobs, etc. There is a 24-hour awake staff at all Kalispell City Planning Board Minutes of the meeting of June 9, 2020 Pagel times and a psychiatrist on site as well. The girls will not have cars but there will be approximately 2-3 staff vehicles and a transport van on site. It is a part of Chrysalis Schools of Montana, based in Eureka, Montana, and operates under a State of Montana Department of Public Health and Human Services license for a private alternative adolescent residential or outdoor program. The most common diagnosis for a Chrysalis student is anxiety and/or depression. At the point that the girls are placed in the transitional home, they are well advanced in what is typically a 12-18-month process that they have begun in the main Eureka facility. Depending upon the girl's specific age, they are ready to step back into high school, employment, or go on to college. Their time in the home is highly structured and includes chores, curfews, and off -site weekend activities such as hiking, biking, and skiing. The home will be supervised by trained staff, including overnight supervision by awake staff. Under federal and state law, group homes of this size have certain protections. The conditional use permit cannot be denied, although reasonable conditions may be placed on the facility consistent with conditions that might be placed on single-family homes. EVALUATION OF THE REQUEST This application has been reviewed in accordance with the conditional use review criteria in the Kalispell Zoning Ordinance. In general, a conditional use permit is subject to the following criteria, although as a group home with eight (8) or fewer residents, federal and state law, provide certain protections. The conditional use permit cannot be denied, although reasonable conditions may be placed on the facility consistent with conditions that might be placed on single-family homes. 1. Site Suitability: Adequate Useable Space: The subject property is approximately 5600 square feet and is already developed with a single-family residence. b. Height, bulk and location of the building: The existing single-family residence is a single -story structure with a basement (1368 sq ft per floor) and an attached garage. C. Adequate Access: The property sits at the comer of 8t' Avenue East and loth Street East and has adequate access to city streets. d. Environmental Constraints: There are no known environmental constraints, such as steep slopes, streams, floodplains, or wetlands on the property, which could affect the proposed use. 2. Appropriate Design: Parking Scheme/Loading Areas: The existing garage and driveway provide sufficient parking to meet the minimum two (2) parking spaces required under zoning. b. Lighting: Chapter 27.26 of the Kalispell Zoning Ordinance sets standards for all outdoor lighting on commercial or residential structures. Any exterior lighting which may be installed would be required to meet those standards. C. Traffic Circulation: The site is served by a residential driveway off of a city street. d. Open Space: The property has a front and back yard with a lawn. Fencin Screenin andscaping: The yard contains a grass lawn. A portion of the back yard is fenced. f. Signage: There is no signage proposed at this time, and any signage in the future would need to comply with sign regulations for the R-3 zone. g. Interior Layout of Home: There has been recent work done in the basement of the home without a permit. Staff from the Kalispell Building Department inspected the property along with Planning Staff. There are several items that were noted as part of the inspection that the owner and applicant have agreed to correct, primarily the size 4 of egress windows and electrical work. They will obtain a building permit and need to complete the corrections prior to any occupancy. 3. Availability of Public Services/Facilities: Police: Police protection will be provided by the Kalispell Police Department. No unusual impacts or needs are anticipated from the project. b. Fire Protection: Fire protection will be provided by the Kalispell Fire Department. No unusual impacts or needs beyond a single-family residence are expected. Station 61 is approximately 0.6 miles from the subject property giving good response time. C. Water: City water is available and would serve the property with an existing main. d. Sewer: Sewer service will be provided by the City with an existing main. Storm Water Drainage: There are no special storm drainage requirements relating to the site. f. Solid Waste: Solid waste pick-up will be provided by the City. g. Streets: The property is on the corner of 8th Avenue East and loth Street East, which provides access to the greater City of Kalispell circulation system. h. Sidewalks: There are no sidewalks adjacent to the property or in the general vicinity. New sidewalks are not required in conjunction with a single-family or group home use absent a new subdivision being developed. Schools: This site is within the boundaries of School District #5. The group home would house girls ages 13-18 that would attend local schools, most likely Flathead High School, unless they are focused on employment or FVCC Running Start. Parks and Recreation: While there are no parkland requirements associated with this use, the property has a yard with recreational value and is across the street from Thompson Park, which is a city park. 4. Neighborhood impacts: Traffic: The property accesses existing public streets. Any impacts would be minimal and would be generally consistent with residential patterns in the area. The only vehicle in use would belong to a full-time staff member and the girls would not have cars. b. Noise and Vibration: The property is already developed as a single-family residence and the proposed use as a group home for eight or fewer supervised girls would be consistent with that type of use. C. Dust, Glare, and Heat: The use of the property as a group home would not generate any unreasonable dust, glare, and heat. d. Smoke, Fumes, Gas, or Odors: The use will not create additional smoke, fumes, gas and odors. Hours of Operation: As the property is proposed for residential use, there will be no specific hours of operation outside of typical residential functions. The operation of the group home incorporates supervision of the girls, including overnight. 5. Consideration of historical use patterns and recent changes: The area is an established, primarily single-family neighborhood in the east side of Kalispell. There have not been any recent changes and it is expected that the historical use of the neighborhood as residential will continue. 