BACKGROUND: A request from WGM Group and DNRC for a major subdivision of an 8.3-acre
remainder tract of land located within DNRC Section 36 into one 8.3-acre multi -family lot. The lot
proposed to be subdivided is part of Section 36, which is primarily owned and managed by the
Montana Department of Natural Resources and Conservation for the benefit of Montana's school
trust. The proposed subdivision site is zoned R-4/PUD, a mixed residential zoning district originally
adopted in 2001 and amended in 2003 (DNRC — Spring Prairie KPUD-03-01). The tract being
subdivided was identified as part of the "mixed residential" pod in the PUD. This land use theme was
intended to provide a suitable location for a mix of residential uses, including high -density multi-
family. Since the lot is part of a previous subdivision that created more than five lots a major
subdivision application is required. The application was reviewed in accordance with Section 28.2.06
of the Kalispell Subdivision Regulations.
The subject property is located along Treeline Road, north of Bloomstone, west of Kidsports and
south of the new My Place hotel. The property can be legally described as a tract of land being a 8.3-
acre portion of parcel 1 of Certificate of Survey 17217, on file and of record in Flathead County,
Montana; located in the northeast one quarter of the southwest one quarter of Section 36, Township
29 North, Range 22 West, Principal Meridian, Montana, more particularly described in the attached
exhibit "A".
The Kalispell Planning Board held a duly noticed public hearing May 14, and May 22, 2019, to
consider the preliminary plat request. Staff presented staff report KPP-19-01 providing details of the
proposal and evaluation. Staff recommended that the Planning Board adopt the staff report as
findings of fact, and recommend to the Council that the preliminary plat be approved with eleven (11)
conditions.
During the public comment portion of the hearing on May 22, a representative of the applicant spoke
in favor of the request. There being no further public testimony, the public hearing was closed and a
motion was presented to adopt staff report KPP-19-01 as findings of fact and recommend to the
Kalispell City Council that the preliminary plat for Snowline be approved. A brief board discussion
concluded that the request was appropriate, and the motion passed unanimously on roll call vote.
RECOMMENDATION: It is recommended that the Kalispell City Council approve Resolution
5922, a resolution approving a request from Montana Department of Natural Resources for major
subdivision Preliminary Plat KPP-19-01, a major subdivision preliminary plat with 11 conditions of
approval, located in a tract of land being an 8.3-acre portion of parcel 1 of Certificate of Survey
17217, on file and of record in Flathead County, Montana; located in the northeast one quarter of the
southwest one quarter of Section 36, Township 29 North, Range 22 West, Principal Meridian,
Montana, more particularly described in the attached exhibit "A".
FISCAL EFFECTS: There are no anticipated fiscal impacts at this time.
ALTERNATIVES: Deny the request.

A RESOLUTION CONDITIONALLY APPROVING THE PRELIMINARY PLAT OF
SNOWLINE, DESCRIBED AS A TRACT OF LAND BEING A 8.3-ACRE PORTION OF
PARCEL 1 OF CERTIFICATE OF SURVEY 17217, LOCATED IN THE NORTHEAST
QUARTER OF THE SOUTHWEST QUARTER OF SECTION 36, TOWNSHIP 29 NORTH,
RANGE 22 WEST, P.M.M., FLATHEAD COUNTY, MONTANA, AND MORE PARTICULARLY
DESCRIBED ON EXHIBIT "A".
WHEREAS, Montana DNRC, the owner of the certain real property described above, has petitioned
for approval of the Subdivision Plat of said property; and
WHEREAS, the Kalispell City Planning Board and Zoning Commission held a public hearing on May
14, 2019 and May 22, 2019 on the proposal and reviewed Subdivision Report #KPP-19-
01 issued by the Kalispell Planning Department; and
WHEREAS, the Kalispell City Planning Board and Zoning Commission has recommended approval of
the Preliminary Plat of Snowline subj ect to certain conditions and recommendations; and
WHEREAS, the city council of the City of Kalispell at its regular council meeting of June 3, 2019,
reviewed the Kalispell Planning Department Report #KPP-19-01, reviewed the
recommendations of the Kalispell City Planning Board and Zoning Commission, and
found from the Preliminary Plat, and evidence, that the subdivision is in the public
interest.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA AS FOLLOWS:
SECTION 1. That the Findings of Fact contained in Kalispell Planning Department Report
#KPP-19-01 are hereby adopted as the Findings of Fact of the city council.
SECTION 2. That the application of Montana DNRC for approval of the Preliminary Plat of
Snowline, Kalispell, Flathead County, Montana is hereby approved subject to the
following conditions:
1. The development of the site shall be in substantial compliance with the application submitted, the
site plan, materials and other specifications as well as any additional conditions associated with
the preliminary plat as approved by the city council.
2. The preliminary plat approval shall be valid for a period of three years from the date of approval.
3. The developer shall submit to the Kalispell Public Works Department prior to construction an
erosion/sediment control plan for review and approval and a copy of all documents submitted to
Montana Department of Environmental Quality for the General Permit for Stormwater Discharge
Associated with Construction Activities.
4. The developer shall submit water and sanitary sewer plans, applicable specifications, and design
reports to the Kalispell Public Works Department and the Montana Department of Environmental
Quality for concurrent review, with approval of both required prior to construction.
5. A letter from the Kalispell Public Works Department shall be submitted stating that all new
infrastructure has been accepted by the City of Kalispell or a proper bond has been accepted for
unfinished work.
6. All existing and proposed easements shall be indicated on the face of the final plat. Utility
easements for city water and sewer shall be provided to allow for the logical extension of utilities
from this subdivision to adjoining properties. A letter from the Kalispell Public Works
Department shall be obtained stating that the required easements are being shown on the final
plat.
7. A letter shall be obtained from the Kalispell Parks and Recreation Director approving a landscape
plan for the placement of trees and landscaping materials within the landscape boulevards of
Treeline Road. The approved landscape plan shall be implemented or a cash in lieu payment for
installation of the street trees and groundcover be provided to the Kalispell Parks and Recreation
Department.
8. The following statement shall appear on the final plat: "The undersigned hereby grants unto each
and every person, firm or corporation, whether public or private, providing or offering to provide
telephone, telegraph, electric power, gas, cable television, water or sewer service to the public, the
right to the joint use of an easement for the construction, maintenance, repair, and removal of
their lines and other facilities, in, over, under, and across each area designated on this plat as
"Utility Easement" to have and to hold forever."

