Park. The subdivision is the first phase of five (5) phases. The request was reviewed in accordance with Section 28.4 (Manufactured Homes, Recreational Vehicle Parks and Campgrounds) of the Kalispell Subdivision Regulations. This process insures the proper planning and oversight of public services such as water, sewer, storm water, streets, intersections, traffic control is provided for. Recreational vehicle parks are exempt from the surveying and filing requirements of the Montana Subdivision and Platting Act, but must be submitted for review and approval by the Kalispell City Council via a Revised Preliminary Plat before portions thereof may be leased. The property can be legally described as Tract 1 and Tract 2 of Certificate of Survey 20796 in the S2S4 of Section 29 and N2NE4 of Section 32, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana. The City Council approved the preliminary plat for Montana Basecamp with 41 conditions at their meeting on September 4, 2018, with Resolution No. 5900. All of the conditions have been met or adequately addressed. In addition, a Performance Bond Improvement Agreement in the amount of $867,281.69 (125% of remaining cost) is included for City Council action. RECOMMENDATION: It is recommended that the City Council approve the Revised Preliminary Plat for Montana Basecamp FISCAL EFFECTS: Positive impacts once developed. ALTERNATIVES: Deny the request. WHEREAS, on September 4, 2018, the City Council passed Resolution 5900 approving the Preliminary Subdivision Phase 1 Plat of applicant Montana Basecamp; and WHEREAS, on June 3, 2019, Montana Basecamp filed its application for a Revised Preliminary Subdivision Phase I Plat, signed by the owner of record and listing how each of the 41 conditions of the Preliminary Subdivision Phase I Plat have been met or otherwise addressed to the satisfaction of the city staff, and WHEREAS, the Kalispell City Planning staffed reviewed the application and compliance with the conditions of the Preliminary Phase I Plat in accordance with Section 28.4 (Manufactured Homes, Recreational Vehicle Parks and Campgrounds) of the Kalispell Subdivision Regulations; and WHEREAS, recreational vehicle parks are exempt from the surveying and filing requirements of the Montana Subdivision and Platting Act, but must be submitted for review and approval by the Kalispell City Council via a Revised Preliminary Plat before portions thereof may be leased; and WHEREAS, the City Council hereby finds that all of the conditions of the Preliminary Subdivision Phase I Plat have been met or otherwise satisfactorily addressed and that an Improvement Agreement supported by adequate security in the amount of $867,281.69 (125% of remaining cost) has been executed in favor of the City of Kalispell. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA AS FOLLOWS: SECTION 1. That the application of Basecamp Outpost, LLC for approval of the Revised Preliminary Plat of Phase 1 of Montana Basecamp, Kalispell, Flathead County, Montana is hereby approved with no further conditions for such phase. SECTION 2. Upon completion of the remaining phases of the development and after proper review and filing of the Final Plat of said subdivision in the office of the Flathead County Clerk and Recorder, said premises shall be a subdivision of the City of Kalispell. COMPLIANCE WITH CONDITIONS OF APPROVAL The Planned Unit Development for Montana Base Camp allows the following deviations from the Kalispell Zoning Ordinance: a) Kalispell Zoning Ordinance, Chapter 27.13 — Allows for an R.V. Park and accessory uses only on the property in accordance with the development plan submitted. All other permitted and conditionally permitted uses within the B-2 zone are not allowed at this time. Staff Response: This condition has been met. The Revised Preliminary Plat is in compliance with the submitted preliminary plat application and materials. No additional deviations are requested. 2. That the development of the site will be in substantial conformance with the documents entitled Montana Base Camp and associated submittal drawings which shall govern location of the lots, easements, roadways, phasing plan, landscaping, parkland/open space, stormwater, and pedestrian access facilities. Staff Response: This condition has been met. The Revised Preliminary Plat is in compliance with the approved preliminary plat. 3. The preliminary plat approval for the development shall be valid for a period of three years from the date of approval. Staff Response: This condition has been met. The City Council approved the preliminary plat at their meeting on September 4, 2018, giving the plat an expiration date of September 4, 2021. 4. In lieu of filing a final plat, the subdivider shall submit to the Kalispell Planning Department four official copies and one digital copy of a plat labeled "Revised Preliminary Plat" conforming to the requirements for preliminary plats contained on the Appendix A of the Kalispell Subdivision Regulations. Staff Response: This condition has been met. The applicant has submitted the Revised Preliminary Plat application materials. 5. A development agreement shall be drafted by the Kalispell City Attorney between the City of Kalispell and the developer outlining and formalizing the terms, conditions and provisions of approval. The final plan as approved, together with the conditions and restrictions imposed, shall constitute the Planned Unit Development (PUD) zoning for the site that shall be completed and signed by the city and owner prior to the issuance of a building permit. Staff Response: This condition has been adequately addressed. All of the conditions of the preliminary plat have been met, or otherwise bonded; thereby, a further agreement is unnecessary. 6. Architectural renderings for all commercial buildings are required to be submitted to the Kalispell Architectural Review Committee for review and approval prior to issuance of a building permit. Staff Response: This condition has been met. All of the building located within the Revised Preliminary Plat have been approved by the Architectural Review Committee. 7. To ensure the traffic flow and access comply with Kalispell Design and Construction Standards, the development shall receive Site Review Committee approval prior to issuance of building permits. Staff Response: This condition has been met. The project received Site Review approval prior to building permits being issued on the property. 8. New infrastructure required to serve the subdivision shall be designed and constructed in accordance with the City of Kalispell's Standards for Design and Construction. All design work shall be reviewed and approved in writing by the Kalispell Public Works Department prior to construction. This infrastructure shall include but not be limited to streets, street lighting, street signage, curb, gutter, boulevard and sidewalks. Staff Response: This condition has been met. Public Works has issued a letter approving the subdivision on 5/30/2019. The letter is attached hereto for reference. In addition, the developer has entered into a performance bond improvement agreement with the City of Kalispell that can be used by the city as collateral to assure all remaining infrastructure required is installed to city standards for design and construction. 9. Water and sewer main extensions shall be designed and constructed in accordance with the City of Kalispell's Standards for Design and Construction and in compliance with the city facility plan updates and extensions of services plans. The water and sewer main extension plans shall be reviewed and approved by the Kalispell Public Works Department. Staff Response: This condition has been met. Public Works has issued a letter approving the subdivision on 5/30/2019. The letter is attached hereto for reference. In addition, the developer has entered into a performance bond improvement agreement with the City of Kalispell that can be used by the city as collateral to assure all remaining infrastructure required is installed to city standards for design and construction. 10. The developer shall work with the Montana Department of Environmental Quality in seeking a deviation from the individual water service line requirement in an effort to reduce the number of water meters within the development. Staff Response: This condition has been met. The Montana Department of Environmental Quality approved the project on 6/20/2019. The letter is attached hereto for reference. 11. Sewer mains located outside of public Right-of-ways shall be privately owned, operated and maintained. Staff Response: This condition has been met. The sewer mains outside of the public right-of- way are privately owned. 12. Pursuant to septic sewer requirements, the applicant shall coordinate with the City of Kalispell Pretreatment Coordinator for development of items related to the Pretreatment Program. Applicant shall enter into a Memorandum of Understanding (MOU) for each phase of construction to establish sampling protocols for the Wet Industry Impact Fee, sewer billing surcharge, and other related pretreatment requirements applicable at the time of construction. Applicant shall install a sample port meeting the requirements of the City Design and Construction Standards and Pretreatment Program on the sewer collection system downstream future phase or current phase connection point. Applicant shall install applicable pretreatment appurtenances as required, such as pretreatment interceptors. Applicant shall bear all costs of sampling completed in accordance with the sampling protocols developed in the MOU's. Staff Response: This condition has been met. The MOU has been completed and signed by the developer. 13. The developer shall submit to the Kalispell Public Works Department for review and approval a stormwater report and an engineered drainage plan that meets the requirements of the current City standards for design and construction. The stormwater design shall be in compliance with the submitted drawings which indicate the intent of the stormwater areas being shallow, landscaped areas that can also be used for recreation. The plan shall be updated and approved for each phase of construction. Staff Response: This condition has been met. Public Works has issued a letter approving the subdivision on 5/30/2019. The letter is attached hereto for reference. In addition, the developer has entered into a performance bond improvement agreement with the City of Kalispell that can be used by the city as collateral to assure all remaining infrastructure required is installed to city standards for design and construction. 14. The developer shall submit to the Kalispell Public Works Department prior to construction an erosion/sediment control plan for review and approval and a copy of all documents submitted to Montana Department of Environmental Quality for the General Permit for Stormwater Discharge Associated with Construction Activities. Staff Response: This condition has been met. Kalispell Public Works issued a stormwater management permit on 3/9/2019. DEQ also issued a stormwater permit on 3/19/2019. Both permits are attached hereto for reference. 15. A letter from the Kalispell Public Works Department shall be submitted stating that all new infrastructure has been accepted by the City of Kalispell or a proper bond has been accepted for unfinished work prior to submittal of the Revised Preliminary Plat. Staff Response: This condition has been met. The developer has entered into a performance bond improvement agreement with the City of Kalispell that can be used by the city as collateral to assure all remaining infrastructure required is installed to city standards for design and construction. 16. If the developer chooses to use the City of Kalispell solid waste pickup program they shall coordinate the number, size and location of all pickup bins prior to installation. The area to be used for solid waste pickup shall have appropriate access, size and maneuvering area for city solid waste trucks. Staff Response: This condition has been met. The developer has met with City of Kalispell Solid Waste and a program for the R.V. Park has been completed. The email approving the program, dated 6/14/2019 is attached hereto for reference. 17. The traffic impact study for the project site shall be reviewed and approved by the Public Works Department and where appropriate, the Montana Department of Transportation in order to determine the appropriate mitigation as the project develops. Staff Response: This condition has been met. Public Works issued a letter approving the street improvements on 5/30/2019. MDT issued an approach permit, which incorporated TIS mitigation, on 6/26/2019. The two approvals are attached hereto for reference. 18. The developer shall obtain an approach permit from the Montana Department of Transportation (MDT) for approaches onto the bypass and Ashley Meadows. If any improvements are necessary at the intersection of the roadways, these improvements shall be completed to the satisfaction of the MDT prior to the Revised Preliminary Plat. MDT shall so certify this in writing to the city. Staff Response: This condition has been met. MDT issued an approach permit, is attached hereto for reference. The developer has entered into a performance bond improvement agreement with the City of Kalispell that can be used by the city as collateral to assure all remaining infrastructure improvements associated with the approaches are installed to appropriate standards. 