A RESOLUTION CONDITIONALLY APPROVING THE PRELIMINARY PLAT OF THE
SUBDIVISION OF BLOCK 1, LOT 1, ADAMS ADDITION, LOCATED IN THE
NORTHEAST 1/4 OF THE NORTHEAST 1/4 OF SECTION 12, TOWNSHIP 28
NORTH, RANGE 22 WEST, P.M.M., FLATHEAD COUNTY, MONTANA.
WHEREAS, Douglas Wood, the owner of Block 1, Lot 1, Adams
Addition, Flathead County, Montana, has petitioned for the
approval of the Subdivision Plat of Block 1, Lot 1, Adams
Addition, and
WHEREAS, the proposed Subdivision Plat of Block 1, Lot 1,
Adams Addition is subject to the provisions of Section 2.7
(Summary Subdivision Review), Subdivision Regulations of the City
of Kalispell, and
WHEREAS, the Flathead Regional Development office has
reviewed the proposed subdivision and made a report to the City
Council of the City of Kalispell, said report considering and
weighing all public interest criterion set forth in Section
2.2(F)(3), Subdivision Regulations of the City of Kalispell, and
WHEREAS, the City Council of the city of Kalispell has
reviewed the report of the Flathead Regional Development office
and has found from the preliminary plat, and evidence, that the
subdivision is in the public interest, and
WHEREAS, the city Council has based its public interest
findings upon the following findings of fact:
A. EFFECTS ON PUBLIC HEALTH AND SAFETY:
The site is level and poses no threats for building
safety due to slope. The area is outside of a
designated flood plain. Access to the property does
pose a serious concern. The entire property fronts on
the inside of a 90 degree curve of Three Mile Drive as
it intercepts Meridian. Presently a single access for
the existing office enters the curve at the midpoint.
The site distance is good on the curve but increased
traffic at the access point will congest the area. The
applicants are willing to limit access onto the curve
by creating a shared single access at this location.
This will help alleviate the potential conflict points
along the curve.
B. EFFECTS ON WILDLIFE AND WILDLIFE HABITAT:
The area is completely within the urbanized area of
a

Kalispell and outside of any designated or critical
wildlife habitat.
C. EFFECTS ON THE NATURAL ENVIRONMENT:
The property does not exhibit any unique natural
features. The lot is relatively flat. There are no
unique or unusual plant communities present. Municipal
sewer and water serve the site consequently impacts on
water quality and ground water reserves will be
minimal.
D. EFFECTS ON TAXATION:
The property, which contains an existing dental office,
presently pays $2,945 in property taxes per year. Upon
subdivision and full development using the existing
dental office as a scale for development, the project
would generate approximately $7,100 in property taxes
per year.
E. EFFECTS ON LOCAL SERVICES:
1. Schools: The project is commercial in nature and
other than an increase in taxes paid to the school
district, will have minimal impact on the school
system.
2. Parks and Recreation: The project is commercial
in nature and will have minimal impacts on the
parks system.
3. Fire Protection: The project is within reasonable
access and response time of the Kalispell Fire
Dept.
4. Police Protection: The project is within
reasonable access and response time of the
Kalispell Police Dept. Because of the low density
professional office nature design of the project,
service demands will be low.
5. Roads: Three Mile and Meridian can adequately
handle the increased traffic generated by three
professional offices. The greatest limitation
will be the location of the access point on the
inside curve of Three Mile Drive. The City does
have long range plans of re -designing the
intersection of Three Mile and Meridian to create
a "T" intersection with preference given to
through traffic on Meridian. This would eliminate

the curve and allow for an improved access design
at that time.
6. Water/Sewer : A 10 inch sewer main and a 16 inch
water main exist in Meridian at this time. There
is adequate capacity in each to adequately serve
the proposed development.
7. Solid Waste: Municipal garbage collection is
available.
8. Public Health Services: Ambulance service is
available. In addition the property is less than
one mile from a regional medical center located on
Buffalo Hill.
F. EFFECTS ON AGRICULTURE:
The site is completely urbanized and does not contain
any lands suitable for agriculture production.
G. EXPRESSED PUBLIC OPINION:
No comments have been received at this time. However,
as a minor plat, public comment is not openly solicited
and adjacent property owners are not notified.
H. NEED FOR THE SUBDIVISION:
Mr. Wood has substantial open space and excess land
around his current office. He has a potential buyer
for one of the lots.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL, MONTANA:
SECTION I. That the application of Douglas Wood for
approval of the Subdivision of Lot 1, Block 1, Adams
Addition, a proposal to create a three lot commercial
subdivision on the Northeast 1/4 of the Northeast 1/4
of Section 12, T28N, R22W, P.M.M., Flathead County,
Montana is hereby approved subject to the following
conditions:
1. The applicants shall submit a fully executed
"Access Road and Parking Lot Maintenance
Agreement" that adequately addresses common
usership and maintenance of the single access
point and parking lot arrangement.

the Three Mile Drive - Meridian Road

frontage. The final plat shall reflect "No
access" along the remainder of the frontage.
3. All sewer and water main extensions shall be
approved by both the State Department of
Health and the Kalispell Public Works
Department.
4; Additional fire hydrants shall be located as
deemed necessary by the Kalispell Fire Chief
to meet minimum fire safety standards.
5. The preliminary plat is effective for a
period of one year from the date of approval.
SECTION Il. The classification of said premises under
the Kalispell Zoning Ordinance shall not be changed by
the action.
SECTION III. That this preliminary plat should be
effective for a period of one year following passage of
this Resolution.
SECTION IV. That upon proper review and filing of the
f inal plat of said subdivision in the of f ice of the
Flathead County Clerk & Recorder, said premises shall
be a subdivision of the City of Kalispell.