9. A minimum of two-thirds of the necessary infrastructure for the subdivision shall be completed
prior to final plat submittal.
10. All utilities shall be installed underground.
11. All areas disturbed during development shall be re -vegetated with a weed -free mix immediately
after development.
SECTION 3. Upon proper review and filing of the Final Plat of said subdivision in the office
of the Flathead County Clerk and Recorder, said premises shall be a subdivision
of the City of Kalispell.

A report to the Kalispell City Planning Board and the Kalispell City Council
regarding a preliminary plat to create one 8.3-acre multi -family lot within DNRC
Section 36. A public hearing has been scheduled before the planning board for May
22, 2019, beginning at 6:00 PM in the Kalispell City Council Chambers. The
planning board will forward a recommendation to the Kalispell City Council for final
action.

G. General Land Use Character: The subdivision is proposed within the
mixed residential POD of the DNRC Neighborhood Plan, which provides for
a mixture high and low density residential development. Over the last 15
years there has been a number of developments consisting of the Kalispell

Bypass, Glacier High School, the US Forest Service, Treeline Center
commercial development and Montana DNRC Offices to the north and west.
The land to south located within the Bloomstone PUD has started to
develop with both single-family and multi -family developments. Kidsports is
also in the process of expanding its boundaries adjacent the eastern
boundary of the proposed subdivision. Finally, fire station 62 has been
constructed to the east.

REVIEW AND FINDINGS OF FACT FOR THE PRELIMINARY PLAT OF BRIGHT
VIEW SUBDIVISION
A. Effects on Health and Safety:
Fire: The property is considered to be at low risk of fire because the
subdivision and structures within the subdivision will be constructed in
accordance with the International Fire Code and have access meeting city
standards. The lot abuts Treeline Road, which is an improved city street
providing good access to the site.
Fire station 62 is located on Old Reserve Drive, less than 0.25 miles to the
east of the subdivision.
Flooding: Flood Insurance Rate Map, panel number 30029C 1805J,
November 4, 2015, shows the entire subdivision to be outside of the 100-
year floodplain.
Access: Access to the subdivision is provided by Treeline Road, an
improved city street. There is an existing pathway located within the bypass
right-of-way west of the proposed subdivision and there are existing
sidewalks within the Treeline Road right-of-way fronting the subdivision.
B. Effects on Wildlife and Wildlife Habitat: The subdivision is not located in
known big game habitat and the property is not considered suitable habitat
for other significant wildlife.