19. Prior to Revised Preliminary Plat all mitigation required as part of the approved traffic impact study shall be completed for each phase. All improvements shall be reviewed and approved by either the Public Works Department or Montana Department of Transportation. A letter from the Kalispell Public Works Department or Montana Department of Transportation shall be submitted stating that all new infrastructure has been accepted by the City of Kalispell or State of Montana. If infrastructure work has not been accepted, a letter stating that a proper bond has been accepted for the unfinished work by the appropriate agency is required. Staff Response: This condition has been met. Public Works issued a letter approving the street improvements on 5/30/2019. MDT issued an approach permit, which incorporated TIS mitigation, on 6/26/2019. The two approvals are attached hereto for reference. 20. A letter from the Kalispell Fire Department approving the access, placement of the fire hydrants and fire flows within the subdivision shall be submitted prior to Revised Preliminary Plat for each phase. Staff Response: This condition has been met. An email from the Kalispell Fire Department approving the project, dated 12/31/2018, is attached hereto for reference. 21. A letter shall be obtained from the Parks and Recreation Director approving a landscape plan for the placement of trees and landscaping materials within the landscape boulevards of the streets serving the subdivision. Staff Response: This condition has been met. Kalispell Parks and Recreation issued a letter approving the project on 6/26/2019. The letter is attached hereto for reference. 22. A 6' tall landscaped berm with a 3:1 slope shall be constructed along the entire northerly property boundary. The berm shall be landscaped with grass, trees bushes and shrubs to form a pleasing sight obscuring visual barrier. The plan shall be approved by the Parks and Recreation Director. The berm may be phased so as to buffer adjacent development. Staff Response: This condition has been adequately addressed. Kalispell Parks and Recreation issued a letter approving the project on 6/26/2019. The berm will be constructed as the project develops along the northern property boundary at a later phase. The letter is attached hereto for reference. 23. All parking areas shall be constructed in accordance with Chapter 27.24 of the Kalispell Zoning Ordinance except as provided for in condition 1 above. Staff Response: This condition is adequately addressed. Currently, there is no parking onsite other than the R.V. spaces. As the project progresses into further phases, which may include parking areas the Site Review Committee will review those spaces for circulation and the zoning ordinance. 24. Signage shall be installed in accordance with Chapter 27.22 of the Kalispell Zoning Ordinance. Staff Response: This condition has been met. The developer received a sign permit that will be installed in accordance with the zoning ordinance. 25. Common facilities on the property (pool, recreation building camp store, food, etc.) shall be intended for guests of the R.V. Park and not open to the general public. Staff Response: This not applicable. No common facilities, other than the bathrooms which will be used by paying customers have been constructed with this phase. 26. All easements and/or right-of-ways shall be indicated on the face of the Revised Preliminary Plat. Utility easements for City water and sewer shall be provided to allow for the logical extension of utilities from this subdivision to adjoining properties. A letter from the Kalispell Public Works Department shall be obtained stating that the required easements are being shown on the final plat. Staff Response: This condition has been met. All easements are shown and have been dedicated where appropriate. 27. The following statement shall appear on the final plat: "The undersigned hereby grants unto each and every person, firm or corporation, whether public or private, providing or offering to provide telephone, telegraph, electric power, gas, cable television, water or sewer service to the public, the right to the joint use of an easement for the construction, maintenance, repair, and removal of their lines and other facilities, in, over, under, and across each area designated on this plat as "Utility Easement" to have and to hold forever." Developer's Name Staff Response: Not applicable. The Revised Preliminary Plat is not being recorded, therefore the statement is not needed. 28. That a minimum of two-thirds of the necessary public infrastructure for this subdivision shall be completed prior to Revised Preliminary Plat submittal for each phase and that both the water and sewer systems serving this phase be operational. Staff Response: This condition has been met. More than 2/3 of the public infrastructure has been installed, and/or accepted by the city. The developer has entered into a performance bond improvement agreement with the City of Kalispell that can be used by the city as collateral to assure all remaining infrastructure required is installed to city standards for design and construction. 29. All utilities shall be placed underground and in locations that are approved by the Kalispell Public Works Department in accordance with the Kalispell Standards for Design and Construction. Staff Response: This condition has been adequately addressed. Utilities have either been constructed underground, or will be constructed in the near future, at which time they will be verified via filed inspection by Public Works. 30. The following public right-of-way improvements shall be completed at each phase of the development: a) Phase 1 — The new unnamed city street shall be improved to city standards from the roundabout to the northern entrance into the development and from Ashley Meadows to the southern access into the development. b) Phase 2 — The unnamed city street shall be constructed to city standards at the point 165 R.V. spaces are constructed connecting the northern and southern entry points into the development. Staff Response: This condition has been met. Phase 1 improvements have been completed and/or a bond is in place for any remaining improvements associated with the accesses. 31. A management plan shall be completed and submitted to the city with provisions on how the developer intends to manage the open space areas, landscaping, security, stormwater, long-term stay, R.V. dump station and wayfinding signs. Staff Response: This condition has been met. The developer has submitted a management plan, dated 6/7/2019 with provisions of they intend to manage the property. The management plan is attached hereto for reference. 32. Guests shall be limited to no more than 90 consecutive days within the park. Moving an R.V. from one location to another within the park shall not constitute a new time period. Staff Response: This condition is adequately addressed. The management plan of the R.V. park contains provisions indicating a maximum stay of 90 days. 33. Fires are permitted only in facilities provided for this purpose. Staff Response: This condition has been met. An email from the Kalispell Fire Department approving the project, dated 12/31/2018, is attached hereto for reference. 34. Skirting of R.V.'s is prohibited. Staff Response: This condition is adequately addressed. Provision for limited stay have been incorporated into the zoning of the property and management plan from the developer. If any issues arise on the property in violation of this requirement, normal enforcement action will be taken by the Kalispell Planning office. 35. Mobile homes are prohibited. Staff Response: This condition is adequately addressed. Provisions for mobile homes have been incorporated into the zoning of the property and management plan from the developer. If any issues arise on the property in violation of this requirement, normal enforcement action will be taken by the Kalispell Planning office. 36. Fireworks are prohibited. Staff Response: This condition is adequately addressed. Fireworks are prohibited onsite and the developer will take all steps necessary to discourage their use. In a case where fireworks are being used normal enforcement procedures will be used by the Kalispell Police Department. 37. On -street parking shall be prohibited within the development on the private road system. Staff Response: This condition has been met. On -street parking within the development is not permitted in order to allow for two way traffic into and out of the park. 38. Trail connections to the Rails to Trails pathway shall not be made until a letter has been submitted to the City of Kalispell Planning Department from both the Montana Department of Transportation and the Rails to Trails board accepting the proposed design. Staff Response: This condition has been adequately addressed. The Rails to Trails board met with the developer's engineer at their February Board meeting and the mitigation being implemented was determined to be adequate. 39. The developer shall coordinate with the Montana Department of Transportation and Rails to Trails board a redesign of the path where it crosses the new unnamed city street and Ashley Meadows so that there is only one street crossing, rather than two. Staff Response: This condition has been met. The trail was redesigned to where it only crosses the street once. 40. The developer shall coordinate with the Montana Department of Transportation and move the southern end of the new unnamed city street to the east so that it could provide a logical intersection with Ashley Meadows and future development develop to the south. Staff Response: This condition has been met. The new unnamed city has been moved to the east so that it could provide a logical intersection with Ashley Meadows and future development develop to the south. 41. The developer shall coordinate with the Montana Department of Transportation and remove the barbwire fence at the top of the existing wood fencing along the pathway boundary. Staff Response: This condition has been met. The barbed wire has been removed from the fence around this phase of the project. COMPLIANCE WITH APPROVED PRELIMINARY PLAT The Revised Preliminary Plat is in substantial compliance with the preliminary plat approved by the Kalispell City Council on September 4, 2018. COMPLIANCE WITH THE SUBDIVISION REGULATIONS: This Revised Preliminary Plat has been found to be in compliance with the state and city Subdivision Regulations. COMPLIANCE WITH THE ZONING REGULATIONS This subdivision can be found to be in compliance with the Kalispell Zoning Ordinance and the B- 2/PUD zoning designation for the property which governs the dimensional requirements of the lots within the subdivision as well as the uses. RECOMMENDATION: It can be found that the conditions of preliminary plat approval have been met or are otherwise adequately addressed. The staff recommends that the Kalispell City Council approve the Revised Preliminary Plat for Montana Basecamp. A revised preliminary plat must be signed by all owners of record, and by the surveyor. 2. Attach a letter which lists each condition of preliminary plat approval and individually state how each condition has specifically been met. In cases where documentation is required, such as an engineer's certification, State Department of Health certification, etc., original letters shall be submitted. Blanket statements stating, for example, "all improvements are in place" are not acceptable. 