04-30-09 Site Review MinutesSITE DEVELOPMENT REVIEW COMMITTEE SUMMARY Thursday, April 30, 2009 Lower Level Main Conference Room 201 First Avenue East ATTENDING: Charlie Johnson, Construction Manager Tom Jentz, Planning & Bldg Director Frank Castles, Deputy Public Works Director Susie Turner, Stormwater Engineer Dan Diehl, Acting Fire Chief Michelle Anderson, Recording Secretary Paul Burnham, Assistant City Engineer Sean Conrad, Senior Planner Chad Fincher, Parks Superintendent Dwain Elkins, Plans Examiner P.J. Sorensen, Chairman Guests: James Freyholtz, MDT, Rory Young, Jackola Engineering. Hear the Public: No one wished to speak. Performance Bond Reminders: The bonds for Aspen Creek and Lone Pine Trails are expired and need to be finished. OLD BUSINESS: None. NEW BUSINESS: Northwest Transition Center — 2280 Hwy 93 South: Sorensen noted there will be an addition on the back side of the building and some other changes. The CUP had conditions one of which was dealing with the easements. Jentz said the frontage road needs to be placed squarely within an easement and the current easements need to be removed from the parking lot and building area. Rory Young from Jackola Engineering said those easement issues will be resolved with a revised COS after their contract with CCCS has been secured. Young reviewed the existing landscaping and their plans for additional landscaping. Young asked if the 24' access road along the north side of the building could be used as a two-way street and Sorensen said yes it was wide enough. Young added they plan to add signage and street markings for safety. Public Works noted the ends of the island should be rounded, and landscaping added to the island will better define it. Young agreed. Diehl said the Fire Department would need a natural curve around the island so they can get around the building. Young also added the fire sprinklers will be brought up to code. Sorensen asked what kind of fence will be used around the exercise yard and Young said a standard chain link fence, 5 — 6 feet tall, with a magnetic/electronic lock that would open when the fire alarm is activated. Regarding lighting there will be soffit down -lights added to the outside of the building and Sorensen noted when the building permit is submitted they should include an outdoor lighting plan. Young said there is an existing water supply coming into a janitor's closet which T's and goes into an irrigation meter and domestic water supply meter. What they would like to do is take out the domestic water supply meter but keep the irrigation meter and the main domestic water supply would be a new 2" tap which would save them from having to back feed the irrigation system. Castles said he doesn't have a problem with that and noted a backflow preventer has to be installed on the sprinkler system. There was discussion regarding the timeframe for building permit submittal and construction which Young thought Swank is looking at starting work the beginning of June. Jentz noted the Pre -Release Committee will be meeting about mid -May to give the project their final review. Sorensen added the State still needs to make a final decision on the location and there is a 60 day protest period after the 2nd reading of the ordinance for the zone change. Young asked for an estimate of the impact fees and was told to contact Susie Turner in the Public Works Department. PLANNING OFFICE ITEMS: Accessible Space — 23-unit Assisted Living Facility — Grandview Drive: Conrad said Greg Lukasik of Morrison-Maierle contacted Paul Burnham of Public Works about the cash -in -lieu payment and ASI said based on their funding they cannot be the lead on the contract to put in the bike path through the property or the sidewalk/street improvements along Grandview Drive. Burnham said these are standard requirements and it is now up to ASI and HUD to figure out a way to resolve that issue since the city cannot do the work on private property. Jentz noted the current property owner could be the one to complete those improvements then increase the price of the lot. Burnham said that may be an option or they pay that fee directly to the contractor. Further discussion was held. Village Plaza 5 lot subdivision waiver — East Evergreen: Conrad asked if Public Works was able to take a look at the property and are there any issues with waiving the preliminary plat or conditions that should be added to create the lots. Burnham said they looked at it last week and Turner said Public Works decided a geo-tech report will not be required but the stormwater report will be. They discussed a bike path along East Evergreen Drive, however east of this property the road becomes very steep and a bike path would not be extended. Conrad noted there is a sidewalk and boulevard that is grass but no street trees are present and Fincher agreed trees should be installed or payment in lieu could be arranged. Conrad will prepare the waiver letter and add the issues discussed. Valcon subdivision waiver — 5t" Avenue WN: Conrad reviewed the 2 lot subdivision on 5th Avenue WN just north of the Cenex grain elevators. Castles said the plat needs to clearly depict the city owned easements within the subdivision including storm sewer, sanitary