C. Effects on the Natural Environment:
Surface and groundwater: The nearest surface water is the Stillwater River,
approximately 5,000 feet east of the subdivision. Groundwater is relatively
deep in the area, with depths greater than 50 feet at the subdivision site.
Drainage: The property owner will be required to develop an onsite storm
drainage system. A final storm water design will be reviewed and approved
by Kalispell Public Works prior to building permit issuance of a multi-
family project on the property.
D. Effects on Local Services:
Water and Sewer: Water and sewer service to the subdivision will be
provided by existing water and sewer mains located in Treeline Road public
right-of-way.
Roads: Development of the site will include primary ingress and egress from
Treeline Road, which is an improved public street that was constructed to
city standards. Any development of the property that creates 300 or more
vehicle trips per day would require a traffic impact study. The traffic study
evaluates the impacts the development has on the traffic system and
indicates mitigation necessary to maintain acceptable levels of service.
Schools: The property is within the boundaries of School District #5 (High
School) and West Valley Elementary. The school district could anticipate
additional school aged children from the subdivision. Although we don't
know what will be developed onsite, it is likely that the site will develop with
multi -family, which could have a large impact on the districts.
Section 76-3-608(1) of the Montana Code Annotated states that the
governing body may not deny approval of a proposed subdivision based
solely on the subdivision's impacts on educational services.
Parks and Open Space: Per the Kalispell Subdivision Regulations, park
dedication is not required for lots over 5-acres in size. In this case, an 8.3-
acre lot is being created. At the time the site develops, provisions for open
space, depending on the number of dwelling units being constructed will be
evaluated. Additionally, all of the setbacks for the property count as open
space and will be reviewed at the time of building permit onsite.
Police: This subdivision is in the jurisdiction of the City of Kalispell Police
Department. The department can adequately provide service to this
subdivision.
Fire Protection: Fire protection services will be provided by the City of
Kalispell Fire Department. Old Reserve Drive and Treeline Road provide

adequate access. Fire station 62 is approximately 0.25 miles away from the
subdivision providing excellent response time.
Solid Waste: Solid waste will be handled by the city. There is sufficient
capacity within the landfill to accommodate this additional solid waste
generated from this subdivision.
Medical Services: Ambulance service is available from the fire department
and ALERT helicopter service. Kalispell Regional Medical Center is
approximately 2 miles from the site.
E. Effects on Agriculture and agricultural water user facilities: The
subject property is in an urbanized area and the property lies completely
within city limits and adjacent to city water and sewer services. There will
be no impact to agriculture facilities in this case, as the property has not
been used for agriculture for years and is surrounded by development in all
directions. No impact to water user facilities are anticipated since the
property will be served by a public water system.
F. Relation to the Kalispell Growth Policy: The Kalispell Growth Policy
Future Land Use map for the area indicates this area is anticipated to be
developed as a high -density residential area. Additionally, the DNRC
neighborhood Plan designates the tract of land as "mixed residential,"
which anticipates multi -family development for which the proposed 8.3-
acre site could provide.
G. Compliance with Zoning: The proposed subdivision site is zoned R-
4/PUD, a residential zoning district originally adopted in 2001 and
amended in 2003 (DNRC - Spring Prairie KPUD-03-01). The site being
subdivided is identified as part of the "mixed residential" pod in the PUD,
which provides for residential development.
H. Compliance with the Kalispell Subdivision Regulations: This
subdivision complies with the Kalispell Subdivision Regulations and no
variances have been requested.
RECOMMENDATION
Staff recommends that the Kalispell City Planning Board and Zoning Commission
adopt staff report KPP-19-01 as findings of fact and recommend to the Kalispell
City Council that the preliminary plat of Treeline Center be approved, subject to
the conditions listed below:

CONDITIONS OF APPROVAL
1. The development of the site shall be in substantial compliance with the
application submitted, the site plan, materials and other specifications as
well as any additional conditions associated with the preliminary plat as
approved by the city council.
2. The preliminary plat approval shall be valid for a period of three years from
the date of approval.
3. The developer shall submit to the Kalispell Public Works Department prior
to construction an erosion/ sediment control plan for review and approval
and a copy of all documents submitted to Montana Department of
Environmental Quality for the General Permit for Stormwater Discharge
Associated with Construction Activities.
4. The developer shall submit water and sanitary sewer plans, applicable
specifications, and design reports to the Kalispell Public Works Department
and the Montana Department of Environmental Quality for concurrent
review, with approval of both required prior to construction.
S. A letter from the Kalispell Public Works Department shall be submitted
stating that all new infrastructure has been accepted by the City of
Kalispell or a proper bond has been accepted for unfinished work.
6. All existing and proposed easements shall be indicated on the face of the
final plat. Utility easements for city water and sewer shall be provided to
allow for the logical extension of utilities from this subdivision to adjoining
properties. A letter from the Kalispell Public Works Department shall be
obtained stating that the required easements are being shown on the final
plat.
7. A letter shall be obtained from the Kalispell Parks and Recreation Director
approving a landscape plan for the placement of trees and landscaping
materials within the landscape boulevards of Treeline Road. The approved
landscape plan shall be implemented or a cash in lieu payment for
installation of the street trees and groundcover be provided to the Kalispell
Parks and Recreation Department.
8. The following statement shall appear on the final plat: "The undersigned
hereby grants unto each and every person, firm or corporation, whether
public or private, providing or offering to provide telephone, telegraph,
electric power, gas, cable television, water or sewer service to the public, the
right to the joint use of an easement for the construction, maintenance,
repair, and removal of their lines and other facilities, in, over, under, and
across each area designated on this plat as "Utility Easement" to have and to

hold forever."

shall be completed prior to final plat submittal.
10. All utilities shall be installed underground.