3. Pursuant to septic sewer requirements, the Applicant shall coordinate with the City of Kalispell Pretreatment Coordinator for development of items related to the Pretreatment Progratu. Applicant shall enter into a Memorandum of Understanding (MOU) for each phase of Construction to establish sampling protocols for the Wet Industry Impact Fee, sewer billing surcharge, and other related pretreatment requirements applicable at the time of construction. At a minimum, the agreement shall include, but not be limited to the following conditions: a. The City provided generator and transfer switch shall be installed for use with the temporary lift station. The generator and transfer switch shall be modified to be utilized with the permanent lift station prior to the transfer to the City of Kalispell. b. The utility services for the temporary lift station shall be in the name of Basecamp and shall be paid by Basecamp until transfer of the permanent lift station to the City. c. The permanent security fencing around the lift station shall be installed prior to operation of the temporary lift station. d. Basecamp shall be responsible for the design, construction, maintenance, and operation of the Basecamp Private Sewer System and temporary lift station as indicated in the plans, specifications, calculations, and reports approved by the Department of Public Works. e. A letter of concurrence from MDEQ for the temporary lift station shall be provided to the City of Kalispell. f. The rail system for the permanent pumps shall not be modified to be used with the temporary lift station. g. Programming of the Mission Control Unit for callouts shall call Basecamp until the transfer of ownership, at which time the unit shall be transferred to the City. h. Bonding for 125% of the approved engineer's estimate for the cost of any unbuilt portions of the permanent lift station must be in place until the transfer of ownership. i. The completion of construction of the permanent lift station and the transfer of ownership shall be completed by November 31, 2019. The City of Kalispell shall have 24-hour access to the private sanitary sewer system and lift station. k. Repair or replacement of any defective appurtenances in the Private Sanitary Sewer System of temporary lift station immediately following notification by the City. 7. Previously approved deviation requests I through 5 are unchanged by this review and remain in effect. No other deviation requests have been made or are approved. All other portions of the design plans, reports, and specifications shall comply with the City of Kalispell Design and Construction Standards. Page 2 of 3 Additional Conditions: Approval does not relieve you, nor the contractor from designing or constructing this project in accordance with the City Standards currently in effect. If more than 18 months lapse before completing construction, plans, reports, calculations, and specifications must be resubmitted and approved before construction continues. Any modifications made to these approved plans shall be submitted for review prior to construction. Due to the major modifications from the approved plans, review fees are deemed applicable. There were two additional plan reviews completed. Each plan review costs $180. Fees for the previous 2 reviews were never collected. Please submit a check for $720 to the City of Kalispell Public Works Department to cover the original 2 reviews and additional 2 reviews after plan modifications were made. This approval is for the Public Works Department only and does not necessitate full City approval. If additional approvals from other City Departments or agencies are required, they should continue to be pursued. Proof of MDEQ approval shall be obtained prior to construction. Purpose and Scope The purpose of this Memorandum of Understanding (this "MOU") is to establish the rules and regulations that Montana Basecamp Inc 1 Basecamp Outpost LLC (hereinafter "MBC") and the City of Kalispell (hereinafter the "CITY") shall follow as well as to establish an appropriate sewer impact fee (conveyance and treatment) and surcharge in consideration for receiving municipal sewer utility services from the CITY. The parties acknowledge that MBC does not discharge typical domestic waste and is therefore required to pay an impact fee and surcharge fee for the wastewater to be received by the City as it relates to this development. II. Term There are two CITY components addressed within this MOU, as such the Terms with each are defined as follows. Sewer Impact Fee: This MOU shail remain in force so long as MBC continues to operate its business and remains a customer of the CITY wastewater system. Surcharges and Industrial Pretreatment Program (IPP): This MOU shall remain in force so long as MBC continues to operate its business and remain a customer of the CITY's Wastewater system, or until such a time when the CITY has an approved Industrial Pretreatment Program (IPP) with the United States Environmental Protection Agency (USEPA). When the City obtains the approved IPP with the USEPA, the MOU components addressing sampling and surcharges will be replaced with an Industrial Pretreatment Permit along with the application of the most current adopted surcharge schedule. III. MBC Responsibilities MBC shall abide by the terms set forth in Appendix A, and all of the CITY codes, regulations, resolution, and ordinances in regards to the CITY's wastewater system. Surcharges will commence on the date that MBC connects to the CITY's sanitary sewer system. Surcharge samples shall be collected for analysis annually in May, July, September, and November for the purpose of determining and charging surcharges. Surcharge cost will be applied to the entire volumetric flowrate received by the City, as there is no mechanism to separate the RV site wastewater from the facilities wastewater. Page 1 of 10 MBC will be responsible for all costs associated with sampling and analysis as related to calculation of impact and surcharge fees. All sampling and analytical reports shall be sent to the CITY as defined in Appendix A. IV. CITY Responsibilities The CITY shall provide municipal sanitary sewer service to MBC and shall abide by the terms set forth in Appendix A. The CITY will assist MBC with collecting samples. Within 60 days of receiving the analytical report from the second annual seasonal sampling, the CITY shall review the monthly samples and adjust the impact fee accordingly. V. Sewer Impact Fees The Wet Industry impact fee for which MBC is obligated for this MOU pertains to the RV portion for Phase 1 of the Development. Additional impact fees shall be calculated and collected separately as it pertains to development phases for the RV sites and facilities. All calculations shall be in accordance with the most current adopted impact fee. Appendix B provides the estimated wet industry calculation and cost. The total estimated wet industry impact fee for Phase 1 of the MBC is $134,692.08, of which $26,938.41 shall be paid prior to connection, with the balance to be paid utilizing the CITY's deferred payment plan. Appendix C sets forth the terms of the deferred payment plan. See CITY Responsibilities in IV above regarding final determination of impact fee based on actual sampling results. VI. Modification The CITY and MBC acknowledge that the CITY's pretreatment regulations currently are being reviewed and will be formally established and modified from time to time. MBC shalt be obligated to abide by such regulations, as they are adopted by the City. Any and all amendments to this agreement must be made in writing and must be agreed to and executed by both parties before becoming effective. VII. Effective Date and Signature This MOU shall be effective upon the signature of the CITY and MBC's authorized officials. The CITY and MBC indicate agreement with this MOU by their signatures. General Prohibitions 1. Pass Through - No user shall discharge pollutants through the wastewater utility into the receiving stream in quantities or concentrations that are a cause of or significantly contribute to violation of any requirements contained in the City's NPDES permit_ 2. Interference - No user shall directly or indirectly inhibit or disrupt the wastewater treatment plant process or operation. B. Wastes Prohibited from beinz discharged to the Wastewater Treatment System The discharge of any waters containing toxic or poisonous solids, liquids or gases in sufficient quantity, either singly, or by interaction with other wastes, to contaminate the sludge of the City of Kalispell's sewerage system, or to injure or interfere with any sewage treatment processes, constitute a hazard to humans or animals, create a public nuisance, or create any hazard in or have an adverse effect on the waters receiving any discharge from the treatment works is hereby prohibited. Substances specifically prohibited are: 1. Any liquid or vapor having a temperature higher than one hundred fifty degrees Fahrenheit (150°F) (65°C), or having ltarrvnable or explosive qualities; 2. Any water or waste containing fats, wax, grease or oils, whether emulsified or not, in excess of one hundred (100) mg/l or containing substances which may solidify or become viscous at temperatures between thirty-two and one hundred fifty degrees Fahrenheit (32 and 150°F) (0 and 65'C); 3. Any garbage that has not been properly shredded. The installation and operation of any ZD garbage grinder equipped with a motor of three -fourths (3/4) horsepower or greater shall be subject to the review and approval of the City; 4. Any waters or wastes containing strong acid iron pickling wastes or concentrated plating solutions whether neutralized or not; 5. Any waters or wastes containing iron, chromium, copper, zinc and similar objectionable or toxic substances; or wastes exerting an excessive chlorine requirement; to such degree that any such material received in the composite sewage at the sewage treatment works may exceed the limits established by the City to comply with applicable State and Federal regulations; 6. Any waters or wastes containing phenols or other taste -producing or odor -producing substances, in such concentrations exceeding limits which may be established by the City as necessary, after treatment of the composite sewage, to meet the requirements of the State, Federal or other public agencies of jurisdiction for such discharge to the receiving waters; 7. Any radioactive wastes or isotopes of such half-life or concentration as may exceed limits established by the City to comply with applicable State or Federal regulations; Page 3 of 10 S. Any waters or wastes having a pH in excess of 9.5 or under 5.5; 9. Materials which exert or cause: a. Unusual concentrations or inert suspended solids (such as, but not limited to, Fullers earth, lime slurries and lime residues) or of dissolved solids (such as, but not limited to, sodium chloride and sodium sulfate) b. Excessive discoloration (such as, but not limited to, dye wastes and vegetable tanning solutions) C. Unusual BOD, chemical oxygen demand, or chlorine requirements in such quantities as to constitute a significant load on the sewage treatment works. 10. Waters or wastes containing substances which are not amenable to treatment or reduction by the sewage treatment processes employed or are amenable to treatment only to such degree that the sewage treatment plant effluent cannot meet the requirements of other agencies having jurisdiction over discharge to the receiving waters. (Ord. 1002 § 11) C. Specific Discharge „Limits Materials discharged from RV holding tanks have the potential to contain toxic pollutants and heavy metals. Periodic sampling for the pollutants contained in 40 CFR Part 122, Appendix D, Tables II, III and V will be performed by the City. If any of these pollutants are detected in any concentration, routine sampling at MBC's expense and as described at that time, will be required. Biochemical Oxygen Demand (BOD), Total Suspended Solids (TSS), Total Phosphorus (TP), Total Nitrogen (TN), Fats, Oils and Grease (FOG) and pH shall be tested as prescribed in the schedule below. PART 2 - MONITORING REQUIREMENTS A. All handling, preservation, and laboratory analyses of samples shall be performed in accordance with 40 CFR Part 136 and amendments thereto. C. The City may, at any time, collect random samples at the City's expense. D. Sampling shall take place on the first full week of each month, and not less than 21 days after septic tank(s) are pumped (cleaned). E. All samples shall be taken from sample port (s) that will be installed by MBC, and shall be located in an area(s) where flow can be monitored and represented from the entire development. Sample port design shall be in accordance with current City Standards for Design and Construction. PART 3 - REPORTING REQUIREMENTS A. Monitoring Reports 1. Monthly Flow report shall iliclude a total monthly flow from water service meters associated from the entire site. 2. The monthly report shall include any laboratory analytical reports for any sampling performed during the previous month. 3. MBC may monitor any pollutant more frequently than required, using test procedures prescribed in 40 CFR Part 136 or amendments thereto. If MBC chooses to include the additional sampling data in the monthly report, MBC shall provide the City with an explanation as to why the additional sampling was performed. The City will review the information and determine if the additional data shall be included when calculating impact and / or surcharges. 