RESOLUTION NO. 4191
A RESOLUTION TO ADOPT THE FEES* SCHEDULES, RATES, CHARGES AND
CLASSIFICATION IMPOSED ON THE CUSTOMERS OF THE CITY OF KALISPELL
SEWER UTILITY.
WHEREAS, the City of Kalispell has an infrastructure investment of
$17,404,743.00 in its waste water treatment plant and
sanitary sewer collection system, and
WHEREAS, the City's sewer connection fee of $500-00 ($625.00
outside the city) has not kept pace with either the cost
of inflation or the City's infrastructure investment, and
WHEREAS, in order to replace and improve the sewer system it is
necessary to build a capital cash account to be used to
replace all or a portion of the waste water treatment
plant and sanitary sewer collection system, and
WHEREAS, because the city has classifications of users outside who
do not utilize the City's collection system but do
utilize the City's waste water treatment plant, it is
appropriate that the city have collection fees based upon
the use of city facilities, and
WHEREAS, in order for the City to provide for the replacement of
the waste water treatment plant and sanitary sewer
collection system based upon a decline in capacity due to
an increase in connections, it is appropriate that the
City index the connection fees, and
WHEREAS, said proposed adjustment of sewer connection fees is
reasonable and just and is not contemplated to yield more
than a 12% increase in the total amount of annual revenue
to the city of Kalispell Sewer Utility, and
WHEREAS, the City Council did, on the 19th day of September, 1994
set a public hearing to be held on November 7, 1994 on
said proposed adjustment of sewer connection fees of the
Sewer Utility Services of the City of Kalispell and gave
the necessary Notice thereof as required by Section 69-7-
ill, M.C.A., and
WHEREAS, due and proper Notice of said public hearing has been
given by the Finance Director by publication and mailing
as required by law; and
WHEREAS, said public hearing was duly held by the City Council at
a public meeting thereof in the Kalispell City Hall
beginning at 7:00 P.M. on November 7, 1994, and all

furnished to the Clerk of Council at said meeting or
prior thereto were given consideration by the Council.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL:
SECTION 1. That the fees, schedules, rates, charges and
classifications applicable to the use of the City of
Kalispell Sewer System and other services performed by
said utility as set forth on Exhibit "A" attached hereto
and by this reference made a part hereof, are found to be
just and are hereby established and adopted to be imposed
for sewer utility services to the inhabitants of the City
of Kalispell and those other persons served by its sewer
utility service.
SECTION II. This decision is final ten (10) days after
filing of this Resolution with the City Finance Director.
The Finance Director shall file a copy hereof with the
Public Service Commission of Montana at that time.
PASSED AND APPROVED BY THE CITY COUNCIL AND MAYOR OF THE CITY
OF KALISPELL THIS 5TH DAY OF DECEMBER -, 1994.

All users connected to the City Water Utility System and
also connected to the Sewer System will be assessed Sewer

gallons of all water registered on the Water Meter
