RESOLUTION NO. 4300
A RESOLUTION TO ALTER AND AMEND THE CONTRACT WITH NUPAC ON 14TH
STREET EAST ROADWAY AND UTILITY PROJECT.
WHEREAS, the City on July 9,1996 did enter into a contract
with NUPAC, Kalispell, MT for the construction of certain roadway
and utility improvements on 14th Street East, and
WHEREAS, certain elements in the project required addition
time to complete ; and said additional time requirements could not
have been necessarily foreseeable when the original construction
contract into, and said changes are contained in Exhibit "A",
attached hereto and are by this reference made a part hereof; and
WHEREAS, upon the advise and recommendation of Fred Zavodny,
PWD, it appears in the best interests of the City to approve said
changes and alterations.
NOW THEREFORE, pursuant to the provisions of Section 7-5-
4308(1) MCA be it hereby resolved:
1. The alterations and modifications of the contract between
the City of Kalispell and NUPAC, dated July 9, 1996, as set out in
Exhibit "A" attached hereto are hereby approved, and
2. As soon as the alterations and modifications are agreed to
in writing, signed by the Public Works Department, as hereby
approved by the Council, this approval thereof shall be in effect.

Re: 14"' Street East Roadway and Utility Project - Request For Change Order 1
The date of substantial completion for the 14"' St. East Project was September 20t".
Contractually the project completion date was September 1 11. A time extension of 19
calendar days or 14 work days is requested.
Justification is as follows:
1. The Contract was bid with Schedule IV, additional storm drain construction, as
optional depending on bid prices and budget limitations. Schedule IV was awarded
but no additional time was granted within the contract. A seven (7) day extension is
requested for this item.
2. Acceptable water main disinfection tests were difficult to achieve. No specific reason
for the test failures were determined. The logistics of the project prohibited other
significant construction operations from being accomplished while water testing
operations were being conducted. A seven (7) day extension is requested for this
item.
3. The storm drain outfall structure required additional piping components to achieve
design parameters. An additional three days were required to obtain the
components and install them. A three (3) day extension is requested for this item.
4. A number of unanticipated conflicts with existing gas mains were encountered. Two
lost days can be attributed to the gas main conflicts and investigations. A two (2) day
extension is requested for this item.
The contractor performed in a workmanlike manner throughout the project and the request
for additional time is reasonable and prudent. I recommend approval of this change order.
