05-14-09 Site Review MinutesSITE DEVELOPMENT REVIEW COMMITTEE SUMMARY Thursday, May 14, 2009 Lower Level Main Conference Room 201 First Avenue East ATTENDING: Charlie Johnson, Construction Manager Jeff Clawson, Building Official Frank Castles, Deputy Public Works Director Sean Conrad, Senior Planner Dan Diehl, Acting Fire Chief Michelle Anderson, Recording Secretary Guests: James Freyholtz, MDT. Hear the Public: No one wished to speak. Paul Burnham, Assistant City Engineer Tom Jentz, Planning & Bldg Director Chad Fincher, Parks Superintendent Roger Krauss, Police Dept. P.J. Sorensen, Chairman Performance Bond Reminders: Johnson said Diamond Ridge has a maintenance bond coming up and he has been in touch with Carver Engineering who indicated they are still working on it. Fincher said he will be meeting with Tim Birk regarding a plan for the trees and parkland for Spring Creek Estates. Johnson suggested that Fincher let Mr. Birk know that the trees in front of the stop signs have to be transplanted to another location. OLD BUSINESS: None. NEW BUSINESS: Montana Nugget— 740 West Idaho: Sorensen noted October lst is when the new law kicks in that prohibits smoking in buildings. Montana Nugget has brought in pictures and a site plan for a 5 ft x 10 ft smoking hut. The but looks similar to a bus shelter, clear on all sides, and no advertising. The existing building has 5 foot overhangs and the shelter will be under it. If they decide they want to have a sign it would be processed as any other sign request. The but will be located next to the building so it will not be interfering with the parking lot and setbacks won't be an issue. Diehl felt this would be an extension of the footprint of the building and there could be code issues. If the structure would be considered part of the building Transportation Impact Fees would be required as well. Sorensen said if other departments want a copy to let him know and he asked the committee to provide him with final comments at the next meeting. PLANNING OFFICE ITEMS: Montana Academy Youth Home — 3"d Street East: Conrad reviewed the conditional use permit for the Montana Academy youth group home that would operate on 3"d Street East near the Conrad Mansion (no relation). This facility would be an overflow home for their other group homes in the neighborhood. Conrad said this is an existing duplex that is owned by the Academy that they have been renting out. Under State law, zoning has to treat these applications like a residential use and can provide a forum for public comment. Diehl said he will need to know how many youths they will be licensed to house and Conrad said there can't be more than 8 residents. Conrad will ask for the number of residents who will be in each unit and whether or not the facility will be co-ed. Faith Covenant Presbyterian Church — 3"d Avenue and 6t" Street East: Conrad reviewed the proposed expansion of the Faith Covenant Presbyterian Church. The expansion would be a 2-story structure for classroom/meeting rooms and additional restroom facilities. The Building and Fire Department noted that sprinkling the building could be required and their design professionals should contact the departments on that issue. Public Works will do a walk -around the site and look specifically at sidewalks and the alley, and added the alley will need to be paved. Sorensen said the parking lot design could be changed that could potentially shift the access points. Fincher noted that when the sidewalks are replaced their department wants to be consulted on the proper pruning oftree roots. Conrad said they will be completing the work in phases. OTHER REPORTS: Spring Creek Apartments — Appleway: Johnson noted fill has been placed between Appleway and the creek which is a floodplain issue. They did get a floodplain permit and have submitted a LOMR to FEMA. Sorensen noted there are a lot of floodplain issues on this site which still need to be resolved and he will be meeting with the Mayor, Planning Director and their engineer and Sparrow Group tomorrow to discuss them. Further discussion was held. Three Rivers Bank: Sorensen said the list of comments from the committee was forwarded to the bank but he has not yet heard back from them. Sorensen added they were in a preliminary stage and not ready to submit plans at this time. Grizzly Security — Husky Street: Roger Krauss noted staff from the Police Department did an on -site review of the Grizzly Security building and he noted they plan to open in June and they have a vault for safety deposit boxes at this facility. Krauss said although he doesn't know how many employees they will have it appears that there is not sufficient parking on site for those using the boxes. Sorensen said he would look into the parking situation and noted there are other issues including the razor wire and remodeling without a building permit, however Greg Harris is working with Dwain Elkins of the Building Department now. Jentz updated the committee on the Pre-release Center, which has failed at the proposed location; and the 23-unit Senior Apartments proposed for Grandview Drive that was before the planning board Tuesday evening. The meeting was adjourned at 10:45 a.m.
