A RESOLUTION APPROVING THE PRELIMINARY PLAT OF THE SUBDIVISION OF
TRACT 3, LOT 3 IN THE NW1/4 SW1/4 OF SECTION 18, TOWNSHIP 28 NORTH,
RANGE 21 WEST, P.M.M., FLATHEAD COUNTY, MONTANA.
WHEREAS, Frank Taverrite, the owner of certain real property
described as Tract 3, Lot 3 in the NW1/4 SW1/4 of Section 18, T28N,
R21W, P.M.M., Flathead County, Montana, has petitioned for approval
of a subdivision of said property, and
WHEREAS, the proposed subdivision is subject to the provisions
of Section 2.2, Subdivision Regulations of the City of Kalispell,
and
WHEREAS, the Kalispell City -County Planning Board and Zoning

Commission has recommended approval of the Preliminary Plat of
Tract 3, Lot 3 in the NW1/4 SW1/4 of Section 18, T28N, R21W,

Report #KPP-94-01, reviewed the recommendations of the Kalispell
City -County Planning Board and Zoning Commission, and found from
the Preliminary Plat, and evidence, that the subdivision is in the
public interest, and
WHEREAS, the City Council has based its public interest
findings upon the following findings of fact:
A. RELATION TO MASTER PLAN:
The property is designated by the Kalispell City -County Master
Plan as residential. The proposed subdivision would comply
with that designation.
B. RELATION TO ZONING:
The property is zoned RA -I, the proposed subdivision is in
basic compliance with that zone. However, the cul-de-sac lots
would be required to be redesigned to meet the minimum front
lot width requirement of 60 feet measured at the building
setback line.
C. COVENANTS:

D. EFFECTS ON PUBLIC HEALTH AND SAFETY:
The site is not within a designated 100--year floodplain or
high hazard fire area. The site is within the service area of
Kalispell fire and police services and city ambulance. The
streets in the area are not paved and contribute to
Kalispell's none attainment status with respect to airborne
particulate as set by the EPA.
E. EFFECTS ON WILDLIFE AND WILDLIFE HABITAT:
The site lies on the urban fringe of Kalispell. It is not a
designated winter range and is not considered prime or
necessary habitat for any species. There is no known rare or
endangered vegetation on the site. No significant impact is
expected.
F. EFFECTS ON THE NATURAL ENVIRONMENT:
Topography does not pose a serious constraint on the property.
Due to the presence of City sewer and water, ground water
pollution is not a major concern. No significant
environmental impact is expected.
The site does have possible development constraints however,
they are not insurmountable. The sewer that exists in 8th
Street West is too close to the surface for gravity feed from
this development. A lift station or other means would need to
be constructed to eliminate this problem.
G. EFFECTS ON LOCAL SERVICES/FACILITIES:
a. Schools: The creation of 9 lots would allow the
development of up to 18 residential structures
(duplex on each lot) without additional review by
the City in the form of a conditional use permit.
Such a project could be expected to generate
anywhere from 9 to 24 school -age children, again
depending on the scale of development proposed and
the types of families attracted to this area. The
project is anticipated to have impact on the local
school system.
b. Parks and Recreation: State law provides that 1/9
of the undeveloped value of the land be designated
for park land. In this case, park land is
unsuitable, consequently, the applicants will be
required to pay a cash -in -lieu of park land payment
of 1/9 of the undeveloped value of the land. The
applicant puts the site market value at $47,500.
One -ninth of this value .would be $5277.

C. Fire Protection: The site is presently within the
Kalispell City Fire Department jurisdiction.
Response times will be within acceptable standards.
d. Police Protection: The site is within the
Kalispell Police Dept. jurisdiction. Response
times will be within acceptable standards and the
area can be serviced.
e. Roads: Forsythe Avenue is also unpaved, since this
will be a primary route to 7th Avenue West and
Meridian Road it should also be paved. These dirt
roads should be paved from existing pavement on Sth
Street West to existing pavement on 7th Street
West. Improvements not abutting this property
should include 24 foot of paving.
Sth Street West and Wallace Avenue, where they abut
this property, are unimproved and should be
improved to City Standards. These streets are
required to be improved with pavement, curb,
gutter, sidewalk, and street trees.
The interior cul-de-sac would be improved to city
standards for a 40 foot ROW with a 50 foot radius
cul-de-sac.
f. Water/Sewer: The City can serve the proposed
development with water and sewer. Extensions of
the mains would be required to be constructed by
the developer to City standards. In addition, a
lift station would need to be constructed onsite to
an existing sewer main capable of handling the
flows. All improvement costs would be borne by the
developer.
g. Solid Waste: Kalispell municipal garbage pickup is
available and can handle the increased demand in
service.
h. Public Health Services: Adequate medical
facilities exist within the City of Kalispell to
address any reasonable need.
S. EFFECTS ON AGRICULTURE:
The site is located within the urban fringe of Kalispell
and is not considered suitable or desirable agricultural
land. ■

SECTION I. That the application of Frank Taverrite for
approval of the Subdivision Plat of Tract 3, Lot 3 in the
NW1/4 SW1/4 of Section 18, Township 28 North, Range 21 West,
P.M.M., Flathead County, Montana is hereby approved subject to
the following conditions:
1. The plat shall be approved by the Department of Health
and Environmental Sciences.
2. All utilities shall be placed underground.
3. The preliminary plat is valid for a period of one year.
Within that period of time, or as extended by the City,
the applicant shall submit a final plat with attachments
as required by the Kalispell Subdivision Regulations, to
the City for final review and recording.
4. That Forsythe Avenue and Wallace Avenue be improved to
City Standards with 24 feet of pavement from 8th Street
West to 7th Street West.
5. That 8th Street West, where it abuts this project, shall
be improved to city standards with curb, gutter,
sidewalk, and street trees. Pavement to connect with
pavement on Forsythe Avenue.
6. That this project shall be connected to City water and
sewer services that have sufficient capacity; a lift
station may be acquired.
7. The cul-de-sac shall be improved to City Standards for a
40 foot roadway easement with a fifty-five foot radius
bulb right of way.
8. Cash -in -lieu of parkland fees totaling $5277 shall be
paid based on 1/9 of the undeveloped market value of the
land.
9. Mail delivery locations shall be provided with the design
and location approved by the local postmaster of the U.
S. Postal Service. If a common delivery site(s) is
chosen such facility shall be offset from the edge of the
traveled roadway a minimum of eight feet and a pull -off
area for at least one vehicle shall be provided.
10. Developer obtain City Council approval for reduction of
cul-de-sac width.
11. A fire hydrant will be installed as directed by the City
Fire Chief.
12. Final plat shall show the location of the lot at 60 feet
width and indicate the building setback.
13. Access shall not be gained to the subject property from
the east side of the subdivision.
SECTION II. The classification of said premises under the
Kalispell Zoning Ordinance shall not be changed by the action.
SECTION III. That this preliminary plat should be effective
for a period of one year following passage of this Resolution.
SECTION III. That upon proper review and filing of the final
plat of said subdivision in the office of the Flathead County
Clerk and Recorder, said premises shall be a subdivision of
the City of Kalispell.
