AN EMERGENCY ORDINANCE ALLOWING THE TEMPORARY USE OF THE
PROPERTY AT 1110 2"0 STREET NEST, KALISPELL, MONTANA, PREVIOUSLY
UTILIZED AS AN ARMORY AND WHICH IS CURRENTLY USED AS A HOMELESS
SMELTER AND ZONED P-1, AS A SHELTERING IN PLACE FACILITY FOR THE UN -
HOMED POPULATION FOR A PERIOD TO END 30 DAYS AFTER THE GOVERNOR'S
COVID-19 PANDEMIC "SMELTER IN PLACE" ORDER IS LIFTED; AND
ESTABLISHING AN IMMEDIATE EFFECTIVE DATE.
WHEREAS, due to the COVID-19 pandemic, the Governor of Montana issued a "shelter in place"
directive for all residents of the State of Montana; and
WHEREAS, on March 19, 2020, the Flathead County Commissioners, by resolution, declared a
Public Health Emergency related to COVID-19, pursuant to § 10-3-402, MCA; and
WHEREAS, on April 6, 2020, pursuant to §10-3402, MCA, the City Manager, as principal
executive officer of the City of Kalispell, declared a local state of emergency for the
City of Kalispell in response to the potential resource challenges of COVID-19
infections locally, which findings were approved and adopted by the Kalispell City
Council by emergency ordinance, Ordinance No. 1840, that same day; and
WHEREAS, on April 10, 2020, the Flathead County Health Officer and Incident Commander,
notified the Kalispell City Manager by letter, a copy of which is attached hereto and
incorporated into these recitals as "Exhibit "A", of the determination that the City of
Kalispell and its immediate environs has an un-homed population at risk of an
outbreak of COVID-19 due to the lack of social distancing and access to facilities to
ensure hygiene and medical care and the ability to shelter in place; and
WHEREAS, in the same notification to the Kalispell City Manager, the Flathead County Health
Officer and Incident Commander advised him that it had been determined that the
facilities located at 1110 2"d Street West, Kalispell, Montana, Zoned P-1, previously
the Armory and currently utilized by the Samaritan House, a homeless shelters has the
unique capacity to house and care for the un-homed population for sheltering in place
and specifically requested that the land use of the subject property be approved for
the above described temporary emergency use; and
WHEREAS, the Flathead COVID-19 Emergency Shelter Collaborative is a public/private alliance
brought together for the purpose of providing temporary emergency shelter for un-
homed individuals who need to safely shelter in place pursuant to the Governor's
"shelter in place" order; and
WHEREAS, the Flathead COVID-19 Emergency Shelter Collaborative has provided to the City a
specific plan for utilizing the property at 1110 2"d Street West, Kalispell, Montana as
a facility to house and care for the un-homed population for sheltering in place, a
copy of which is attached hereto as Exhibit "B" and incorporated into these recitals.
NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA, AS FOLLOWS:
SECTION 1, Pursuant to the authority of MCA § 10-3-402, and KMC 2-26 the Kalispell
City Council hereby approves the temporary land use of the property
located at 1110 2nd Street west, Kalispell, Montana for the purpose of
providing temporary emergency shelter for un-homed individuals who
need to safely shelter in place pursuant to the Governor's "shelter in place"
order, by the means and plans set forth in Exhibit "B", attached hereto and
fully incorporated herein by this reference.
SECTION 2. This Ordinance, pursuant to KMC 2-26, is effective upon passage and
approval and shall be in effect for no longer than 30 days after the
Montana State Governor lifts the "shelter in place" order or for no longer
than ninety (90) days, whichever is less.
PASSED AND APPROVED BY THE CITY COUNCIL BY AT LEAST 213RD VOTE AND
SIGNED BY THE MAYOR OF THE CITY OF KALISPELL, MONTANA THIS 20TH DAY OF
APRIL, 2020.

Dear Mr. Russell,
As the lead public health official in Flathead County and the Incident Commander for the COVID-19
response, I am writing to formally request that you temporarily waive the zoning regulations for
1110 2nd Street West to allow for the use of this location as shelter during the COVID-19 event.
The spread of COVID-19 in the Flathead is raising a great deal of concern. We have been working to halt
the spread of the virus through efforts such as school and business closures. However, we have
recognized that our un-homed population is at risk of an outbreak due to lack of social distancing, and a
lack of access to facilities to ensure hygiene and medical care. While individuals experiencing
homelessness are exempt from the Governor's Directives he has strongly urged communities to make
shelter available as soon as possible to put in operation mitigation practices.
We have been working to find a location that could allow for sheltering in addition to food,
facilities, behavioral health services, medical services and isolation/quarantine quarters. The
identified location is 1110 2nd Street (Nest, Kalispell. However, in order to utilize this facility the
zoning for this property needs to be waived during this emergency public health event.
The creation of this shelter is a vital part of Flathead County's COVID-19 emergency plan and
based on that fact I request that City of Kalispell waive the applicable zoning regulations starting
immediately until one month after the lifting of the 'Stay at Home" Directive from Governor
Bullock. Our hospitals and healthcare services have limited capacity and we are doing all we can
to bend the curve to ensure they can serve everyone requiring care. The implementation of this
temporary shelter will help ensure we are further protecting our community.

NEED
Supportive care serving the unhoused population during the COVID-19 crisis.
PURPOSE
To provide temporary emergency shelter for unhoused individuals during the COVID-19 crisis who
need to safely shelter in place and who may end up needing behavioral and/or medical support.
OPERATIONAL PERIOD
Begins: Immediately, once location and resources are secured.
Ends: one month after the Governor's "Shelter in Place" order is lifted, allowing time for transition of
clients and clean-up of the site.
