BACKGROUND: WGM Group Inc. submitted a request, on behalf of State of Montana Department of
Natural Resources and Conservation for final plat approval of Snowline Acreage. Snowline Acreage final
plats an 8.3-acre remainder tract of land located within DNRC Section 36 into one multi -family lot.
The lot proposed to be subdivided is part of Section 36, which is primarily owned and managed by the
Montana Department of Natural Resources and Conservation for the benefit of Montana's school trust.
The subject property is located along Treeline Road, north of Bloomstone, west of Kidsports and south
of the My Place hotel. The property can be legally described as a tract of land being a 8.3-acre portion
of parcel 1 of Certificate of Survey 17217, on file and of record in Flathead County, Montana; located
in the northeast quarter of the southwest quarter of Section 36, Township 29 North, Range 22 West,
Principal Meridian, Montana, more particularly described in the attached exhibit "A".
The City Council approved the preliminary plat with 11 conditions in June 2019, with Resolution 95922.
All of the conditions have been met or adequately addressed. The following report summarizes the
applicant's compliance with the conditions of approval contained within Resolution 45922.
RECOMMENDATION: It is recommended that the City Council make a motion to approve the final
plat for Snowline Acreage.
FISCAL EFFECTS: Positive impacts once developed.
ALTERNATIVES: Deny the request.

COMPLIANCE WITH CONDITIONS OF APPROVAL
General Conditions:
The development of the site shall be in substantial compliance with the application submitted,
the site plan, materials and other specifications as well as any additional conditions associated
with the preliminary plat as approved by the city council.
Staff Response: This condition has been met. The final plat submitted is in compliance with the
approved preliminary plat.
2. The preliminary plat approval shall be valid for a period of three years from the date of approval.
Staff Response: This condition has been met. The preliminary plat was approved in June of
2019, thus being well within the allowable three-year time window.
3. The developer shall submit to the Kalispell Public Works Department prior to construction an
erosion/sediment control plan for review and approval and a copy of all documents submitted to
Montana Department of Environmental Quality for the General Permit for Stormwater Discharge
Associated with Construction Activities.
Staff Response: This condition has been met. An erosion control plan and construction
document have been reviewed and approved by both Public Works and the Montana Department
of Environmental Quality.
4. The developer shall submit water and sanitary sewer plans, applicable specifications, and design
reports to the Kalispell Public Works Department and the Montana Department of Environmental
Quality for concurrent review, with approval of both required prior to construction.
Staff Response: This condition has been met. Water and sanitary sewer plans for proposed work
have been reviewed and approved by both Public Works and the Montana Department of
Environmental Quality. See attached letters.
5. A letter from the Kalispell Public Works Department shall be submitted stating that all new
infrastructure has been accepted by the City of Kalispell or a proper bond has been accepted for
unfinished work.
Staff Response: This condition has been met. The infrastructure supporting the one lot
subdivision was previously approved and accepted by the City of Kalispell during construction
of Treeline Road.
6. All existing and proposed easements shall be indicated on the face of the final plat. Utility easements
for city water and sewer shall be provided to allow for the logical extension of utilities from this
subdivision to adjoining properties. A letter from the Kalispell Public Works Department shall be
obtained stating that the required easements are being shown on the final plat.
Staff Response: This condition has been met. All existing and proposed easements are shown
on the face of the attached final plat. A letter from Public Works stating such is attached hereto
for reference.
7. A letter shall be obtained from the Kalispell Parks and Recreation Director approving a landscape
plan for the placement of trees and landscaping materials within the landscape boulevards of
Treeline Road. The approved landscape plan shall be implemented or a cash in lieu payment for
installation of the street trees and groundcover be provided to the Kalispell Parks and Recreation
Department.
Staff Response: This condition has been met. A landscape plan has been approved the Kalispell
Parks Department and email stating such is attached hereto for reference.
8. The following statement shall appear on the final plat: "The undersigned hereby grants unto each
and every person, firm or corporation, whether public or private, providing or offering to provide
telephone, telegraph, electric power, gas, cable television, water or sewer service to the public, the
right to the joint use of an easement for the construction, maintenance, repair, and removal of their
lines and other facilities, in, over, under, and across each area designated on this plat as "Utility
Easement" to have and to hold forever."