4. Monthly reports shall be sent to the City's Industrial Pretreatment Coordinator no later than the 15th of each month and contain all required information from the previous month. B. Certification Statement All reports submitted by the facility shall include the following signed certification statement per 40 CFR 403.12(1): 1 certify under penalty of law that this document and all attachments were prepared under my direction or supervision in accordance with a system designed to assure that qualified personnel properly gather and evaluate the information submitted. Based on my inquiry of the person or person who manage the system, or those persons directly responsible for gathering the information, the information submitted is, to the best of my knowledge and belief, true, accurate, and complete. I am aware that there are significant penalties for submitting false information, including the possibility of fine and imprisonment for knowing violations. Page 5 of 10 C. Accidental Discharge Report NIBC shall notify the City of Kalispell within 24 hours or sooner of the occurrence of an accidental discharge o C substances prohibited by City of Kalispell Ordinance or any slug loads or spills that may enter the wastewater treatment system. During normal business hours the City of Kalispell shall be notified by telephone at 406-758-7817. At all other times, the City of Kalispell shall be notified by calling 911. The notification shall include location of discharge, date and time thereof, type of waste, including concentration and accidental releases in accordance with this section does not relieve it of other reporting requirements that arise under local, State, or Federal laws. 2. Within five days following an accidental discharge, MBC shall submit to the City of Kalispell a detailed written report. The report shall specify: a. Description and cause of the upset, slug load or accidental discharge; including location of discharge, type, concentration and volume of waste. b. Duration of discharge, including exact dates and times and, if continuing, the time by which nonn.al operation is reasonably expected to commence. c. All steps taken or to be taken to reduce, eliminate, and/or prevent recurrence of such an upset, slug load, or accidental discharge. d. BCRP shall give notice to the City of Kalispell ninety (90) days prior to any change or modification of operations which results in new or increased discharges or a change in the nature of the discharge. e. Procedures for immediately notifying the Wastewater Treatment Plant of slug discharges and measures for containing spills. 2. Description of stored chemicals. Page 6 of 10 B. Settling Tank(s) Settling Tank(s) shall be installed to receive wastewater flow from all RV sites. Wastewater effluent from the RV sites shall flow into a sample port prior to connecting to the City's sewer system. The sizing of the tank shall be a minimum of 200 gallons/RV site. If other facilities are connected upstream of a tank, additional sizing consideration shall be taken into account. C. Dump Station(s) Any dump station(s) installed in MSC shall not connect to the City's sanitary sewer. D. Flow Meter Water service meter(s) compatible with the City's metering system shall be installed in a location, which measures flow usage going to the development. The meter flow will be used to calculate the volume of wastewater being discharged from the entire site. E. Sample Port A sample port shall be installed in a location that allows sampling that best represents discharcr quality from the RV development. Design and location shall be in accordance with current City Standards for Design and Construction. F. Educate Guests of Best Management Practices MBC shall educate guests of chemicals that can safely be used at the RV park. MBC shall not sell any products that are not environmentally friendly or have the potential to cause adverse effect on the plants ability for treatment and/or permit compliance. PART 5 - STANDARD CONDITIONS A. Inspection and Entry The Industrial Pretreatment Coordinator and other duly authorized employees of the City bearing proper credentials and identification, shall be permitted to enter all properties for the purposes of inspection, observation, measurement, sampling and testing in accordance with the provisions of the City Code. Including to: Inspect any production, manufacturing, fabricating, or storage area where regulated pollutants could originate, be stored, or be discharged into the wastewater treatment system. Any persons entering production facilities will be subject to the same dress restrictions as an employee of MBC. Examine and copy any and all records required to be maintained by the pennittee for the purpose of determining compliance with Federal, State, and local regulations pertaining to wastewater. The Industrial Pretreatment Coordinator or his or her representatives shall have no authority to inquire into any processes, beyond the point where such processes have a direct bearing on the kind and source of discharge into the sewers or waterways or facilities for waste treatment. Page 7 of 10 While performing the necessary work on MBC's private property, the Industrial Pretreatment Coordinator or duly authorized employees of the City shall observe all safety rules, applicable to the premises as established by MBC; MBC shall be held harmless for injury or death to the City employees; and the City shall indemnify- the company against loss or damage to its property by City employees and against liability claims and demands for personal injury or property damage asserted against MBC and growing out of the gauging and sampling operation, except as such that may be caused by negligence or failure of MBC to maintain safe conditions. B. _Duty to Comply and Enforcement Remedies MBC must comply with all conditions of the City Ordinance. Failure to comply with these requirements may be grounds for enforcement action. The City reserves the right to take any, all, or any combination of these actions against a noncompliant user. The provisions in this section are not exclusive remedies. 1. Written Notice of Violation. ?. Compliance Orders, 3. Emergency suspension or termination of discharge 4. Severance of water supply. C. Duty to Mitigate MBC shall take all reasonable steps to minimize or correct any adverse impact to the Wastewater Treatment Plant or the environment resulting from noncompliance with this permit, including such accelerated or additional monitoring as necessary to determine the nature and impact of the noncomplying discharge. D. Dilution MBC shall not increase the use of potable or process water or, in any way attempt to dilute an effluent as a partial or complete substitute for adequate treatment to achieve compliance with the limitations contained in this permit. E. Record Keeping MBC shall retain, and make available for inspection and copying, all records of monitoring and any additional records regarding monitoring activities undertaken by the user. Records shall include the date, exact place, method, and time of sampling, and the name of the person(s) taking the samples; the dates analyses were performed; who performed the analyses; the analytical techniques or methods used; and the results of such analyses. These records shall remain available for a period of at least three (3) years. This period shall be extended for the duration of any litigation concerning the user or the City. F. Owner_shp of Sewer System Components Settling tanks, dump stations, sample ports and all other sewer conveyance systems or appurtenance at MBC shall be considered property of MBC up to the point of the connection to the City's sewer main. FOR A CONSECUTIVE WATER SYSTEM AND WATER METERING SYSTEM This agreement ("MOU") made and entered into by and between the City of Kalispell, a municipal corporation incorporated and organized under the laws of the State of Montana, ("City") and the Montana Basecamp Inc / Montana Basecamp, Inc. / Basecamp Outpost, LLC., ("Basecamp"). RECITALS 1. The City serves as the owner and operator/manager of a unified utility system known as the Kalispell Public Water System that provides water utility services to the City of Kalispell. 2. Montana Basecamp, Inc. / Basecamp Outpost, LLC. desires to provide water service to its development through a consecutive water system (the "Private Water System") which is defined as a public water system that receives some or all of its finished water from one or more wholesale systems (40 CFR 141.2). 3. The City desires to provide water service to a consecutive water system within the boundaries of the real property owned by Montana Basecamp, Inc. / Basecamp Outpost, LLC., legally described as follows, and hereinafter referred to as "Basecamp": Tracts I and 2 as shown and described in COS 20796, on file and record in the office of the Clerk and Recorder of Flathead County, Montana. 4. The City sets rates and charges for water services it provides. Rates shall be applied per the most up-to-date rate and schedule as may be adopted by the Kalispell City Council. Basecamp plans for multiple phases of development, which will include a total of 330 proposed RV spaces and multiple facilities at buitdout. Rather than City owned infrastructure within the site and individual water meters for each lot, the City and Basecamp both agree a consecutive water system fully owned, operated, and maintained by Basecamp is a benefit to both parties. A master meter system will measure and report water use for the entire site. Basecamp's Private Water System shall be sized appropriately to provide fire flows as required by the Kalispell Fire Department. 6. Each phase of the Private Water System and metering system will be designed by a professional engineer and comply with Montana Department of Environmental Quality design requirements, City Design and Construction Standards (Standards), and City Rules and Regulations Governing Water Service (Water Regulations). The City will administer water service according to the adopted Regulations; exceptions to the Regulation are Page 1 of described in the terms of this MOU. 7. The Private Water System water metering will consist of an appropriately sized meter (or meters) to capture and record water use from commercial and domestic water demands. A larger ten -inch meter will record water used during line flushing and fire flows. 8. It is understood between the parties that the volume rate for the described consecutive system shall not exceed an average of 166,000 gallons per day during the months of operation by the Private Water System. If the volume rate is fully utilized Basecamp may request an approval of a volume rate increase from the City. 9. Irrigation water will be metered separately, but considered apart of the Private Water System. Irrigation water shall only be used for irrigation of outside grass and landscape areas. NOW, THEREFORE the City and Basecamp agree as follows: 1. The foregoing recitals are true and correct and by this reference are incorporated into the terms of this MOU. 2. The City is the owner, operator/manager of the Kalispell public water system, and has the authority to administer all functions and responsibilities of the water system up to the point of connection to the Private Water System. The City will be responsible for the following: a. Setting all rates or fees for water service to generate sufficient revenue to pay all costs for the operation and maintenance, administration and routine functions of the City water system. The City is in the process of updating the water and sewer rate schedule. Upon completion of the rate study a wholesale or consecutive system charge will be established, and shall be applied once approved by City Council. b. Ensure the operations and maintenance of the City's water system are in full compliance with all applicable federal, state and municipal laws, regulations and ordinances. c. Collect all fees and charges due from consumers receiving services. The City of Kalispell will prepare one bill monthly for water service provided to Basecamp based upon total metered volume of water supplied to the point of connection to Private Water System. d. Notify Basecamp in writing of any non -compliant items and/or defective appurtenances found during inspection of the Basecamp Private Water System. If compliance is not met within 30 days after receipt of written notification, service will be terminated to Basecamp until compliance is met and accepted by the City, at which point service will be reinstated. 3. Basecamp will be responsible for the following: a. The design, construction, maintenance, and operation of the Basecamp Private Water Page 2 of System described in this MOU. b. Employing a certified water operator to complete required water sampling and operation of the Private Water System at no cost to the City. c. Failing water samples within the Basecamp Private Water System shall be reported to the City within 24 hours. d Failing water samples within the Private Water System that require the collection, testing, and reporting of water samples within the City Public Water distribution and water sources shall be wholly paid by Basecamp except as follows: If the Private Water System failing samples are found to be caused by the City's water distribution or source. e. The design, construction, maintenance, and operation of the water metering system described in this MOU. f. Providing 24-hr access for City staff to the Private Water System and water metering system to verify compliance with this agreement, the approved design City Standards, City Water Regulations, and to check or verify meter accuracy. g. For continued water supply, Basecamp shall repair or replace any defective appurtenances to and of the Private Water System and/or return such appurtenance to proper working order within 30 days after written notification by the City. h. All Backflow prevention assemblies shall be tested by a certified backflow prevention tester upon installation and annually thereafter. Repairs to backflow prevention assemblies shall be made within 7 days of the failed inspection. All backflow tests, retests and repairs shall be at no cost to the City. All Backflow prevention testing results shall be submitted to the Public Works Department for review. i. Basecamp shall perpetually maintain its status as a legal entity with the authority to respond to its legal obligations under this agreement. Basecamp may not assign its duties and obligations under this agreement without the prior written consent of the City of Kalispell. 