Ordinance 1385 - Zoning Text Amendment - Off-Street Parking in H-1 DistrictORDINANCE NO. 1385 191 1 AN ORDINANCE AMENDING SECTION 27.26.030(e)(2) OF THE KALISPELL ZONING ORDINANCE, (ORDINANCE NO. 1175), BY AMENDING OFF STREET PARKING DESIGN TO ALLOW PARKING IN THE FRONT AND SIDE SETBACKS IN THE H-1, HEALTH CARE DISTRICT, AND DECLARING AN EFFECTIVE DATE. WHEREAS, Northwest Healthcare -- The Summit has submitted a written request to amend Section 27.26.030(e)(2) of the Kalispell Zoning Ordinance, by amending Off Street Parking Design to allow parking in the front and side setbacks in the H-1, Health Care District, and WHEREAS, the request was forwarded to the Kalispell City -County Planning Board and Zoning Commission by the Flathead Regional Development Office after having been evaluated under 27.14.030, Kalispell Zoning Ordinance, and WHEREAS, the Kalispell City -County Planning Board and Zoning Commission recommended that parking be allowed in the front and side setbacks in the H-1, Health Care District, and WHEREAS, the City Council has reviewed the FRDO Report and the transmittal from the Kalispell City -County Planning Board and Zoning Commission and hereby adopts the findings made in Report ##KZTA-01-06 as the Findings of Fact applicable to this Ordinance. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF KALISPELL AS FOLLOWS: SECTION I. The City of Kalispell Zoning Ordinance, Ordinance No. 1175, is hereby amended as follows: 27.26.030 Off Street Parking -- Design 2) . In B-1, B-2, B-3_,_ and B-5 and H-1 zones: i). vehicles will be allowed to park within five (5) feet of the front and side corner lot line. ii). Vehicles will be allowed to park in the side yard setback as long as a sight obscuring fence or landscaping is constructed along the side lot line obscuring the presence of the parked vehicles. This requirement may be waived where property abuts an existing parking lot. (Note: when a designated parking lot abuts a residentially zoned property other than the R-5 zone, the side yard abutting the residential zone may not be used for parking.) 192 SECTION II. All parts and portions of Ordinance No. 1175 not amended hereby remain unchanged. SECTION III. This Ordinance shall take effect thirty (30) days after its final passage.