Staff Response: This condition has been met. The note is on the final plat.
9. A minimum of two-thirds of the necessary infrastructure for the subdivision shall be completed
prior to final plat submittal.
Staff Response: This condition has been met. All of the required infrastructure for the creation
of this on lot has been installed and accepted by the City of Kalispell.
10. All utilities shall be installed underground.
Staff Response: This condition has been met. All of the utilities have been installed underground
within Treeline Road.
11. All areas disturbed during development shall be re -vegetated with a weed -free mix immediately
after development.
Staff Response: This condition has been met. DNRC has seeded the property and has continually
maintained the vacant land to suppress the weeds.
COMPLIANCE WITH THE SUBDIVISION REGULATIONS:
This subdivision plat has been found to be in compliance with the State and City subdivision regulations.
COMPLIANCE WITH THE ZONING REGULATIONS
This subdivision complies with the Kalispell Zoning Ordinance and the R-4/PUD zoning for the
property.
RECOMMENDATION:
It can be found that the conditions of preliminary plat approval have been met or are otherwise adequately
addressed. It is recommended that the Kalispell City Council approve the final plat for Snowline
Acreage. Please schedule this matter for the regular city council meeting on March 2, 2020.

**The plat must be signed by all owners of record, the surveyor and the .examining land surveyor.
Attach a letter, which lists each condition of preliminary plat approval, and individually state how
each condition has specifically been met. In cases where documentation is required, such as an
engineer's certification, State Department of Health certification, etc., original letters shall be

A complete final plat application must be submitted no less than 60 days prior to expiration date
of the preliminary plat.
When all application materials are submitted to the Kalispell Planning Department, and the staff
finds the application is complete, the staff will submit a report to the governing body. The
governing body must act within 30 days of receipt of the revised preliminary plat application and
staff report. Incomplete submittals will not be accepted and will not be forwarded to the governing
body for approval. Changes to the approved preliminary plat may necessitate reconsideration by
the planning board.

As engineer of record for Snowline Acreage (Frontier Village Apartments Lot), I hereby
certify that all of the conditions stated in Resolution No. 5922 have been addressed to the
best of my knowledge.
Enclosed is the Final Plat application for the Snowline Acreage, The conditions of approval
are listed below along with how each has been addressed:
I. The development of the site shall be in substantial compliance with the application
submitted, the site plan, materials and other specifications as well as any additional
conditions associated with the preliminary plat as approved by the city council.
The development of the site is in substantial compliance with the Preliminary Plat
documents as approved by City Council. Please see enclosed Resolution No. 5922 -
Preliminary Plat Conditions of Approval.
2. The preliminary plat approval for the development shall be valid for a period of three
years from the date of approval.
The preliminary plat was approved in June of 2019 and is still valid.
3. The developer shall submit to the Kalispell Public Works Department prior to
construction an erosion/sediment control plan for review and approval and a copy of
all documents submitted to Montana Department of Environmental Quality for the
General Permit for Storm Water Discharge Associated with Construction Activities.

