NOTICE OF PUBLIC HEARING
RESOLUTION NO. 4662
A RESOLUTION OF INTENTION TO APPROVE, MODIFY OR DENY A PLANNED UNIT
DEVELOPMENT AGREEMENT ON CERTAIN REAL PROPERTY OWNED BY THE
DEPARTMENT OF NATURAL RESOURCES AND CONSERVATION (DNRC) KNOWN AS
SECTION 36.
WHEREAS, On August 13, 2001, the Department of Natural Resources
and Conservation (DNRC) made an application for zoning
under Chapter 27.21, Kalispell Zoning Ordinance, Creation
of Planned Unit Development District, and
WHEREAS, on September 11, 2001, the Kalispell City County Planning
Board and Zoning Commission reviewed the application and
recommended adoption of Commercial/Industrial, B-5;
Residential/Professional Office, R-5; and Residential, R-
4 with a Planned Unit Development overlay zoning for the
property, and
WHEREAS, under §27,21.020, Kalispell Zoning Ordinance requires
that the City Council hold a public hearing to consider
the recommendation of the Zoning Commission regarding a
Planned Unit Development proposal.
NOW THEREFORE BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. That pursuant to §27.21.020 (4), Kalispell
Zoning Ordinance, the City Council of the City
of Kalispell intends to consider a proposed
Planned Unit Development amendment to the
Kalispell Zoning Ordinance, made by the
Department of Natural Resources and
Conservation on Section 36, as recommended by
the Kalispell City -County Planning Board and
Zoning Commission. Said amendment consisting
of creating a Commercial/Industrial, B-5;
Residential/Professional Office, R-5; and
Residential, R-4 with a PUD overlay on
property owned by the DNRC bordered by Four
Mile Drive on the south, West Reserve Drive on
the north and Stillwater Road on the west, by
adopting, revising or rejecting said proposed
amendment.
SECTION II. That the. City Council of the City of Kalispell
shall consider whether to pass a final
resolution affirming, modifying or denying
proposed amendment as set forth herein at a
meeting to be held on October 15, 2001 at 7:00
P.M., at the Council Chambers, City Hall,
Kalispell, Montana, and at the conclusion of
said meeting the City Council will consider a
Resolution to revise, reject or adopt the
proposed amendment.
SECTION 111. The Clerk of Council is authorized and
directed to give notice of this meeting in
accordance with Section 7-1-4128, MCA.

AND SIGNED BY THE MAYOR, THIS 1ST DAY OF OCTOBER, 2001.
