RESOLUTION NO —4315
A RESOLUTION TO ABANDON AND DISCONTINUE THE DEDICATED PUBLIC STREET
KNOWN AS 'AA STREET" RUNNING ALONG THE NORTH SIDE OF LOT 9, BLOCK 5,
KNOLL'S ADDITION, KALISPELL, MONTANA.
WHEREAS, on the 30th day of September, 1996, the City of
Kalispell received a petition from Carver Engineering, Inc., on
behalf of Ronald M. Henry, Trustee for the Lloyd L. Dahl
Testamentary Trust, owner of Lot 9 through 16, Block 5, Knoll's
Addition, Kalispell, Flathead County, Montana, requesting that the
City of Kalispell abandon and discontinue the street located along
the north side of Lot 9, Block 5, Knoll's Addition, pursuant to
Section 7-14-4114, M.C.A., and
WHEREAS, notice of said petition was published in the Daily
Inter Lake on the 911 day of February, 1997, and
WHEREAS, on the 18th day of February, 1997 the City Council of
the City of Kalispell held a public hearing to hear proponents and
opponents on the closure and to further determine any action, that
would serve the public interest, and
WHEREAS, it was determined that the petition hereinbefore
mentioned was properly presented to the Council, and
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION I. All that part of the City street located 20
feet running along the north side of Lot 9,
Block 5, Knoll's Addition, Kalispell, Montana,
is hereby discontinued as the same was never,
nor ever will be, used for public
transportation and the public interest will be
served by its discontinuance.

The enactment of this Resolution shall not
affect nor impair the right of any public or
municipal utility to continue to maintain its
plant or equipment in said street.

SICTION III, This Resolution shall take effect immediately
upon passage by the City Council and approval
by the Mayor.
