SUBJECT Final Plat for Kalispell Regional Medical Center -
Buffalo Commons Phase V
MEETING DATE: October 1, 2001
BACKGROUND: This is a request for final plat approval of Kalispell Regional Medical
Center, a two lot subdivision for the hospital which is located in part of the Buffalo
Commons Phase V subdivision. This final plat creates two lots within the hospital
campus and reflects the recently constructed Sunnyview Lane and Heritage Way as well
as the abandonment of the former Sunnyview Lane. The final plat creates two lots with
Lot 1 containing 2.043 acres which would be used for the new surgical outpatient clinic.
Lot 2 contains 6.987 acres and defines the footprint of the existing hospital building. A
note has been placed on the face of the plat addressing potential building code issues.
The area around these lots is common area that would be commonly owned and
maintained and used for parking, access and landscaping.
The preliminary plat for Buffalo Commons Phases 3, 4 and 5 was approved by the
Kalispell City Council on November 15, 1999 subject to conditions. Since the approval of
the preliminary plat for these phases, the relocation of Sunnyview Lane and the creation
of a special improvement district (SID) have occurred which resulted in some changes to
the overall subdivision design. Sunnyview Lane has been abandoned and relocated to
the north and the SID covers the construction of Sunnyview Lane and Heritage Way to
the north. A proposed cul-de-sac has been eliminated and the location of Heritage Way
has not changed.
The final plat for Kalispell Regional Medical Center includes a portion of Phase V that
was approved as part of Buffalo Commons, specifically proposed lots 5, 6 and 7. This
has resulted in the modification of the subdivision and ultimately the final plat. It may
be noteworthy that the hospital is also subject to the terms and conditions of a
conditional use permit that also address the location of the new Sunnyview Lane,
landscaping, parking and access. The conditions of the conditional use permit are being
addressed as a separate matter in association with the issuance of the building permit
for the outpatient clinic to be located on Lot 1.

Dear Chris:
Our office has received an application from Northwest Healthcare Corp. for final plat
approval of Buffalo Commons Lot 2, Block 2, Phase 3 which will plat a one lot
subdivision. The lot is located on the north side of Commons Way and east of Hwy. 93
and contains 0.925 of an acre. It combines Lots 5 and 6, Phase 3 as indicated on the
preliminary plat approved by the Kalispell City Council. The lot is in the
Retail/Commercial/ Office pod of the Buffalo Commons Planned Unit Development with
the rear of the lot facing Hwy 93. Previous phases of the subdivision have dedicated the
roads and utilities within the subdivision to the City of Kalispell and they were accepted.
Preliminary plat approval was granted by the Kalispell City Council on November 15,
1999 subject to ten conditions. Several of these conditions relate to the development of
Phase V, to the south of this lot, and would not be applicable to this subdivision. The
following is a list of the conditions of preliminary plat approval for this subdivision and a
discussion of how they have been met or otherwise addressed.
COMPLIANCE WITH CONDITIONS OF APPROVAL
Condition No. 1 That the development of the site will be in substantial conformance
with the approved preliminary plat which shall govern the general location of the lots,
easements and roadways.]
This condition has been adequately addressed. The plat reflects the realignment of
Sunnyview Lane and results in the loss of cul-de-sac initially proposed on the
preliminary plat. The final plat is in substantial compliance with the preliminary plat.
Condition No. 2 That the roadways within the subdivision shall be constructed in
accordance with the City of Kalispell's Standards for Design and Construction which
includes the pavement, curbs, gutters, sidewalks and drainage system. A letter from the
Kalispell Public Works Department shall be required stating that the improvements have
been installed according to the required specifications at the time of final plat approval.