4. The City reserves the right to refuse to deliver water to Private Water System if it is determined that conditions exist which might lead to contamination of the public water supply, and may continue to refuse such delivery of water until such condition is remedied to the satisfaction of the City. 5. The City reserves the right to sample from the Private Water System, as it deems necessary. 6, fn the event there is a need to issue a public notice regarding the public water supply, the City will issue public notice to Basecamp at its property address and business mailing address on file with the Montana Secretary of State. Basecamp will be responsible for notification of its users. Basecamp will be responsible for notifying the Department of Environmental Quality (DEQ) that the public notice was delivered as required by local state and or federal regulations. The City will not be responsible for delivery of public notices to the individual users of Basecamp under any circumstances. Page 3 of 4 7. Basecamp will be responsible to copy and distribute, as required, the Consumer Confidence Deport to its users. If required, Basecamp is responsible for notifying DEQ that Consumer Confidence Reports were provided to their users as required by local, state, or federal regulations. S. Basecamp shall obtain all of its water from the City and shall not sell water to any other person or entity. 9. Nothing in this agreement will obligate the City to operate or maintain any asset owned by Basecamp. 10, Nothing in this agreement will obligate the City to modify the operation or maintenance of the City's water treatment or water distribution system. 11. Nothing in this agreement will relieve either party from any duty required by local, state or federal rules or regulations. 11 The City may unilaterally amend this agreement in response to changes in state or federal rules and regulations or in response to circumstances that were not anticipated at the time the agreement was executed. The City will provide notice to Basecamp of any proposed amendment(s) and Basecamp will be given 30 days to comment. The amendment(s) will go into effect 30 days after Basecamp is provided with a copy of the final version of the amendrnent(s). I3. Both parties agree to review this agreement in no less than 20 years, at which time conditions of this agreement may be re-established. The parties desire that the City's sanitary sewer facility collect sanitary sewer effluent from within the boundaries of the real property owned by Basecamp, legally described as follows: Tracts 1 and 2 as shown and described in COS 20796, on file and record in the office of the Clerk and Recorder of Flathead County, Montana. 3. All mains, laterals, manholes, structures, and appurtenances located on the subject property upstream of the permanent lift station to be located on the subject property shall be a Private Sanitary Sewer System and will be privately owned and maintained by Basecamp. 4. Basecamp desires to provide sanitary sewer service to its development on the above - described property through a private temporary lift station that will be in place until a permanent lift station can be manufactured, installed, placed in service, and transferred to the ownership of the City of Kalispell. 5, The City sets rates and charges for sewer services it provides. Rates shall be applied pursuant to the most up-to-date rate and schedule as may be adopted by the Kalispell City Council. NOW, THEREFORE the City and Basecamp agree as follows: 1. The foregoing recitals are true and correct and by this reference are incorporated into the terms of this MOU. 2. The City is the owner, operator/manager of the Kalispell public sanitary sewer system, and has the authority to administer all functions and responsibilities of the sanitary sewer system downstream of and including the permanent lift station to be constructed upon the subject property. Setting all rates or fees for sanitary sewer service to generate sufficient revenue to pay all costs for the operation and maintenance, administration and routine functions of the City sanitary system. b. Ensuring the operations and maintenance of the City's sanitary sewer system are in Cult compliance with all applicable federal, state and municipal laws, regulations and ordinances. c. Collectin; all fees and charges due for the sanitary sewer services it provides. d Notifying Basecamp in writing of any non -compliant items and/or defective appurtenances found during inspection of the Basecamp temporary lift station or Private Sanitary Sewer System. 3. Basecamp will be responsible for the following: a Completing the design, construction, maintenance, and operation of the Basecamp Private Sewer System and temporary lift station described in this MOU and as indicated in the plans, specifications, calculations, and reports approved by the Department of Public Works. b. Providing a letter of concurrence from MDEQ for the temporary lift station prior to the temporary lift station being placed in service. c. Ensuring the rail system for the .l-series pumps are not modified for use in the temporary pump setup. d Programming the Mission Control Unit for callouts to Basecamp until the transfer of ownership, at which time the unit shall be transferred to the City. e. Bonding for 125% of the approved engineer's estimate for the cost of any unbuilt portions of the permanent lift station must be in place until transfer of ownership. E Completing the installation and transfer of ownership of the permanent lift station as shown and described in the approved plans by November 30, 2019. CY Completing a lift station startup of the permanent lift station with City staff and a manufacturer's representative prior to transfer of ownership. h. Providing 24-hr access for City staff to the Private Sanitary Sewer System and temporary lift station to verify compliance with this agreement, the approved design City Standards, City Water Regulations, and approved plans. i. Repairing or replacing any defective appurtenances in the Private Sanitary Sewer System or temporary lift station and/or return such appurtenance to proper working order immediately following identification by Basecamp or notification by the City. j. N'laintaining its status as a legal entity with the authority to respond to its legal obligations under this agreement. Basecamp may not assign its duties and obligations under this agreement without the prior written consent of the City of Kalispel I. Page 2 of 4 4. If, after receiving written notice of noncompliance with the requirements set forth herein from the City, Basecamp fails to comply within 30 days after receipt of such notice, service will be terminated to Basecamp until compliance is met and accepted by the City, at which point service will be reinstated. The City reserves the right to refuse to collect sewage from the Private Sanitary Sewer System if it is determined that conditions exist which might impair the Kalispell Public Sanitary Sewer System or Wastewater Treatment Plant. The City may continue to refuse such collection of sanitary sewer until such conditions are remedied to the satisfaction of the City. 5. City acceptance of all materials and workmanship shall be completed prior to lift station transfer of ownership. 6. There will be a one year warranty period for all infrastructure transferred to the City of Kalispell. The warranty period will begin after startup and acceptance of the permanent lift station and all other work indicated and required in the approved design and City Standards. These items include engineer certifications and record drawings of the permanent lift station and of such other related work M 7. Nothing in this agreement will obligate the City to operate or maintain any asset owned by Basecamp. 8. Nothing in this agreement will obligate the City to modify the operation or maintenance of the City's sanitary sewer system or sanitary sewer treatment facility. 9. Nothing in this agreement will relieve either party from any duty required by local, state or federal rules or regulations. 10. The City may unilaterally amend this agreement in response to changes in state or federal rules and regulations or in response to circumstances that were not reasonably anticipated at the time the agreement was executed. The City will provide notice to Basecamp of any proposed amendment(s) and Basecamp will be given 30 days to comment on the same prior to the adoption of the proposed amendments. The amendinent(s) will go into effect 30 days after Basecamp is provided with a copy of the final version of the amendment(s). 11. Both parties agree to review this agreement in no more than 20 years, at which time conditions of this agreement may be re-evaluated by the City and re-established in consideration of the City's new evaluation. Basecamp Outpost, LLC will obtain a letter from the Kalispell Parks and Recreation Director approving of its landscape plan as described in Condition No. 21 of Ordinance No. 1815. Basecamp Outpost, LLC will install a landscaped berm along the northerly boundary of the RV park property in accordance with Condition No. 22 of Ordinance No. 1815. Security / Safety. Security for Montana Basecamp RV Park will be accomplished through an on - site manager. Local police will be contacted for criminal violations that occur within the RV Park. The on -site manager will also call police as needed for public disobedience. The on -site manager will use all reasonably safe and prudent means to diffuse most on -site situations. Montana Basecamp, Inc. has a long term operational goal of being designated as a "Gated Tourism Destination Outdoor/Indoor Resort" and will work with the City towards an agreeable gated business model as Kalispell grows. As for emergency vehicle ingress and egress to and from the RV Park, the fire exit shall be restricted to emergency operations only. City Police will be contacted for citation of any violators. The Fire Exit will be marked as "Emergency Fire Exit Only" using signs along the road, above the road, and painted on the road. Storm Water. Basecamp Outpost, LLC will abide by Condition No. 14 of Ordinance 1815 by submitting the required erosion / sediment control plan and other documents described in such Condition. The Developer will also, in accordance with Condition No. 13 of Ordinance No. 1815, submit a storm water report and engineered drainage plan to the Kalispell Public Works Department, for its review and approval. The Developer will abide by and follow the aforementioned erosion / sediment control plan, storm water report, and engineered drainage plan. Long -Term Stay. Although Montana Basecamp will provide service as market conditions dictate, current operations, and those in the foreseeable future, will be focused on spring - fall tourism destination RV tourism. The maximum allowed stay in the RV Park will be 90 consecutive days. However, movement of an RV from one space to another will result in the initiation of a new time period. Mobile homes and house trailers, as defined under Montana law, will be prohibited at the RV Park. R.V. Dump Station and Sewer System. The on -site manager will coordinate sewer/ water testing as needed and required during park operation with a duly licensed firm. The on -site manager will also coordinate sewer tank clean out as needed / required and as part of the winterization process. Sealed sewer elbows will be required on all RV sewer hoses. Guests will not be allowed to connect to the RV park sewer system without one. Emptying of RV black water and gray water tanks will only be allowed at provided and clearly marked dump stations in strict adherence with posted instructions. With regard to the Montana Basecamp RV Park's dump station(s) and internal sewer system, Basecamp Outpost, LLC will abide by and follow the MOU between the City of Kalispell and the Developer regarding sewage effluent and effluent limitations. "Owner or operator" means a person who owns, leases, operates, controls, or supervises a point source. In this General Permit, the "owner or operator" is also identified as the "perrnittee". A "storm wafter discharge associated with construction activity" regulated under this permit is determined by meeting both of the following two criteria: • There are areas of ground disturbance or other potential pollutant sources due to the construction activity where a storm water discharge to state surface waters can occur. • The construction activity has a total area of ground disturbance through clearing, excavating, grading, or placement/removal of earth material which is equal to or greater than one acre. The "total area" must include all areas which are part of a "larger common plan of development or sale". Larger common plan of development or sale means a contiguous area where multiple separate and distinct construction activities are planned to occur at different