Resolution 5952 - ROI - Amend SKURP - 18th & Airport Rd ProjectRESOLUTION NO.5952 A RESOLUTION CALLING FOR A PUBLIC HEARING ON THE PROPOSED AMENDMENT TO THE SOUTH KALISPELL URBAN RENEWAL PLAN TO APPROVE THE AIRPORT ROAD AND 18TH STREET WEST URBAN RENEWAL PROJECT AS RECOMMENDED BY THE KALISPELL CITY PLANNING AND ZONING BOARD. WHEREAS, the City of Kalispell, Montana (the "City") is authorized by Montana Code Annotated, Title 7, Chapter 15, Parts 42 and 43, as amended (the "Act"), to create an urban renewal area, to undertake urban renewal projects therein, to provide for the segregation and collection of tax increment with respect to property taxes collected in the urban renewal area, to issue its bonds to pay the costs of such projects and to pledge to the repaymentof the bonds the tax increment derived from the urban renewal area; and WHEREAS, in accordance with the provisions of the Act, this Council adopted Ordinance No. 1242, on July 1, 1996, establishing an urban renewal area within the City designated as the "City of Kalispell Airport/Athletic Complex Urban Renewal District" (the "Urban Renewal Area") and adopted an urban renewal plan therefor, entitled the "Kalispell City Airport/Athletic Complex Redevelopment Plan Analysis" (the "Urban Renewal Plan"), after duly mailed and published notice and a public hearing and receipt of recommendations from the City/County Planning Board, which certified that the Urban Renewal Plan conforms to the general plan for the development of the City as a whole and the comprehensive plan of the City for the area containing the Urban Renewal Area; and WHEREAS, by Ordinance No. 1260, adopted by this Council on March 17, 1997, this Council amended Ordinance No. 1242 to provide for the segregation of and application of tax increment in the Urban Renewal Area and established January 1, 1996 as the base year for calculating the tax increment as provided in Sections 7-15-4282 through 7-15-4293 of the Act; and WHEREAS, by Ordinance No. 1541, adopted by this Council on July 19, 2005, this Council amended Ordinance No. 1260 to include additional projects consistent with and in furtherance of the Plan; and WHEREAS, on July 5, 2016, this Council passed Ordinance No. 1774, amending Ordinance No. 1541, with findings adopting a study by CTA Architects, referred to now as the South Kalispell Urban Renewal Plan, which identified, among other things, recommended improvements to the vehicular and pedestrian transportation facilities within the Urban Renewal District; and WHEREAS, thereafter the City contracted with WGM Engineering to facilitate an urban renewal project consistent with and in furtherance of the South Kalispell Urban Renewal Plan, and referred to as the Airport Road and 18th Street West Project, designed to mitigate the vehicular and pedestrian impacts of various new developments in the Urban Renewal Area, that included the addition of an elementary school as well as housing and apartment developments; and WHEREAS, WGM Engineering presented the 30% design and cost estimate for the Airport Road and 18th Street West Project to the Urban Renewal Agency, which approved it and forwarded it to the Kalispell Planning Board for public hearing; and WHEREAS, pursuant to MCA 7-15-4213, on November 12, 2019, the Kalispell Planning and Zoning Board took public comment on the Airport Road and 18th Street West Project at a noticed public hearing, reviewed and considered it as to its conformity with the Kalispell Growth Policy Plan -It 2035 and transmitted it to the City Council with the finding that the Project conforms to the Kalispell Growth Policy Plan -It 2035 and should be adopted by the City Council; and WHEREAS, an Ordinance has been proposed to be adopted by this Council (the "Ordinance") which would amend the Urban Renewal Plan to adopt the Airport Road and 18th Street West Project as recommended by the Kalispell City Planning and Zoning Board; and WHEREAS, under Sections 7-15-4214, 7-15-4215 and 7-15-4221 of the Act, it is necessary to conduct a public hearing on the amendment of the Urban Renewal Plan and approval of any of the Urban Renewal Projects therein. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: Section 1. Public Hearings On December 16, 2019, at 7:00 p.m., in the Council Chambers in the Kalispell City Hall, the City Council will conduct a public hearing on the proposed amendment of the Urban Renewal Plan to adopt the Airport Road and 18th Street West Project and incorporate it into the South Kalispell Urban Renewal Plan as recommended by the Kalispell City Planning and Zoning Board. Section 2. Notice of Public Hearing. The City Clerk is hereby authorized and directed to publish a copy of the Notice of the Public Hearing in substantially the form attached hereto as Exhibit A (which is hereby incorporated herein and made a part hereof) twice in The Daily Interlake, the official newspaper of the City and published in Flathead County, Montana, with not less than six days separating each publication date, and to mail a copy of said notice, not less than 10 days before the date of the public hearing, to every person or entity whose names appear on the County Treasurer's tax roll as the owners, reputed owners, or purchasers under contracts of deed of real property within the Urban Renewal Area at the addresses shown on the tax roll. SON Illll l I IIl1\ CITY OF KALISPELL, MONTANA NOTICE OF PUBLIC HEARING NOTICE IS HEREBY GIVEN that the City Council (the "Council") of the City of Kalispell, Montana (the "City") will hold a public hearing on the proposed amendment to the South Kalispell Urban Renewal Plan (the "Plan") on December 16, 2019, at 7:00 p.m., at the Council Chambers in the Kalispell City Hall, 201 1 st Avenue East, Kalispell, Montana. The Plan relates to an urban renewal area within the City designated as the "South Kalispell Urban Renewal District" (the "Urban Renewal Area"), which encompasses the municipal airport and certain adjacent property. The proposed amendment of the Plan is the Airport Road and 18th Street West Project contained within the South Kalispell Urban Renewal Plan published on the City of Kalispell website and accessed at kalispell.com/agendacenter. The Project is designed to mitigate the vehicular and pedestrian impacts of various new developments in the Urban Renewal Area, including an elementary school, apartments, and housing developments.