This condition has been adequately addressed. With regard to Phase V, the
construction of Sunnyview Lane and Heritage Way have been included in a special
improvement district (SID) and are nearing completion. Certification from Philip
Porrini with Robert Peccia and Associates for Sunnyview Lane and Heritage Way
dated 9/22/01 has been included with the final plat application. The improvements
are guaranteed under the SID.
Condition No. 3 That sidewalks shall be constructed on the north side of the
Sunnyview Lane next to the property boundary along with a minimum five foot boulevard
space between the sidewalk and roadway.
• This condition has been adequately addressed. Sunnyview Lane is part of an SID
with the reconstruction of the roadway nearing completion. The roadway has been
designed and constructed in accordance with City standards and includes sidewalks
and boulevards. These improvements are guaranteed under the SID.
Condition No. 4 Installation of curb and gutter on the north side of Sunnyview Lane
for Phase V, or posting a bond for said curb and gutter, or waiving the right to protest a
special improvements district for the same shall be required in conjunction with the final
plat of Phase V.
This condition has been met. An SID for the reconstruction of Sunnyview Lane
included the required improvements.
Condition No. 5 That approach permits for the required road construction at Heritage
Way and Sunnyview Lane be obtained from the Kalispell Public Works Department.
• This condition has been adequately addressed. Because the City of Kalispell is
responsible for approving the reconstruction of Sunnyview Lane and Heritage Way,
the location of the driveways were approved as part of the design review process.
Condition No. b That all water and sewer service plans and specifications shall be
reviewed and approved by the Department of Environmental Quality and the Kalispell
Public Works Department.
• This condition has been met. Attached with the final plat application are letters from
the Montana Department of Environmental Quality and the City of Kalispell Public
Works Department approving the plans and specifications for this project.
Condition No. 7 That a letter from the Kalispell fire chief approving the location and
placement of the fire hydrants within the subdivision shall be submitted with the final
plat.
• This condition has been adequately addressed. The number and location of hydrants
for this area of the development was addressed as part of the review and approval of
the SID for Sunnyview and Heritage Way.

Condition No. 8 That areas be landscaped according to the specifications outlined in
the development agreement with the City of Kalispell. All utilities shall be installed
underground.
• This condition has been adequately addressed. All of the landscaping for Phases 1
through 4 has been put in place and maintained. Most of the landscaping is in place
for the hospital complex. The remaining landscaping around the surgical center will
be addressed as part of the conditional use permit for the hospital expansion and the
issuance of a building permit for the surgical center. All of the new utilities have been
placed underground.
Condition No. 9 A storm water drainage plan which incorporates the drainage
easements indicated on the preliminary plat shall be reviewed and approved by the City
of Kalispell prior to the filing of Phase V.
• This condition has been met. A stormwater management plan was developed as part
of the SID for Sunnyview Lane and Heritage Way. Robert Peccia & Associates have
certified that the plan ha been incorporated into the design of this project.
Condition No. 10. The parking lot on the north side of Sunnyview Lane and the
proposed temporary expansion of the parking lot must be brought into full conformance
with the Kalispell Zoning Ordinance with the infrastructure for Buffalo Commons is
developed prior to filing Phase V.
This condition has been met. The parking lot referenced in this condition has been
replaced by new parking areas located north of Sunnyview Lane and with the
expansion of new parking areas south of the Brendan House. An overall parking plan
for the hospital campus will also be addressed through the conditional use permit
and with the issuance of the building permit for the surgical center. A general
parking plan has been submitted which complies with the Kalispell Zoning
Ordinance.
COMPLIANCE WITH APPROVED PRELIMINARY PLAT
The final plat is in substantial compliance with the preliminary plat which was reviewed
and approved by the city council on November 15, 1999.
COMPLIANCE WITH THE SUBDIVISION REGULATIONS:
This subdivision plat has been found to be in compliance with the State and City
Subdivision Regulations.
COMPLIANCE WITH THE ZONING REGULATIONS
This subdivision can be found to be in compliance with the Kalispell Zoning Ordinance
and the Planned Unit Development which governs the dimensional requirements of the
lots within the subdivision and well as the uses within the various development pods.

