WHEREAS, Northwest Healthcare Corporation, the owner of
certain real property described as Huf Palo Commons Phase 3, Block
1, Section 6, T , N, R21Wr P.M.M. # and Section 1, T28N, R22W,
P. M. . 1 Kalispell, Flathead County, Montana, has petitioned for
approval of the Subdivision Plat of said property, and
WHEREAS, the proposed subdivision plat of said property is
subject to the provisions of Section 2.05 (Preliminary Plat
Process -Minor Subdivision) , Subdivision Reg lations of the City of
Kalispell, and
WHE EAS , the Flathead Regional Development Office has reviewed
the proposed subdivision and mane a report PP- -1 to the City
Council of the City of Kalispell, said report considering the
criteria set forth in Section 7- - , MCA, and
WHEREAS , the City Council of the City of Kalispell has
reviewed the report of the Flathead Regional Development office and
has found from the preliminary plat, and evidence, that the
subdivision meets the requirements of the Title 76, Chapter 3,
Montana Code Annotated, and
wHE EAS, the City Council has based its findings upon the
following findings of fact: r
A. EFFECTS ON PUBLIC HEALTH AND SAFETY
: Fire access to the area will be by way of a paved
road system which has been reviewed, approved and built
to City of Kalispell design standards. Access to the site
will be from Commons Way or Commons Loop from a private
driveway. Fire access to the site is good.

present which might be associated with the topography of
the site.
Primary access to the site will be from commons
Way and Commons Loop, paved roads which have been built
to city standards and will be dedicated to the City as
part of the plat process. Access is good to the parcel.
B. EFFECTS ON WILDLIFE AND WILDLIFE HABITAT
The site is not mapped within any big gate winter range
and does not provide significant habitat to wildlife.
This property is within an area of Kalispell that can be
considered to be on the urban fringes. No significant
impacts to wildlife or wildlife habitat can be
anticipated as a result of this subdivision.
C. EFFECTS ON NATURAL ENVIRONMENT
There is no surface water in the area which might be
effected by this development. There is no obvious high
groundwater in the area which may be effected or which
might be impacted by this deve 1 opment . The terrain can
be described as gently rolling hills. All drainage will
be retainedon-site.Re-vegetation of the disturbed
areas should be dome -within a reasonable time after
development to deter erosion and other drainage problems.
This re -vegetation is anticipated.
D. EFFECTS ON LOCAL SERVICES
Sewer and Water: City of Kalispell water and sewer have
been extended to serve the subdivision. There is
sufficient capacity within the Kalispell sewer treatment
plant and within the water system to accundate this
development. The impacts to these services were assessed
and anticipated with the review and approval of the
planned -unit development in 1995.
Roa• An entire road system is part of the Buffalo
Commons BLS] and will be dedicated to the city. There
will be an internal loop road system within the
subdivision which has been constructed. Commons Way will

has been flashing, but not activated. With the
dedication of these roadways to the City, the signal at
the intersection of Commons Way and Highway 93 will be
activated at the same time that Meridian Road will become
one-way East.
Schools : This subdivision is within the boundaries of
School District #. Children from this subdivision would
attend Edgerton School, Linderman School and Flathead
High School. It can be anticipated that this subdivision
will not impact the school district because it i
commercial in nature.
Par • This subdivision is not subject to parkland
dedication because it is commercial in nature. There is
some common area indicated on the plat which contains
approximately 1.132 acres which will be used as a
detention area for storm water run-off and green space.
Landscaping within the subdivision will be accomplished
according to the terms of the development agreement with
the City of Kalispell.
Police Prnter-tion.• This development will be served b
the Kalispell Police Department. According to the
Kalispell Police Department, they will be able to
adequately serge this area.
This development will be served b
the Kalispell Fire Department. The location and
placement of fire hydrants will be according to the
specifications of the City of Kalispell. Fire flows In
the area will be adequate to accommodate the hydrant
network within the development and subdivision.
Disposal:Refuse
The subdivision will be served by the
City of Kalispell for solid waste disposal. Adequate
space at the Counter landfill is available for the solid
waste which will be generated by the subdivision.
I dical Services: Flathead Regional Hospital is
approximately one mile from the site. Ambulance services
are available to sere this subdivision and access is

E . EFFECT'S ON AGRICULTURE AND AGRICULTURAL WATERUSER
FACILITIES
The soils in this area have limited agricultural value.
This property has been idle grasslands. This subdivision
will have an insignificant impact on agriculture in the
Valley and is more valuable for residential development
because of its close proximity to Kalispell and
associated services and the lack of obvious development
constraints.
F . COMPLIANCE WITH MASTER PlJkN
The Kalispell City -County Master Plan leap designates this
area as Medical/Professional. Buffalo Commons PUD has
been approved with the overall goals and object Ives of
the master plan and has been found to further those
goals. Phase I of the Buf f alo Commons P D under review
is found to be in substantial compliance with the master_
plan.
G . COMPLIANCE WITH ZONING REGULATIONS
The zoning for this property is a planned unit
development, , Buffalo Commons. The lots created with this
subdivision meet the minimum lot specifications of the
approved plan.
H. COMPLIANCE WITH THE SUBDIVISION REGULATIONS
The preliminary plat appears to be in substantial
compliance with the State and City ub i ision
Regulations. ' -
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
LI PELL, MONTANA AS FOLLOWS
RIWTION I. That the application of Northwest Healthcare
Corporation for approval of the Buffalo C mmons , Phase 3,
Bloch 1, Section 6, T28 , R- 1W, P.M.M. , and Section 1, T28N,
R22W, P .1 . . , Kalispell, Flathead Counter, Montana is hereby
approved subject to the following conditions

. That the public roadways within the subdivision shall be
constructed in accordance with the adopted Standards for
Design and Construction which includes the pavement,,
curbs, gutters, sidewalks and drainage system. A letter
from the Kalispell Public Works Department shall be
required stating that the improvements have been
installed according to the required specifications at the
time of final plat approval.
. A storm water drainage plan which incorporates on -site
detention methods be reviewed and approved by the
Kalispell Public Works Department.
. That all water and sewer service plans and specifications
shall be reviewed and approved by the Department of
Environmental Quality and the Kalispell Public Works
Department.

Kalispell Zoning ordinance shall not be changed her the action •

KALE I FELL o MONTANAr AS SET FORTH IN THE 1997-98 BUDGET ADOPTED B
THE O I T OUNC I L FOR THE C HO HOTS I NG NEIGHBORHOOD RSV I TAL I AT I ON
GRANT.
WHE R i S , the annual appropriation for the CDBG Housing
Neighborhood Revitalization Grant is a federal grant
received subsequent to the adoption of the Fiscal 1 7-9
budget, in accordance with M.C.A. - -427I, and
WHEREAS, t he s ourc e o f f unds i s f e de ra l money pa s s ed t hrough t he
Department of Housing and Urban Development in the amount
f $400,000.00, and
WHEREAS, the Punning, Economic and Community Development
Department is a recipient of the CDBG Housing
Neighborhood Revitalization Grant on behalf of Samaritan
House, and
WHEREAS, said Grant is revenue accruing to the City not
appropriated pursuant to Section 7 - -42 71, and
constitutes an overall increase in appropriation
authority, and
HFRRAS , the appropriate fund would be a Special Revenue fund,
2940, with the appropriate expenditure lime item for
construction of a -bed shelter,
NOW, 1 HE F E , BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS
SECT That the annual appropriation for Special
Revenue Fund, 1940, as a result of the CDBG
Housing & Neighborhood Revitalization Grant
Award on behalf of Samaritan House, is hereby
increased by the sun of $400,000.00.
