Item 1 is okay. Item 2 is okay. Item 3 we are not able to do the non-refundable clause. We do not have the authority to agree. Although we understand their reasons for wanting this, we just can't do it. Chris suggested that maybe it could be said that since we are agreeing to the 1031 they could agree to removing this request. Item 4, 5, and 6 are okay. We need to add two other changes: 1. We are having a delay in getting the appraiser and we also need a review appraiser. Since the closing date has been moved out, we would like to extend the completion of the appraisal to January 31, 2004. 2. We missed it the first time looking at the contract, but we are not able to get governing body ratification the same day the appraisal comes it. We are required to get it on a Council agenda & then bring it forward at the Council meeting. By extending the appraisal date to January 31, and allowing for the 3 business days they recommend for review in item 4 of their counter offer, the new date for ratification would be February 23. It may be possible to make a February 9th meeting, but I'm afraid that will be cutting it too close and I'd rather say a safe date than risk the whole thing falling through.