times on different schedules under one plan. These separate and distinct construction activities which form a larger common plan of development or sale may have areas of disturbance which are not physically connected. The permittee must consider support activities for the construction project which may be on or off the conventional construction project "site". Support activities can include, but are not limited to, areas used for access -related work, earth material borrow areas, equipment staging areas, materials storage areas, temporary concrete or asphalt batch plants, and any areas used for fill placement. For storm water discharges from support activities to be covered under this permit for a particular construction activity permit authorization, such support activities must: • Not be part of a larger commercial operation serving multiple unrelated construction activities, and not continue operation beyond the completion of the particular construction activity, and • Have appropriate controls and measures identified for the particular support activity. All construction activities that disturb and are part of a larger common plan of development or sale are subject to permit coverage. Please review Part I of the General Permit for all eligibility requirements for coverage. A Notice of Intent (NOD process is used for an owner or operator to obtain authorization to discharge under this permit. Through the submittal of a NOI, the owner or operator acknowledges eligibility for coverage under this permit and agrees to comply with the effluent limits and conditions of this permit. The complete NOI Package submitted to: Montana Department of Environmental Quality Water Protection Bureau P.O. Box 200901 319/2319 Page 6 of 11 Helena, MT 59620-0901 The complete NOI Package consists of: • A completed NOI form and attached USGS map; • A separate SWPPP completed in accordance with the requirements this General Permit; • A copy of the consultation letter from the Montana Sage Grouse Habitat Conservation Program (if applicable); and • The appropriate "application fee" for the NOI. Upon receipt of the NOI Package by the Department, it is stamped with the date of receipt. The Department then performs a check to ensure the NOI Form is complete, that a signed SWPPP is attached, and that the required fee is submitted. If the NOI Package is determined to be complete, authorization is effective upon the date it was stamped as received and the Department issues a Confirmation of Receipt letter to the permittee. If the NOT Package is incomplete, the Department provides notification as to what the deficiencies are, and permit authorization does not become effective under this permit until the deficiencies are addressed and the Department subsequently receives the complete NOI Package, Coverage does not relieve the permittee from any other statute, regulation, permits, or other regulatory requirements for activities occurring within their area and not associated with permitted storm water discharges associated with construction activities. Instructions for N01 Sections Section A — NOI Status Check the appropriate box. For resubmitted, renewal, and modification status provide the 9-digit authorization number (beginning with MTR10) assigned to your construction activity. New: Use only if no prior NOI submitted for this facility/site. Resubmitted: Use only if requested by DEQ to resubmit NOI and/or SWPPP. Renewal: Use only if renewing an authorization before the expiration date of December 31, 2017. Modification: Use only if this facility/site has General Permit coverage and the authorization needs to be updated. A permittee may not modify an authorization to add additional construction -related disturbance area(s) unless the new additional construction -related disturbance is directly contiguous to and directly associated with the original site, except for support activities. Section B — Facility or Site Information Enter the legal or official name and complete street address. If the street address is not available, include the nearest intersection or other identifying information. Provide the latitude and longitude for the location of the approximate center point of the construction activity site. It is preferred the latitude and longitude location be specified in decimal degrees, accurate to the fourth decimal place. If the preferred decimal degrees are not used, then the latitude and longitude must be provided in degrees, minutes, and seconds, accurate to the nearest second. 3/9/2019 Page 7 of 11 Indicate if any construction activity covered under this NOI will occur on Indian Reservations. This Permit applies to all areas of the State of Montana, except for Indian Reservations. Please contact EPA for construction activity within Indian Reservations. Section C — Applicant (Owner/Operator) Information An "owner or operator" is a person who owns, leases, operates, controls, or supervises the construction activity. The owner or operator can be identified as an organization or business name. The owner or operator acknowledges eligibility for coverage under this General Permit and agrees to comply with the effluent limits and conditions of this permit. Section D — Existing or Pending Permits Certifications orApprovals Provide a list of permits, certifications, and/or approvals from state or federal regulatory agencies regarding the construction activity or project. Local Sediment and Erosion Control Requirements: Verify if the construction activity is proposed within a regulated Municipal Separate Storm Sewer System (MS4) to include: • The Cities of Billings, Bozeman, Butte, Helena, Great Falls, Missoula, and Kalispell; • Yellowstone, Cascade, and Missoula Counties; and • Others - Malmstrom Air Force Base, University of Montana -Missoula, Montana State University, and the Montana Department of Transportation (as applicable). If the construction activity is located within a regulated MS4, verify contact and incorporate any additional MS4 requirements into the Storm Water Pollution Prevention Plan (SWPPP). Sage Grouse Habitat: Visit http Z/sagearouse.mt.gov/ and review the Sage Grouse Core Areas and General Habitat Map to determine whether your project would occur in sage grouse habitats designated as a core area, general habitat, or a connectivity area. Projects within sage grouse habitat must be submitted to the Montana Sage Grouse Habitat Conservation Program (the Program), through their website, for consultation. Any recommendations and mitigations determined by the Program are provided in a consultation letter, If the project is outside of sage grouse habitat, no consultation is required. . Section E — Standard Industrial Classification (SIC) Codes Select at least one SIC code that best reflects the type of construction activities or description of the nature of the business applicable to General Permit coverage. SIC codes can be obtained at http:[L-ww.census.gov/epcd/www/naics.html or http;//www.osha.gov/pls/imis/sicsearch,html, Section F — SWPPP Preparer and Administrator The permittee must identify a SWPPP Preparer and SWPPP Administrator and the requested contact information. The name of the training course(s) and date of completion(s) must be provided within the NOI form. Valid certification documents or certificates of completion from the listed training courses must be maintained with the SWPPP. Valid certification that demonstrates the following concepts: • MPDES permitting requirements to include, but not limited to, applicability, application procedures, SWPPP elements, standard conditions, and termination conditions; • Local permitting requirements; • Sage Grouse requirements based on location of the project, V9/2019 Page 8 of 11 • Knowledge of the principles and practices of erosion and sediment controls and pollution prevention practices; • Construction site assessment and planning skills to include knowledge and identification of major construction activities and the phases of construction activities and all support activities, and the potential pollutants generated based on the scope of the project; • Development, selection, and implementation skills for all storm water controls and BMPs on the site, including final stabilization measures, required by this permit based on appropriate design, installation, function, and location; and how they are to be maintained and/or repaired according to developed and/or manufacturers plans and specifications; • Development, selection, and implementation skills for pollution prevention controls and BMPs required by this permit; * Development and implementation skills for procedures and associated documentation for all inspections, maintenance, and required recordkeeping to include when and how to conduct; - inspections, record applicable findings, take corrective actions, and, when appropriate, report violations and/or noncompliance; and • Ability to develop and update the site map(s) required by this permit. SWPPP Preparer (Effective January 1, 2019): A SWPPP Preparer must be identified. A SWPPP Preparer is an individual or position title who is responsible for planning and development of the SWPPP prior to submission of the NOT. The SWPPP Preparer must develop and document all aspects of the SWPPP, initiating with the start of construction activities, and lasting until final stabilization is achieved and the permit authorization is terminated. The SWPPP Preparer minimum requirements and valid certification must be completed before the submittal of the NOI Package to the Department. *If the NOI is submitted prior to January 1, 2019, a SWPPP Preparer is not required to be identified and this section may be left blank. Effective January 1, 2019, a SWPPP Preparer must be identified in this section and obtain valid certification prior to SWPPP preparation and NOI submittal. SWPPP Administrator: The permittee must specify a primary SWPPP Administrator and a secondary SWPPP Administrator as applicable. Additional SWPPP Administrators can be identified in Attachment A. A SWPPP Administrator(s) is an individual or position title who is responsible for developing, implementing, maintaining, revising, and updating the SWPPP. The SWPPP Administrator(s) must address all aspects of the SWPPP, initiating with the start of construction activities, and lasting until final stabilization is achieved and the permit authorization is terminated. This SWPPP Administrator(s) minimum requirements and valid certification must be completed before the start of earth -disturbing activities or potential pollutant -generating activities, whichever occurs first. For new employees hired after this time, the minimum requirements and valid certification must be completed before assuming SWPPP Administrator responsibilities, Section G — Receivi%LSurface Water(s) An outfall location is considered to be a discrete channel, conveyance, structure, or flow path from which storm water discharge leaves the boundary of the facility or site. "Surface waters" is any waters on the earth's surface including, but not limited to, streams, lakes, ponds, reservoirs, or other surface water including ephemeral and intermittent drainage ways and irrigation systems. Identify 3/9/2QI 9 Page 9 of 11 the immediate receiving surface water and the latitude and longitude of the outfall using decimal degrees. Provide the following information in the table: • Outfall number assignment starts with 001. If the outfall is not discrete or well defined, the relative outfall location may be assigned to the relative flow path or drainage area. • If the immediate receiving surface water is unnamed, provide the latitude and longitude of the immediate receiving surface water and indicate the closest named surface water that the unnamed receiving waterbody flows into (i.e. unnamed tributary to Rock Creek or unnamed drainage to Clear Creek). This naming process will provides better clarification. ■ For existing permittees, ensure outfall numbers used are consistent with those identified in the past for the same outfall. Waterbodies with Impairments Identify if storm water discharges from the construction activity will discharge to impaired waterbodies. Determine if the immediate receiving surface waters identified in Section G and/or other surface waters with connectivity and within one mile of the construction site boundaries identified in the map required in Section K are listed as impaired. Information on impaired waterbodies may be obtained from the Department or from the Montana DEQ Clean Water Act Information Center website at httsvc.mt. ov de dst # a cwaic. An interactive map is located at: http://deq.mt.gov/Water./WOPB/CWAIC. Compare pollutant(s) of impairment to identified potential pollutant sources from your construction activities. Typical pollutants from construction activities include sediment, suspended solids and turbidity, and any secondary sources of pollutants based on materials and support activities. Section H — Nature of the Construction Activity or Project In your own words, briefly describe the overall construction activity that requires authorization under this General Permit, Provide a summary of the phases and associated Best Management Practices required