RECOMMENDATION:
All of the conditions of preliminary plat approval have been met or otherwise adequately
addressed The staff would recommend that the Kalispell City Council approve the final
plat for this two lot subdivision. Please schedule this matter for the regular city council
meeting of October 1, 2001.

Dear Narda:
Attached are the application materials forthe above -referenced final plat. Please note that
the final plat has one parent lot and two sublots. Lot 1 represents the footprint area of the
proposed surgical center. Lot 2 represents the footprint area of the expanded hospital.
Common area surrounds the two sublots, which is available for utilities, access, parking,
landscaping, and othershared amenities. Lot 1 is within Phase 5 of Buffalo Commons and -
Lot 2 is an existing lot associated with the existing hospital property.
Most of the improvements are either completed or guaranteed for completion via a city
S.I.D. The extension of Heritage Way and the realignment of Sunnyview are all city
projects, including not only the roads but also the sidewalks, boulevards, trees, water,
sewer, and drainage. The old alignment of Sunnyview has been abandoned by the City
and NWHC has deeded the new alignment of Heritage Way and Sunnyview to the City.

However, Heritage Way is extended to Sunnyview Lane as originally proposed. The

continuous years. Boulevard landscaping is completed with development of the
adjacent lots. The boulevard trees associated with the new street system in Phase 5
are guaranteed by the city S.I.D. Timing ofplanting will be coordinated with the city
Parks Director. Landscaping of sublot 1 is subject to approval under a conditional
use permit. All utilities are underground.
9. A storm water drainage plan which incorporates the drainage easements indicated on
the preliminary plat.........
An engineered storm water drainage system has been completed for phases 1-5. The
drainage system for phase 5 is also complete. Related easements will be indicated
in future platting of Phase 5.

The parking lot has been replaced by new parking areas located north of Sunnyview
and by expansion of existing parking areas near Brendon House and the ALERT

Plat must be signed by all owners of record, the surveyor and examining land surveyor.
Attach a letterwhich lists each condition of preliminary plat approval and individually state
how each condition has specifically been met. In cases where documentation is required,
such as an engineer's certification, State Department of Health certification, etc., original
shall be submitted. Blanket statements stating, for example, "all improvements are in
place" are not acceptable.
A complete final application must be submitted no less than 30 days prior to expiration
date of preliminary plat.
When all final plat materials are submitted to the TCPO and the staff finds the application
is complete, the staff will submit a report to the governing body. The governing body must
act within 30 days of receipt of the final plat application and staff report. Incomplete
submittals will not be accepted and will not be forwarded to the governing body for
approval. Changes to the approved preliminary plat may necessitate reconsideration by
the Planning Board.

In accordance with Resolution 4520 (a resolution approving the Preliminary Plat of
Buffalo Commons Phase III, IV, & V, Flathead County):
Section II:
2. See attached certification of roadways within the subdivision being constructed in
accordance with City of Kalispell standards.
5. Road construction for the extension of Heritage Way and the relocation of
Sunnyview Lane have been reviewed and approved by the Kalispell Public Works
Department. Individual approach permits will be submitted to serve each development
along these roads.
6. ' See attached letters from the Montana Department of Environmental Quality and
the City of Kalispell approving the water and sewer extensions for this development.
7. The positioning of the existing and proposed Fire Hydrants for this area were
addressed in the Kalispell Regional Medical Center Master Plan - Site Development
Issues, April 10, 2000. An attached drawing shows each fire hydrant and a 350 ft radius
circle. The entire development area is covered by one or more hydrants.
S. A landscaping plan is being prepared by Bruce Boody, ASLA for the areas
surrounding the proposed Kalispell Surgical and Diagnostic Center (former known as
LLC),
9. A storm water drainage plan has been reviewed and approved by the City of
Kalispell. The attached plan is being incorporated into the construction of SID#343
10. ' A parking plan has been prepared. The attached drawing indicates the existing
(490 spaces, including the unmarked 100 spaces in the temporary lot northwest of
Sunnyview Lane) and proposed parking spaces. The total future parking (746 spaces)
exceeds the number proposed in the Master Plan (652 spaces) and greatly exceeds the
minimum parking required (376 spaces).

