A RESOLUTION OF INTENT TO ENACT A STORMWATER ORDINANCE IN ORDER
TO IMPLEMENT AND ENFORCE A STORMWATER MANAGEMENT PROGRAM
PURSUANT TO FEDERAL AND STATE LEGAL REQUIREMENTS, SETTING A PUBLIC
HEARING AND DIRECTING THE CITY CLERK TO PROVIDE NOTICE THEREOF.
WHEREAS, based upon its population, the City of Kalispell is required to comply with MCA §
75-5-101 et seq. and ARM §§ 17.30.1101; 17.30.1301 et seq. and 17.30.1401 et seq.
for Storm Water Discharge Associated with Small Municipal Separate Storm Sewer
System (commonly referred to as "MS4" permitting); and
WHEREAS, a draft ordinance, attached hereto and incorporated fully herein by this reference, has
been prepared for the purpose of bringing the City into further compliance with the
MS4 requirements by combining and updating the existing stormwater ordinances
regarding construction and illicit discharges in order to ,implement a Stormwater
Management Program; and
WHEREAS, prior to enacting the ordinance the City should hold a public hearing on the matter to
allow the public to provide input on the draft ordinance after giving due and proper
notice of said hearing.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION 1. That there is hereby set a Public Hearing on the 21 st day of October, 2019, at
7:00 o'clock p.m. in the Council Chambers, City Hall, Kalispell, Montana, to
discuss a proposal to enact an updated stormwater ordinance as required by
Federal and State law.
SECTION 2. The City Clerk is hereby authorized and directed to make, publish and
distribute notices of said Public Hearing in conformity with State law. The
City Clerk shall further make the proposed draft ordinance, attached hereto,
available to the public upon the Kalispell City Website and in paper format
upon request.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF THE
CITY OF KALISPELL, ON THE 7TH DAY OF OCTOBER, 2019.

NOTICE OF PUBLIC HEARING
A proposal to enact a Stormwater Management Program Ordinance, as required by Federal
and State law, will be presented at a Public Hearing, Monday, October 21, 2019, in the Council
Chambers of City Hall, 201 1 st Avenue East, Kalispell, Montana, at 7:00 P.M.
Based upon its population, the City of Kalispell is required to comply with MCA § 75-5-101
et seq. and ARM §§ 17.30.1101; 17.30.1301 et seq. and 17.30.1401 et seq. for Storm Water
Discharge Associated with Small Municipal Separate Storm Sewer System (commonly referred to as
"MS4" permitting).
Any person wishing to address the proposed ordinance may appear at this hearing and make
oral statements or present same in writing. Written comments may also be submitted for Council
consideration by delivering the same to the City Clerk prior to the hearing. If there are questions that

The proposed draft ordinance is available on-line at www.kalispell.com or in the office of the
City Clerk during regular business hours.