to achieve final stabilization. Do not repeat the SIC Code description. Provide information regarding the actual project. Enter the total site area of the project in acres. Enter the number of acres of construction related disturbance for the site. This calculation includes the common plan of development or sale and support activities. Enter the estimated project start date, completion date, and final stabilization date. These dates are recognized as estimated and provide a timeframe for the project. Section I -- Supplemental Information *For Permit Modification Only. Leave this section blank except for modification. Modification requests (including decreased or increased disturbance area) submitted by the permittee within six months of the date of issuance of the authorization are processed as a minor modifications. If the authorization requires modification after six months of the date of issuance (other than an ownership/name change using the Permit Transfer Notification form), the modification will be processed with a new project fee. 3/9/2019 Page 10 of l l A permittee may not modify the NOI to add additional construction -related disturbance area(s) unless the new additional construction -related disturbance is directly contiguous to and directly associated with the original site, except for support activities. Sage Grouse Consultation Requirements for Modifications: Any modification due to a change in disturbed acreage requires verification of the construction project boundaries being in designated sage grouse habitat that will result in a consultation letter and/or updates to a consultation letter, If the modification request is outside of sage grouse habitat, no consultation is required. Section J — Fee New Projects: The fee for new projects is based on the number of disturbed acres from Section H of this form. The fee for disturbing one to five acres (inclusive) is $900.00. The fee for over five acres up to and including ten acres is $1,000.00, The fee for over ten acres up to and including twenty-five acres is 52,200.00. The fee for over twenty-five acres up to and including one hundred acres is $2,000,00. The fee for any number of acres over one hundred is $3,500,00. Modification: The fee for a minor modification to the original permit authorization is $500.00, Minor modifications must be made within six months of the original issue date. Examples of a minor modification include changing the number of disturbed acres within one of the ranges above, or changing or adding outfall locations, If the acreage increases to a new fee range, the permittee must pay the difference from the original fee amount submitted. Updating administrative information (examples: addresses, phone numbers and changing the SWPPP administrator) are examples that do not require an NOI or fee. If the modification is made after the first six months from the original issue date, the full fee applies. See the correct amount under New Projects above. Renewal: A renewal is only for permittees requiring continued authorization beyond the December 31, 2017, expiration date. The fee is based on the number of disturbed acres under new projects. Resubmittal: A resubmittal is only used if the entity was required to resubmit by request of DEQ, The fee is $500.00. Permit Transfer Fee: The permit transfer is to change ownership of the permit authorization to another entity. The fee is $500.00. Do not use this form, use the PTN Form. Section K —Attachments Map: Attach a USGS topographic map extending one mile beyond the project boundaries of the site or activity in Section B depicting the facility or activity boundaries, the receiving surface waters in Section G, and other major drainage patterns to include connectivity from the receiving surface waters. Section I — Final Stabilization (Part 3.8) Identify the BMPs that will be used to achieve final stabilization. Information to be included is seed mix selection and application methods, soil preparation and amendments, soil stabilization practices, and any temporary BMPs. All disturbed areas will be seeded to accomplish final stabilization. Section J — Post -Construction Storm Water Management (Pail 3.9) Identify BMPs that will be used to control storm water discharges that will occur after the major construction activities are complete. Include a description of applicable local requirements. All BIVIP's will stay in place until final stabilization occurs inlet protection, street sweeping, and spill kit on site. The Planned Unit Development for Montana Base Camp allows the following deviations from the Kalispell Zoning Ordinance: a) Kalispell Zoning Ordinance, Chapter 27.13 — Allows for an R.V. Park and accessory uses only on the property in accordance with the development plan submitted. All other permitted and conditionally permitted uses within the B-2 zone are not allowed at this time. 2. That the development of the site will be in substantial conformance with the documents entitled Montana Base Camp and associated submittal drawings which shall govern location of the lots, easements, roadways, phasing plan, landscaping, parkland/open space, stormwater, and pedestrian access facilities. 3. The preliminary plat approval for the development shall be valid for a period of three years from the date of approval. 4. In lieu of Filing a final plat, the subdivider shall submit to the Kalispell Planning Department four official copies and one digital copy of a plat labeled "Revised Preliminary Plat" conforming to the requirements for preliminary plats contained on the Appendix A of the Kalispell Subdivision Regulations. 5. A development agreement shall be drafted by the Kalispell City Attorney between the City of Kalispell and the developer outlining and formalizing the terms, conditions and provisions of approval. The final plan as approved, together with the conditions and restrictions imposed, shall constitute the Planned Unit Development (PUD) zoning for the site that shall be completed and signed by the city and owner prior to the issuance of a building permit. 6. Architectural renderings for all commercial buildings are required to be submitted to the Kalispell Architectural Review Committee for review and approval prior to issuance of a building permit. 7. To ensure the traffic flow and access comply with Kalispell Design and Construction Standards, the development shall receive Site Review Committee approval prior to issuance of building permits. New infrastructure required to serve the subdivision shall be designed and constructed in accordance with the City of Kalispell's Standards for Design and Construction. All design work shall be reviewed and approved in writing by the Kalispell Public Works Department prior to construction. This infrastructure shall include but not be limited to streets, street lighting, street signage, curb, gutter, boulevard and sidewalks. 9. Water and sewer main extensions shall be designed and constructed in accordance with the City of Kalispell's Standards for Design and Construction and in compliance with the city facility plan updates and extensions of services plans. The water and sewer main extension plans shall be reviewed and approved by the Kalispell Public Works Department, 10. The developer shall work with the Montana Department of Environmental Quality in seeking a deviation from the individual water service line requirement in an effort to reduce the number of water meters within the development. 11. Sewer mains located outside of public Right-of-ways shall be privately owned, operated and maintained. 12. Pursuant to septic sewer requirements, the Applicant shall coordinate with the City of Kalispell Pretreatment Coordinator for development of items related to the Pretreatment Program. Applicant shall enter into a Memorandum of Understanding (MOU) for each phase of Construction to establish sampling protocols for the Wet Industry Impact Fee, sewer billing surcharge, and other related pretreatment requirements applicable at the time of construction. Applicant shall install a sample port meeting the requirements of the City Design and Construction Standards and Pretreatment Program on the sewer collection system downstream of the most downstream future phase or current phase connection point. Applicant shall install applicable pretreatment appurtenances as required, such as pretreatment interceptors. Applicant shall bear all costs of sampling completed in accordance with the sampling protocols developed in the MOUs. 13. The developer shall submit to the Kalispell Public Works Department for review and approval a stormwater report and an engineered drainage plan that meets the requirements of the current City standards for design and construction. The stormwater design shall be in compliance with the submitted drawings which indicate the intent of the stormwater areas being shallow, landscaped areas that can also be used for recreation. The plan shall be updated and approved for each phase of construction 14. The developer shall submit to the Kalispell Public Works Department prior to construction an erosion/sediment control plan for review and approval and a copy of all documents submitted to Montana Department of Environmental Quality for the General Permit for Stormwater Discharge Associated with Construction Activities. 15. A letter from the Kalispell Public Works Department shall be submitted stating that all new infrastructure has been accepted by the City of Kalispell or a proper bond has been accepted for unfinished work prior to submittal of the Revised Preliminary Plat. 16. If the developer chooses to use the City of Kalispell solid waste pickup program they shall coordinate the number, size and location of all pickup bins prior to installation. The area to be used for solid waste pickup shall have appropriate access, size and maneuvering area for city solid waste trucks. 17. The traffic impact study for the project site shall be reviewed and approved by the Public Works Department and where appropriate, the Montana Department of Transportation in order to determine the appropriate mitigation as the project develops. 18. The developer shall obtain an approach permit from the Montana Department of Transportation (MDT) for approaches onto the bypass and Ashley Meadows. If any improvements are necessary at the intersection of the roadways, these improvements shall be completed to the satisfaction of the MDT prior to the Revised Preliminary Plat. MDT shall so certify this in writing to the city. 19. Prior to Revised Preliminary Plat all mitigation required as part of the approved traffic impact study shall be completed for each phase. All improvements shall be reviewed and approved by either the Public Works Department or Montana Department of Transportation. A letter from the Kalispell Public Works Department or Montana Department of Transportation shall be submitted stating that all new infrastructure has been accepted by the City of Kalispell or State of Montana. If infrastructure work has not been accepted, a letter stating that a proper bond has been accepted for the unfinished work by the appropriate agency is required. 20. A letter from the Kalispell Fire Department approving the access, placement of the fire hydrants and fire flows within the subdivision shall be submitted prior to Revised Preliminary Plat for each phase. 21. A letter shall be obtained from the Parks and Recreation Director approving a landscape plan for the placement of trees and landscaping materials within the landscape boulevards of the streets serving the subdivision. 22. A 6' tall landscaped berm with a 3:1 slope shall be constructed along the entire northerly property boundary. The berm shall be landscaped with grass, trees bushes and shrubs to form a pleasing sight obscuring visual barrier. The plan shall be approved by the Parks and Recreation Director. The berm may be phased so as to buffer adjacent development. 23. All parking areas shall be constructed in accordance with Chapter 27.24 of the Kalispell Zoning Ordinance except as provided for in condition l above. 24. Signage shall be installed in accordance with Chapter 27.22 of the Kalispell Zoning Ordinance. 25. Common facilities on the property (pool, recreation building camp store, food, etc.) shall be intended for guests of the R.V. Park and not open to the general public. 26. All easements and/or right-of-ways shall be indicated on the face of the Revised Preliminary Plat. Utility easements for City water and sewer shall be provided to allow for the logical extension of utilities from this subdivision to adjoining properties. A letter from the Kalispell Public Works Department shall be obtained stating that the required easements are being shown on the final plat. 27. The following statement shall appear on the final plat: "The undersigned hereby grants unto each and every person, firm or corporation, whether public or private, providing or offering to provide telephone, telegraph, electric power, gas, cable television, water or sewer service to the public, the right to the joint use of an easement for the construction, maintenance, repair, and removal of their lines and other facilities, in, over, under, and across each area designated on this plat as "Utility Easement" to have and to hold forever." That a minimum of two-thirds of the necessary public infrastructure for this subdivision shall be completed prior to Revised Preliminary Plat submittal for each phase and that both the water and sewer systems serving this phase be operational. 