A RESOLUTION CONDITIONALLY APPROVING THE PRELIMINARY PLAT OF
SNOWLINE, DESCRIBED AS A TRACT OF LAND BEING A 8.3-ACRE PORTION OF
PARCEL 1 OF CERTIFICATE OF SURVEY 17217, LOCATED IN THE NORTHEAST

WHEREAS, Montana DNRC, the owner of the certain real property described above, has petitioned
for approval of the Subdivision Plat of said property; and
WHEREAS, the Kalispell City Planning Board and Zoning Commission held a public hearing on May
14, 2019 and May 22, 2019 on the proposal and reviewed Subdivision Report #KPP-19-
01 issued by the Kalispell Planning Department; and
WHEREAS, the Kalispell City Planning Board and Zoning Commission has recommended approval of
the Preliminary Plat of Snowline subject to certain conditions and recommendations; and
WHEREAS, the city council of the City of Kalispell at its regular council meeting of June 3, 2019,
reviewed the Kalispell Planning Department Report #KPP-19-01, reviewed the
recommendations of the Kalispell City Planning Board and Zoning Commission, and
found from the Preliminary Plat, and evidence, that the subdivision is in the public
interest.
NOW THEREFORE, BE 1T RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,
MONTANA AS FOLLOWS:
SECTION 1. That the Findings of Fact contained in Kalispell Planning Department Report
#KPP-19-01 are hereby adopted as the Findings of Fact of the city council.
SECTION 2. That the application of Montana DNRC for approval of the Preliminary Plat of
Snowline, Kalispell, Flathead County, Montana is hereby approved subject to the
following conditions:

6. LIABILITY OF THE COMPANY MUST BE BASED ON THIS COMMITMENT
(a) Only a Proposed Insured identified in Schedule A, and no other person, may make a claim under this Commitment.
(b) Any claim must be based in contract and must be restricted solely to the terms and provisions of this Commitment.
(c) Until the Policy is issued, this Commitment, as last revised, is the exclusive and entire agreement between the parties with
respect to the subject matter of this Commitment and supersedes all prior commitment negotiations, representations, and
proposals of any kind, whether written or oral, express or implied, relating to the subject matter of this Commitment.
(d) The deletion or modification of any Schedule B, Part II — Exception does not constitute an agreement or obligation to

(f) When the Policy is issued, all liability and obligation under this Commitment will end and the Company's only liability will

consisting of one lot that has been reviewed by personnel of the Permitting and Compliance
Division, and,
THAT the documents and data required by ARM Title 17 Chapter 36 have been submitted and
found to be in compliance therewith, and,
THAT the approval of the Plat is made with the understanding that the following conditions shall
be met:
THAT the lot shall be used for six apartment „buildings, not to exceed 128 living units, and,
THAT the water system for the entire lot will be provided by extension and service connection to

THAT the privately -owned sewer collection system, including sanitary sewer mains and services,
shall be maintained by Frontier Village LLC, or future improvements owner, who is a leasee to the
Montana DNRC. Maintenance shall be in accordance with the Operation and Maintenance
Manual.

THAT the storm water conveyance and collection system shall be constructed in accordance
with the approved plans and specifications prepared by Michael J. Brodie, #28348 PE of WGM
Group of Kalispell, received 10/18/2019. A storm water certification letter was signed by the
City of Kalispell on 08114/2019, as a 15t class municipality, accepting responsibility for review
and approval of storm water within this subdivision, and,
THAT the storm water conveyance and detention system shall generally consist of crowned
asphalt streets, curb and gutter, storm catch basin inlet structures, storm drain piping, storm
manholes, and four storm drainage ponds (totaling 37,000 cu.ft.), and,
THAT Frontier Village LLC, or future improvements owner (leasee to Montana DNRC), is
responsible to operate and maintain the storm water structures within the property, and,
THAT construction of the water main improvements, sanitary sewer wastewater collection
system improvements and Storm Water Improvements shall be completed within three years of
the date of this approval. If more than three years pass before beginning construction, it shall
be necessary to resubmit the plans and specifications.
THAT once construction is completed upon the water, sanitary sewer or storm drainage system,
the professional engineer shall certify to the Department that the construction, alteration or
extension was completed in accordance with the plans and specifications without deviation from
the plans approved by the Department, and,
THAT within 90 days of the project certification, a complete set of "as -built" drawings bearing
the signature and seal of the professional engineer must be submitted to the Department, and,
THAT all sanitary facilities must be located as shown on the attached lot layout, and,
THAT the developer and/or owner of record shall provide each purchaser of propertv with a
copy of the Plat, approved location of water supply, sewage treatment s stem and storm water
conveyance system, as shown on the attached lot layout and a copy of this document and
THAT instruments of transfer for this property shall contain reference to these conditions, and.
THAT departure from any criteria set forth in the approved plans and specifications and Title
17, Chapter 36, Sub -Chapters 1, 3, and 6 ARM when erecting a structure and appurtenant
facilities in said subdivision without Department approval, is grounds for injunction by the
Department of Environmental Quality.
THAT the plans and specifications for any proposed sewage treatment systems will be
reviewed and approved by the county health department and will comply with local regulations
and ARM, Title 17, Chapter 36, Subchapters 3 and 9, before construction is started, and,

