Resolution 5898A - Adopts GP Amendment - MT Base CampRESOLUTION NO.5898A A RESOLUTION ADOPTING AN AMENDMENT TO THE KALISPELL GROWTH POLICY -- PLAN IT 2035 ON 50.33 ACRES OF PROPERTY LOCATED AT 3260 HIGHWAY 93 SOUTH IN FLATHEAD COUNTY, MONTANA, BY CHANGING THE DESIGNATION OF LAND FROM "URBAN RESIDENTIAL" TO "URBAN MIXED USE", TO BE KNOWN AS THE MONTANA BASE CAMP GROWTH POLICY AMENDMENT. WHEREAS, pursuant to MCA 76-1-601 the Kalispell Growth Policy — Plan It 2035 was adopted by the Kalispell City Council on July 3, 2017; and WHEREAS, Basecamp Outpost, LLC formally requested a growth policy amendment on approximately 50.33 acres at 3260 Highway 93 South in Flathead County, and more particularly described as Tract 1 and Tract 2 of COS 20796 located in the South half of the Southeast quarter of Section 29 and the North half of the Northeast quarter of Section 32, Township 28 North, Range 21 West, P.M.M, Flathead County, Montana by changing the designation of land from Urban Residential to Urban Mixed Use; and WHEREAS, on August 20, 2018, the Kalispell City Planning Board held a duly noticed public hearing on the request in which it received public comment and reviewed Kalispell Planning Department report #KGPA-18-01 that evaluated the proposal based upon the goals and objectives of the Growth Policy and current circumstances in the planning jurisdiction; and WHEREAS, at the conclusion of the public hearing and after consideration of the proposed amendment, the Kalispell City Planning Board adopted report #KGPA-18-01 as findings of fact and recommended approval of the proposed Growth Policy amendment; and WHEREAS, on August 6, 2018 the Kalispell City Council responded to the Planning Board recommendation by passing Resolution 5882, a Resolution of Intention to Adopt, Revise or Reject a Proposed Amendment to the Kalispell Growth Policy — Plan It 2035 and called for a public hearing to be held on August 20, 2018; and WHEREAS, on August 20, 2018 the Kalispell City Council, after due and proper notice, held a public hearing on the Basecamp Outpost, LLC request and received zero (0) oral public comments regarding the recommendations of the City Planning Board and the Kalispell Planning Department report #KGPA-18-01; and WHEREAS, upon consideration of the recommendation of the Kalispell Planning Board and all other evidence in the public record, the Kalispell City Council finds that it is in the best interest of the City to amend the Kalispell Growth Policy — Plan It 2035 by adopting, as its findings, Kalispell Planning Department report #KGPA-18-01, and to amend the designation of the above described property at 3260 Highway 93 South, Flathead County from Urban Residential to Urban Mixed Use in the Growth Policy. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, AS FOLLOWS: SECTION 1. That pursuant to Section 76-1-604, MCA, the Kalispell City Council hereby adopts as an amendment to the Kalispell Growth Policy — Plan It 2035, the designation of property at 3260 Highway 93 South, Flathead County, and more particularly described as Tract 1 and Tract 2 of COS 20796 located in the South half of the Southeast quarter of Section 29 and the North half of the Northeast quarter of Section 32, Township 28 North, Range 21 West, Flathead County, Montana from Urban Residential to Urban Mixed Use in the Growth Policy as fully described in Kalispell Planning Department report #KGPA- 18-01 attached hereto and incorporated fully herein by this reference. SECTION 2. This Resolution shall become effective immediately upon its passage by the City Council.
