Mike,
I am notifying you at this time to advise you that the performance bond agreement
expires on May 27, 2005. It was requested that Walgreen's plant the required 4 (four
trees) on the boulevard. The location of the boulevards are; I" Ave WN (two trees) and
Montana St (two trees). If the work is not completed by May 27, 2005 or the City has
not received a notice the City Parks and Recreation Department will deposit the check of
$2,500 to pay for the work.

That the Developer shall provide for inspection of all required improvements prior to releaw fiom this
Agreement and that if the City determnes that any miproverrmts are not constructed m. compliauce with the
specifications, it "I furnish the Developer with a list of specific deficiencies and may withhold collateral
sufficient to insure such compliance.
If the City demnines that the Developer will not construct any or all of the improvements in accordance with
the specifications, or within the required time limits, it my wiflidmw the collateral and employ such funds as
may be necessary to construct the impirovement.or improvements in accordance with the specifications. The
unused portions of d-w collateral shall be returned: to the Developer or the crediting institution, as is
appropriate -