SEWER SYSTEM DESCRIPTION
Frontier Village apartments are served by a series of 8" SDR 35 gravity sewer lines
and precast concrete manholes. All of the buildings are connected to the gravity
sewer main by 6" SDR 35 sewer service lines. The proposed sewer plans and profiles
have been included in Appendix A of this Operation and Maintenance memorandum.

SHORT TERM MAINTENANCE RECOMMENDATIONS
Gravity sewer systems are relatively low maintenance. Manhole lids should be pulled
and inspected no less than once every six months to ensure there is no blockage or
backups in the system. Additionally, the inspector shall take note of any apparent
seepage from manhole walls or areas of concrete degradation.
Once every five (5) years, it is recommended that the Frontier Village LLC (or owner
of the apartments at that time) do the following:
1. Pull each of the manhole lids (eight total) to check for any blockage, sediment
build up, or backed up sewage flows.
2. Lines should be jetted (sprayed with high pressure water) during these
inspections to remove any sediment build up in the lines.

Thank you for the plans and specifications and engineering report for the proposed water and sewer
main extensions associated with the Frontier Village Apartments subdivision in Kalispell, received June
28, 2019 -- November 8, 2019, under the Professional Engineer's seal of Michael J. Brodie, #28348PE.
The proposed water and sewer extension was reviewed in accordance with Circular DEQ-1 design
standards, 2014 Edition and Circular DEQ-2 design standards, 2016 Edition. City of Kalispell approval
of the public water mains was received on October 15, 2019.
The plans and specifications for the water and sanitary sewer mains proposed in Frontier
Village Apartments, received October 1$ 2019 are hereby approved with the condition listed
below. One copy of the plans and specifications bearing the approval stamp of the Department of
Environmental Quality is enclosed. A second set will be retained as Department Record.
Condition One: Approval of the water and sewer main extensions is conditioned upon
approval of the entire subdivision currently under review, referenced by EQ#19-2284.
The Frontier Village Apartments project is designed to serve six buildings, with a total of 128 apartment
living units. Peak water demand (domestic and irrigation) is estimated at 194 gpm. Peak hourly
wastewater flow rate is estimated at 72 gpm.
The water main extension includes installation of.- approximately 1000 feet of 8-inch diameter water
main (C900 PVC CL150), 5 gate valves, 3 fire hydrant assemblies, and two connections to the existing
water main in Tree Line Road. Each apartment building will be served with one domestic service
connection and one fire service. Fire hydrant flow testing and water modeling illustrate a fire flow
capacity exceeding 2000 gpm at 20 psi can be provided. Each building must be installed with an
internal building fire sprinkler system.