29. All utilities shall be placed underground and in locations that are approved by the Kalispell Public Works Department in accordance with the Kalispell Standards for Design and Construction. 30. The following public right-of-way improvements shall be completed at each phase of the development: a) Phase 1 — The new unnamed city street shall be improved to city standards from the roundabout to the northern entrance into the development and from Ashley Meadows to the southern access into the development. b) Phase 2 — The unnamed city street shall be constructed to city standards at the point 165 R.V. spaces are constructed connecting the northern and southern entry points into the development. 31. A management plan shall be completed and submitted to the city with provisions on how the developer intends to manage the open space areas, Iandscaping, security, stormwater, long- term stay, R.V. dump station and wayfinding signs. 32. Guests shall be limited to no more than 90 consecutive days within the park. Moving an R.V. from one location to another within the park shall not constitute a new time period. 33. Fires are permitted only in facilities provided for this purpose. 34. Skirting of R.V.s is prohibited. 35. Mobile homes are prohibited. 36. Fireworks are prohibited. 37. On -street parking shall be prohibited within the development on the private road system. 38. A development agreement shall be drafted by the Kalispell City Attorney between the City of Kalispell and the developer outlining and formalizing the terms, conditions and provisions of approval. The final plan as approved, together with the conditions and restrictions imposed, shall constitute the Planned Unit Development (PUD) zoning for the site that shall be completed and signed by the city and owner prior to the issuance of a building permit. 6. Architectural renderings for all commercial buildings are required to be submitted to the Kalispell Architectural Review Committee for review and approval prior to issuance of building permit. 7. To ensure the traffic flow and access comply with Kalispell Design and Construction Standards, the development shall receive Site Review Committee approval prior to issuance of building permits. 8. New infrastructure required to serve the subdivision shall be designed and constructed in accordance with the City of Kalispell's Standards for Design and Construction. All design work shall be reviewed and approved in writing by the Kalispell Public Works Department prior to construction. This infrastructure shall include but not be limited to streets, street lighting, street signage, curb, gutter, boulevard and sidewalks. 9. Water and sewer main extensions shall be designed and constructed in accordance with the City of Kalispell's Standards for Design and Construction and in compliance with the city facility plan updates and extensions of services plans. The water and sewer main extension plans shall be reviewed and approved by the Kalispell Public Works Department. 10. The developer shall work with the Montana Department of Environmental Quality in seeking a deviation from the individual water service line requirement in an effort to reduce the number of water meters within the development. 11. Sewer mains located outside of public Right-of-ways shall be privately owned, operated and maintained. 12. Pursuant to septic sewer requirements, the Applicant shall coordinate with the City of Kalispell Pretreatment Coordinator for development of items related to the Pretreatment Program. Applicant shall enter into a Memorandum of Understanding (MOU) for each phase of Construction to establish sampling protocols for the Wet Industry Impact Fee, sewer billing surcharge, and other related pretreatment requirements applicable at the time of construction. Applicant shall install a sample port meeting the requirements of the City Design and Construction Standards and Pretreatment Program on the sewer collection system downstream of the most downstream future phase or current phase connection point. Applicant shall install applicable pretreatment appurtenances as required, such as pretreatment interceptors. Applicant shall bear all costs of sampling completed in accordance with the sampling protocols developed in the MOUs. 13. The developer shall submit to the Kalispell Public Works Department for review and approval a stormwater report and an engineered drainage plan that meets the requirements of the current City standards for design and construction. The stormwater design shall be in compliance with the submitted drawings which indicate the intent of the stormwater areas being shallow, landscaped areas that can also be used for recreation. The plan shall be updated and approved for each phase of construction 14. The developer shall submit to the Kalispell Public Works Department prior to construction an erosion/sediment control plan for review and approval and a copy of all documents submitted to Montana Department of Environmental Quality for the General Permit for Stormwater Discharge Associated with Construction Activities. 15. A letter from the Kalispell Public Works Department shall be submitted stating that all new infrastructure has been accepted by the City of Kalispell or a proper bond has been accepted for unfinished work prior to submittal of the Revised Preliminary Plat. 16. If the developer chooses to use the City of Kalispell solid waste pickup program they shall coordinate the number, size and location of all pickup bins prior to installation. The area to be used for solid waste pickup shall have appropriate access, size and maneuvering area for city solid waste trucks. 17. The traffic impact study for the project site shall be reviewed and approved by the Public Works Department and where appropriate, the Montana Department of Transportation in order to determine the appropriate mitigation as the project develops. 18. The developer shall obtain an approach permit from the Montana Department of Transportation (MDT) for approaches onto the bypass and Ashley Meadows. If any improvements are necessary at the intersection of the roadways, these improvements shall be completed to the satisfaction of the MDT prior to the Revised Preliminary Plat. MDT shall so certify this in writing to the city. 19. Prior to Revised Preliminary Plat all mitigation required as part of the approved traffic impact study shall be completed for each phase. All improvements shall be reviewed and approved by either the Public Works Department or Montana Department of Transportation. A letter from the Kalispell Public Works Department or Montana Department of Transportation shall be submitted stating that all new infrastructure has been accepted by the City of Kalispell or State of Montana. If infrastructure work has not been accepted, a letter stating that a proper bond has been accepted for the unfinished work by the appropriate agency is required. 20. A letter from the Kalispell Fire Department approving the access, placement of the fire hydrants and fire flows within the subdivision shall be submitted prior to Revised Preliminary Plat for each phase. 21. A letter shall be obtained from the Parks and Recreation Director approving a landscape plan for the placement of trees and landscaping materials within the landscape boulevards of the streets serving the subdivision. 22. A 6' tall landscaped berm with a 3:1 slope shall be constructed along the entire northerly property boundary. The berm shall be landscaped with grass, trees bushes and shrubs to form a pleasing sight obscuring visual barrier. The plan shall be approved by the Parks and Recreation Director. The berm may be phased so as to buffer adjacent development. 23. All parking areas shall be constructed in accordance with Chapter 27.24 of the Kalispell Zoning Ordinance except as provided for in condition 1 above. 24. Signage shall be installed in accordance with Chapter 27.22 of the Kalispell Zoning Ordinance. 25. Common facilities on the property (pool, recreation building camp store, food, etc.) shall be intended for guests of the R.V_ Park and not open to the general public. 26. All easements and/or right-of-ways shall be indicated on the face of the Revised .Preliminary Plat. Utility easements for City water and sewer shall be provided to allow for the logical extension of utilities from this subdivision to adjoining properties. A letter from the Kalispell Public Works Department shall be obtained stating that the required easements are being shown on the final plat. 27. The following statement shall appear on the final plat: "The undersigned hereby grants unto each and every person, firm or corporation, whether public or private, providing or offering to provide telephone, telegraph, electric power, gas, cable television, water or sewer service to the public, the right to the joint use of an easement for the construction, maintenance, repair, and removal of their lines and other facilities, in, over, under, and across each area designated on this plat as "Utility Easement" to have and to hold forever." Developer's Name 28. That a minimum of two-thirds of the necessary public infrastructure for this subdivision shall be completed prior to Revised Preliminary Plat submittal for each phase and that both the water and sewer systems serving this phase be operational. 29. All utilities shall be placed underground and in locations that are approved by the Kalispell Public Works Department in accordance with the Kalispell Standards for Design and Construction. 30. The following public right-of-way improvements shall be completed at each phase of the development: a) Phase l — The new unnamed city street shall be improved to city standards from the roundabout to the northern entrance into the development and from Ashley Meadows to the southern access into the development. b) Phase 2 — The unnamed city street shall be constructed to city standards at the point 165 R.V. spaces are constructed connecting the northern and southern entry points into the development. 31. A management plan shall be completed and submitted to the city with provisions on how the developer intends to manage the open space areas, landscaping, security, stormwater, long-term stay, R.V. dump station and wayfinding signs. 32. Guests shall be limited to no more than 90 consecutive days within the park. Moving an R.V. from one location to another within the park shall not constitute a new time period. 3a. Fires are permitted only in facilities provided for this purpose. 34. Skirting ofR.V.s is prohibited. 35. Mobile homes are prohibited. 36. Fireworks are prohibited. 37. On -street parking shall be prohibited within the development on the private road system. 38. Trail connections to the Rails to Trails pathway shall not be made until a letter has been submitted to the City of Kalispell Planning Department from both the Montana Department of Transportation and the Rails to Trails board accepting the proposed design. 39. The developer shall coordinate with the Montana Department of Transportation and Rails to Trails board a redesign of the path where it crosses the new unnamed city street and Ashley Meadows so that there is only one street crossing, rather than two. 40. The developer shall coordinate with the Montana Department of Transportation and move the southern end of the new unnamed city street to the east so that it could provide a logical intersection with Ashley Meadows and future development develop to the south. 41. The developer shall coordinate with the Montana Department of Transportation and remove the barbwire fence at the top of the existing wood fencing along the pathway boundary. SECTION 3. The balance of Section 27.02.010, Official Zoning Map, City of Kalispell Zoning Ordinance not amended hereby shall remain in full force and effect. SECTION 4. This Ordinance shall take effect from and after 30 days of its passage by the City Council. It is agreed that if the project is extended, the developer will be responsible for submitting bonding for the remaining improvements as specified on the submitted plan for Montana Basecamp. The bond may not be longer than a period of 12 months. Tree plantings are required to meet the Street Tree Ordinance standards of 2 1/4" caliper and have a 4 foot fibrous mulch around them in addition to meeting ISA planting standards. Any landscape revisions or substitutions need to be authorized prior to installation. They will need to coordinate with Public Works for any permits/approvals of working in the right of ways prior to working in the right of way. Final approval will be given upon completion, inspection and approval of the landscaping and tree plantings, at which time any bonding that has been submitted will be released. It should be noted that the trees and landscaping are under a warranty period and should they die within this time frame, the developer will be responsible for replacement.
