RESOLUTION NO. 4017
A RESOLUTION AUTHORIZING THE SALE OF LOTS 4, 5, 6, 7, 8, 9, 11,
12, 13, 16, 17, 18, 19, 20, AND 21; BUFFALO HEAD ADDITION NO. 92,
KALISPELL, FLATHEAD COUNTY, MONTANA.
WHEREAS, the City of Kalispell, a municipal corporation,
owns certain real property, to -wit: Lots 4, 5, 6, 7, 8, 9, 11,
12, 13, 16, 17, 18, 19, 20, and 21; Buffalo Head Addition No. 92,
Kalispell, Flathead County, Montana, and
�- WHEREAS, Section 7-8-4201, Montana Code Annotated,
authorizes the City Council to sell, dispose of or lease any
property belonging to the City upon proper passage of a
Resolution passed by two thirds vote of all members of the City
Council, and
WHEREAS, the City Council of the City of Kalispell on the
5th day of November, 1990 adopted Resolution No. 3964 declaring
an intent to sell said property, establishing a fair market value
of $317,250.000, and directing that said property be offered for
sale at 90% of the fair market value, and
WHEREAS, no prospective purchasers responding to the
advertisement, published pursuant to Resolution No. 3964,
submitted bids meeting the City`s requirement of 90% of the fair
market value, and
WHEREAS, Resolution No. 3964 and the notice published,
pursuant thereto, reserved the right of the City to sell the
property at private sale at an amount agreeable between the City
and the purchaser, in the best interest of the City of Kalispell,
and
WHEREAS, on the 6th day of September, 1991, Lowell I.
Anderson and Ernestine B. Anderson tendered to the City an
Agreement to Sell and Purchase said real property at a total sum
of $260,000.00, and
WHEREAS, the City Council remains desirous of selling said
property, as the same is not necessary for the conduct of City
business or the preservation of property owned by the City, and
WHEREAS, said property is not held in trust for a specific
purpose and an election is not necessary to affect its sale, and
WHEREAS, the sale of said property may result in the
development of additional multi -family residential property in
the City and will result in the satisfaction of delinquent and

outstanding debt owing as a result of the failure of Special
Improvement District 328, and
WHEREAS, Andersons' offer to purchase said property complies
with the terms of Resolution No. 3964 and said sale would be in
the best interest of the City of Kalispell and its inhabitants.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL:
SECTION I. That the City Council of the City of
Kalispell hereby authorizes the Manager and the City
Finance Director to execute all legal documents
necessary to transfer, by Warranty Deed, all the City's
right, title and interest in Lots 4, 5, 6, 7, 8, 9, 11,
12, 13, 16, 17, 18, 19, 20 and 21, Buffalo Head
Addition No. 92, Kalispell, Flathead County, Montana to
Lowell I. Anderson and Ernestine B. Anderson, said
transfer being contingent on receipt of the sum of
$260,000.00, less costs of sale.
PASSED BY TWO-THIRDS VOTE OF THE CITY COUIL OF THE CITY OF
KALISPELL AND APPROVED BY THE MAYOR THIS ��� DAY OF SEPTEMBER,
