RESOLUTION NO. 4085
A RESOLUTION SETTING A HEARING ON THE COSTS OF DEMOLITION OF A
HOUSE LOCATED ON LOT 4, BLOCK 136, KALISPELL ORIGINAL, FLATHEAD
COUNTY, MONTANA (1026 4TH AVENUE EAST); AND AUTHORIZING NOTICE
THEREOF.
WHEREAS, a residence located on Lot 4, Block 136, Kalispell
Original, Flathead County, Montana, (1026 4th Avenue East) was
substantially damaged by fire on or about April 15, 1990, and
WHEREAS, after due and proper notice to all parties having
an equitable or legal interest in the property, the City of
Kalispell Building Official on June 11, 1992 declared said
residence a dangerous building under Section 401, Uniform Code
For the Abatement of Dangerous Buildings, Ordinance No. 1142, and
directed that said building be demolished, and
WHEREAS, no party claiming an equitable or legal interest in
said property obtained a demolition permit within 60 days of
Notice or completed demolition of the structufe within 90 days of
Notice, and
WHEREAS, on September 8th, 1992 the Building Official, the
Public Works Department and the City Attorney requested proposals
on the cost of demolition of said building from local
contractors, and
WHEREAS, on October 26, 1992 the City entered into a
Contract with McElroy & Wiiken, Inc. for demolition of the
building at a cost of $9,875.00, and
WHEREAS, during the course of demolition the City was
obliged to remove an underground fuel storage tank serving said
residence at a cost of $875.00, and
WHEREAS, the total charges paid by the City as a result of
the demolition totaled $10,750.00.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA AS FOLLOWS:
SECTION I. That the City Council of the City of
Kalispell shall hold a Public Hearing on the cost of
said demolition and any objection or protests to said
costs at the regularly scheduled Council Meeting to be
held on the 4th day of January, 1993 at 7:00 o'clock
P.M. in the Council Chambers of City Hail, Kalispell,
Montana.
SECTION II. That at the conclusion of said Public
Hearing the City Council may direct that said costs
-in shall be made a pe, -31 obligation of the property

thereafter to become a lien upon said property until
paid.
SECTION III. That the City Clerk of the Council is
hereby authorized and directed to give notice of said
Public Hearing as required under Section 902, Uniform
"ode for Abatement of Dangerous Buildings, Ordinance
No. 1142.