The sanitary sewer main extension includes installation of: approximately 1200 feet of 8-inch diameter
gravity sewer main (SDR 35 PVC), 8 new manholes and connection to one existing manhole in Tree
Line Road. One service connection per apartment building is planned. The sanitary sewer
infrastructure will be owned by Frontier Village LLC, as such they are responsible for all operation and
maintenance of sanitary sewer within the lot boundaries. The privately -owned sewer mains discharge
to City of Kalispell sanitary sewer collection located in Treeline Road.
Approval is given with the understanding that any deviation from the approved plans and specifications
will be submitted to the Department for reappraisal and approval. The project may not be placed into
service until the project engineer or designer certifies by letter to the Department that the activated
portion of the project was constructed in substantial accordance with the plans and specifications
approved by the Department and there are no deviations from the design standards other than those
previously approved by the department. Within 90 days after the completion of construction, a
complete set of certified "as -built" drawings must be signed and submitted to the department.
It is further understood that construction will be completed within three years of this date. If more than
three years elapse before completing construction, plans and specifications must be resubmitted and
approved before construction begins. This three-year expiration period does not extend any compliance
schedule requirements pursuant to a Department enforcement action against a public water or sewage
system.
Department approval of this project covers only those portions of the plans and specifications that are
subject to the Department's review authority under the Public Water Supply Laws (MCA 75-6) and the
Administrative Rules promulgated thereunder (ARM 17.38), This approval does not cover items found
within the plans and specifications that are outside of the Department's review authority, including but
not limited to: electrical work, architecture, site grading or water and sewer service connections.

Re: Frontier Village Apartments Engineering Approval
Dear Mr. Brodie:
The drawings submitted on October 11 ', for the above project are hereby approved. The
following deviation requests were made and are approved for only this project. Several site and
project specific factors were taken into consideration before granting these deviations. The same
deviations may not be approved for future projects.
The request to deviate from standard 7.1.5F.I(a) to allow a non standard approach to
stormwater pretreatment.
The request to deviate from standard 7.1.5H.II to allow less than 50 feet of separation
between the maximum water surface of a pond and a building foundation.
Two reviews were done at a cost of $180 each. Please submit the review fee of $360 to the
Public Works front desk.
Approval does not relieve you, nor the contractor from designing or constructing this project in
accordance with the City Standards currently in effect. If more than 18 months lapse before
completing construction, plans and specifications must be resubmitted and approved before
construction continues. Any modifications made to these approved plans shall be submitted for
review prior to construction.
This approval is for the Public Works Department only and not does necessitate full City
approval. If additional approvals from other City Departments are required they should continue
to be pursued.
Please contact the Public Works Department at (406)758-7720 to set up a pre -construction
meeting prior to beginning construction. A Right -of --Way and Stormwater permit must be
obtained by the prime contractor for this project. At project completion, please provide the
City with hard copy and electronic record drawings.

Re: Will Serve —Frontier Village Apartments
Dear Mr. Brodie:
The purpose of this letter is to inform you that the City of Kalispell is willing and able to provide
service to the proposed apartment complex located on DNRC land adjoining Treeline Road. The
property has been reviewed by this office and has been determined to have adequate water
supply, sewer collection, and solid waste disposal available to it.
Per our records, water service is available to the property via a 12" PVC water main in Treeline
Road. Likewise, sewer collection is also available to the property via a 10" PVC sewer main in
Treeline Road. Sanitary sewer in this area is subject to latecomer fees.
Storm drainage, sanitary sewer, water design and potential right-of-way improvements are being
reviewed for compliance with the City of Kalispell Standards for Design and Construction, and
must be approved prior to construction. This letter is not intended as an approval civil site
design.
The provision of these services are contingent upon the development meeting minimum design
and construction standards, plan reviews, approvals, zoning regulations, payments of all
applicable fees, and meeting all other rules, regulations, and codes applicable to the site. Final
evaluation of city utility capacities will be completed during the plan review process.

Hi Patrick,
I am working to put the Final Plat Application together for this project and hope you can help me out
on a couple of things.
Has there been a street number assigned to this parcel yet? I will need to show that on the Plat
drawing, and I am not sure who to talk to about that.
One of the conditions of approval is that 2/3rds of the infrastructure be installed prior to the Final
Plat Application. In this situation, doesn't the existing water and sewer mains in Treeline Road, as
well as Treeline Road itself, satisfy this condition for a single lot subdivision?