6. Effects on property values: No significant negative impacts on property values are anticipated as a result of the requested conditional use of the property. 7. Public comment: No comments have been received by staff. Proposed use Applicant shall lease the single-family residential home at 1005 81" Ave. East to Chrysalis Schools of Montana, to serve as a Youth Group home. The home will serve as a residence for up to 8 girls and one full time staff member as the girls attend local schools and pursue employment opportunities. B. Background Chrysalis is an all -girls therapeutic boarding school located in beautiful northwest Montana. Students come from around the country and are motivated to make healthy changes in their life. Chrysalis is a fully licensed high school and residential treatment center specializing in helping students establish a healthy identity. Chrysalis is not a rehab facility, and only accepts students who are not a known safety risk to themselves or others. Chrysalis students attend full time school and are active members in the community. Students are supervised by highly trained staff. In addition to school, their program includes family therapy, a robust adventure program, and bi-annual international travel. Program graduates are well rounded and self -aware young ladies who are prepared to enter young adulthood. C. Traffic flow and control There shall be minimal traffic impact on the neighborhood as the only vehicle in use shall belong to the full-time staff member. The students shall not have motor vehicles. D. Access to and circulation within the property There shall be no change to the existing residential access and circulation of the property. The home shall be used strictly for residential purposes and requires no alteration. E. Off street parking and loading Off street parking shall be provided for by the existing one car garage and the approximately 40x15 ft driveway. There is no need for a loading area. F. Refuse and service areas There are no service areas and residential trash service shall provide for refuse needs. G. General Structure Chrysalis students are supervised by qualified and trained staff. The girls have daily structure, and will attend either Flathead High School or the FVCC Running Start program Monday through Friday. Students living at this house will be advanced in their therapeutic process. Chrysalis has a measurable phase system, and clear expectations for what makes a student appropriate for the Kalispell transition house. These are students who are nearly ready to transition home to continue high school, or go on to college. The girls manage their schedule, with staff supervision. They have significantly more supervision and structure than a typical high school student. Any time a student is in the home there will always be a staff member, including awake staff at night. Why students enroll at Chrysalis Chrysalis serves teenage girls ages 13-18. There is a thorough and strict admissions process to ensure that a student is clinically and academically appropriate. The most common diagnosis for a Chrysalis student is anxiety and/or depression. Marry of our students have struggled to form a healthy identity, and perhaps have experienced some kind of trauma. Our students are invested in treatment, and their entire family is involved in the therapeutic process. These families have tried a variety of out patient or even partial hospitalization treatment options before seeking a 12-18 month residential program. We do not oppose this request for a conditional use permit. In fact, we support these types of group homes, as we have a grandson in such a facility in Utah at the current time. I do have one comment/request. The Report to the Commission, in the Conditions of Approval, says that "That the development of the site shall be in substantial conformance with the submitted application.". I propose that it be amended and approved with the following language: "That the development and use of the site shall be in conformance with the submitted application." The use of the site is equally as important as its development and the application contains important representations as to its use, such as the residents not having motor vehicles and no signs, etc. will be place on the property. I also deleted the word "substantial". I have practiced law for 48 years and have been involved in many disputes, including expensive litigation, over the meaning of the word substantial. It is best for the Chrysalis group, the City, and other homeowners in the area not to debate or fight over what is substantial compliance. Is it 33.3%, 50%, 80% compliance or the interpretation of some person or persons as to what is an important criterium and what is not? The application lays out clearly what is represented by the owner and the standards of the City are also clear. There is no reason why requiring compliance, not substantlal compliance, should be the standard. Thank you for considering my request. First, our entire extended family is concerned with the potential repercussions of starting a group home in this quiet neighborhood. I've spent a considerable amount of time reading the information posted on the Chrysalis School website. I am not opposed to what they are doing; I understand the immense need for additional support for children in difficult situations, and applaud the work they are doing! My concern is primarily with the location of the group home. I understand from reading that only girls who do not pose a threat on the safety of others would be admitted; however, this does not negate the potential influence they could have on peers around them, as I think about my niece growing up with these girls as her neighbors. My brother and sister-in-law are considering withdrawing their offer on this house, and they are discouraged as it's been a long process for them to even get to this point. They are also considering the resale value of their house, I understand that the proposal states that this would not be an issue; however, I think a vast majority of people would hesitate before purchasing a home across the street from a group home. Second, I've read through the provided documents online, and from what I understand, the city cannot deny a permit to such an establishment. My question is whether or not Chrysalis Group Home would be a non-profit organization. Maybe this doesn't matter, and maybe you could clarify for me, but if Chrysalis is a for -profit business, it concerns me that a business would be moving into a residential neighborhood.