sewer, and water mains. In addition they need to identify "Railroad Street" as a private driveway. Sorensen said the lot line proposed follows an existing fence line and asked if it could be changed to be a more rectangular shaped lot since it would make it difficult to be redeveloped and Conrad said he would talk to them. Turner said since there is no development currently proposed no stormwater report would be needed at this time. Diehl said the Fire Department doesn't have any issues until the property is developed. Conrad said he will prepare the waiver letter and add the issues discussed. Temporary Signs Off -Premise Signage Text Amendment: Sorensen reported this is a text amendment that city council directed staff to do for off -premise temporary signs such as the ones directing people to open houses. The signs would not be in the R/W but on private property. The fee to display these signs would be $120.00 for a 6-month period. OTHER REPORTS: All-weather access for construction sites: No further issues were discussed. The process will be put in place. Temporary Signs on Sidewalks Downtown: Sorensen said this is another text amendment that city council has directed staff to do which would allow sandwich -board signs on the sidewalks in the downtown area. Staff is looking at limiting the signs to the boundaries of the Business Improvement District or possibly the B-4 zoned area. The City Attorney's office has some concerns about liability so a requirement that the business owner has to carry additional insurance indemnifying the City will be included. James Freyholtz of MDT noted there could be ADA & Federal advertising control issues and he will find out and report back to the committee. Paul Burnham of Public Works stated he felt it would be inappropriate to put sandwich -board signs on the sidewalk transportation corridor. The appropriate width for an "open" sidewalk would be not less than what is required by ADA which Sorensen stated is 3 feet. He suggested adding a provision that a 3 foot corridor on the sidewalk would have to be maintained at all times. Further discussion was held regarding current sign regulations and the area where this type of sign would be allowed. Sorensen said a permit will be required that would include an indemnity for the city, which the City Attorney is currently formulating. This issue will be discussed again next week. 245 Windward Way: Sorensen stated there are 2 suites in that building that the developer is requesting C of O's for and they suggested holding off on the C of O for the shell until the issues discussed previously can be resolved. Diehl said no C of O should be issued until the sprinkler system is fixed. Public Works agreed and noted as soon as they have made the corrections needed to the handicap ramp they should contact the city. Sorensen will respond to their request. Bob's Professional Bail Bonds — Main Street: Sorensen reviewed the history of this property and said previously they were told that if they intended to continue to use the building as office space, building/fire code issues and improvements to the property frontage on 12th Street East, among other things, needed to be addressed. At that time they indicated the use was going to be reverted back to a house and they would probably use the parking for the Wachholtz building across the street. Sorensen continued currently it is being used as professional office space. Therefore the following was decided: The sidewalk and improvements to 12th Street East need to be completed; they need to contact the Fire Department and Building Department regarding the code issues; they would now be subject to impact fees; and would be required to install street trees. Sorensen will contact them. Conditional Use PermitNouth Shelter — 3"d Street East: Conrad noted the Planning Department has received a conditional use permit for a youth shelter located on 3rd Street East near the Conrad Mansion. Bloomstone: Conrad said he received a call from Mike Baker who noted Bloomstone is looking at starting their first phase, however they are modifying part of their first phase and when that information is received Conrad will send it to the committee. Woodland Intersection: Fincher noted next Wednesday at 1:30 p.m. Mike Baker is asking to meet with Public Works regarding the intersection issues. Burnham said he will attend and Fincher said he will let Burnham know where the meeting will be held. Red's, Wines & Blues Expansion: Jentz noted the project will be moving ahead. Diehl added the Fire Department is working with Bill Goodman on solutions to bring the rest of the KM Building into code. The expansion to Red's will be sprinkled and the building permit can be issued for that work. Westview Estates Park: Johnson asked Parks & Rec what work is being done on the park in Westview Estates and Fincher said they cleaned up the edge of the parking lot adding he had talked to Ben prior to doing that work. He added when it is all done there will actually be more asphalt than there is now. Fincher said they brought the gravel to within a few feet of the door and there is a basketball all -surface court that will be installed south of this site. Fincher will contact Ben.
