RESOLUTION NO. 4124
A RESOLUTION AUTHORIZING THE UTILIZATION OF PROGRAM INCOME DERIVED
FROM THE SOUTHWEST KALISPELL HOUSING REHABILITATION PROJECT CDBG
GRANT FOR EMERGENCY HOUSING REHABILITATION ACTIVITIES ANYWHERE
WITHIN THE CITY OF KALISPELL.
WHEREAS, the City of Kalispell has been allocating Urban
Development Action Grant (UDAG) Program Income and
funds derived through Tax Increment Financing (TIF)
for housing rehabilitation and other related
housing activities for the past several years, and
WHEREAS, the emergency housing rehabilitation activity was
established in 1990 for the specific intent of
making emergency low interest loan or a deferred
loan to low and very low income residents within
the city limits on a first -come, first serve basis
each year, and
WHEREAS, the use of CDBG Program Income from the Southwest
Kalispell Housing Rehabilitation Project solely for
emergency housing repairs would provide a public
benefit, keeping with the original intent of the
grant funding, and enable said Income to be clearly
tracked as to income and expenditures, and
WHEREAS, an emergency is defined as "an unexpected situation
or sudden occurrence of a serious and urgent nature
that demands immediate attention".
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA, AS FOLLOWS:
SECTION I. That the Planning, Economic, and Community
Development Department is hereby authorized
and directed to retain Project Income from the
Southwest Kalispell Housing Rehabilitation
Project CDBG grant, and utilize said Income
for emergency housing rehabilitation
activities as identified in Section 2.3 of the
City's Housing Rehabilitation Policy and
Procedure Manual.
SECTION II. Items eligible for emergency repair shall
include life/safety hazards as recommended by
the Kalispell Fire Department, Kalispell
Building Division or the PECDD Staff, and
include but not be limited to the following:
1. The failure of a structure's heating
system or in the case of a gas appliance,

Montana Power's refusal to re -light the
appliance, and improper venting of fuel
burning appliances.
2. A fire hazard situation such as a poor
electrical system, or improperly installed
wood stove.
3. Plumbing problems such as sewer gas from
improper venting, frozen or burst pipes inside
a structure and prevention measures to
eliminate re -occurrences, as well as broken
water or sewer service lines on the property.
4. Structure failures attributable to a
single, catastrophic occurrence.
SECTION III. This Resolution shall take effect immediately
upon passage by the City Council.
