A RESOLUTION AUTHORIZING THE SALE OF LOTS 1, 2, 3, 4 AND THE
NORTH 7 INCHES OF LOT 5, BLOCK 45, KALISPELL ORIGINAL, FLATHEAD
COUNTY, MONTANA.
WHEREAS, the City of Kalispell, a municipal corporation,
owns certain real property, to -wit: Lots 1, 2, 3, 4 and the
North 7 inches of Lot 5, Block 45, Kalispell Original, Flathead
County, Montana, according to the map or plat thereof on file and
of record in the office of the Clerk and Recorder of Flathead
County, and
WHEREAS, Section 7-15-4263, Montana Code Annotated,
authorizes the city to dispose of real property located in an
urban renewal area by inviting proposals from private developers
and other persons interested in undertaking redevelopment
activities within the urban renewal area, and
WHEREAS, the City Council of the City of Kalispell on the
1st day of June, 1992 adopted Resolution No. 4054 declaring an
intent to sell said property, establishing a fair market value of
$6.65 to $10.00 per square foot, and directing that said property
be offered for sale at fair market value, and
WHEREAS, on the 22nd day of June, 1992, Anderson Theatre Co.
tendered to the City an Agreement to Sell and Purchase said real
property at a total sum of $93,644.00, and
WHEREAS, the City Council remains desirous of selling said
property, as the same is not necessary for the conduct of City
business or the preservation of property owned by the City, and
WHEREAS, said property is not held in trust for a specific
purpose and an election is not necessary to affect its sale, and
WHEREAS, the sale of said property shall result in the
development of a three auditorium movie house adjacent to the
Liberty Theatre within the Downtown Redevelopment Area in
furtherance of the Redevelopment Project under Ordinance No.
1065, and
WHEREAS, Anderson Theatre Co.'s offer to purchase said
property complies with the terms of Resolution No. 4054 and said
sale would be in the best interest of the City of Kalispell and
its inhabitants.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF KALISPELL:

SECTION I. That the City Council of the City of
KalispelT hereby authorizes the Manager and the City
Finance Director to execute all legal documents
necessary to transfer, by Warranty Deed, all the City's
right, title and interest in Lots 1, 2, 3, 4 and North
7 inches of Lot 5, Block 45, Kalispell Original,
Flathead County, Montana to Anderson Theatre Co., said
transfer being contingent on receipt of the sum of
$93,644.00, less cost of sale.

KALISPELL AND APPROVED BY THE MAYOR THIS 3rd DAY OF