Dear Phil:
Plans and specifications and Certified Check Lists submitted on April 12, 2001 with respect to the above
referenced project have been reviewed in accordance with Department design standard DEQ-1 and DEQ-
2, 1999 edition. At this time the plans submitted on have been found to meet the requirements of the
design standards.
This project, consisting of approximately 2500 feet of 12-inch water main and 2600 feet of 8-inch
sewer main extensions is, located in Flathead County, Montana. Project plans, specifications and
certified checklists were submitted by Philip P. Porrini, P.E.# 4371E. Approval is given with the
understanding that any deviation from the approved plans and specifications will be submitted to the
Department for reappraisal and approval. Within 90 days after the project has been completed the
project designer shall certify in writing to the Department that the project was installed in accordance
with the plans and specifications approved by the Department. As -built record drawings shall also be
submitted at this time.
The review of this application was performed to ensure that the design meets Department of
Environmental Quality minimum design standards. The department does not warrant the design,
performance or structural integrity of the project by issuance of this approval statement. This approval is
given with the understanding that the improvements will be constructed and operated in a manner
consistent with the approved plans, specifications, and department regulations. Failure to construct or
operate the system accordingly may be considered a violation of the conditions of this approval.
Plans and specifications must be resubmitted for review and re -approval if construction is not
completed within three years of the date of this letter. Thank you for your efforts to meet our

SUBJECT: Buffalo Commons PUD/KRMC addition
MEETING DATE: October 1, 2001
BACKGROUND: Kalispell Regional Medical Center has been moving forward on a series of
additions to the existing hospital building. One of the most recent building permit applications
includes a surgical center to be located between the old Sunnyview Lane and the new street
location. The surgical center was part of the master plan CUP approved by the council in June
2000.
Subsequent to the CUP approval, KRMC requested a zoning ordinance amendment to the
height limit in the H-1 (Health Care) zone, with a particular focus on the new patient tower. The
request was approved and allowed hospitals to be constructed to a height of 60 feet in the H-1.
The surgical center, however, is not located in the H-1; It is located in the Buffalo Commons
PUD and has a height limit of 35 feet. The proposed structure would be approximately 45 feet
tall.
KRMC initiated a request to modify the language contained in the PUD agreement/
covenants for the medical/professional facilities pod. The proposal would allow 60 feet for
hospital structures, including outpatient surgical centers. The Site Development Review
Committee discussed the proposal and deemed it to be a major change. As a major change, the
proposal is then submitted to the Council. No objections to the proposal were raised by Site
Review, and it was noted that the change substantially mirrors the height standard in the adjacent
H-1 zone.
In addition to written approval by the City, the covenants also require approval by 75% of
the landowners in the pod. According to KRMC, they own land in excess of the necessary 75%.
RECOMMENDATION: The Council move to approve the "Second Amendment to
Declaration of Covenants, Conditions and Restrictions Buffalo Commons (Medical/Professional
Facilities)."
FISCAL EFFECTS: Minimal
ALTERNATIVES: As suggested by the Council.

ORDINANCE NO. 1401
AN ORDINANCE AMENDING ORDINANCE NO. 1226 (PLANNED UNIT DEVELOPMENT,
BUFFALO COMMONS) BY AMENDING THE HEIGHT LIMIT FOR THE
MEDICAL/PROFESSIONAL FACILITIES POD, AND DECLARING AN EFFECTIVE
DATE.
WHEREAS, the Declarations of Covenants, Conditions, and
Restrictions, Buffalo Commons, (A), (B), (C),(D) and (E),
Section I, Ordinance No. 1226, (Records of Flathead
County, Doc. No. 9527615080) were initially filed on
January 26, 1998; and
WHEREAS, the Declarations of Covenants, Conditions, and
Restrictions, Buffalo Commons, were modified on September
29, 2001, by the First Amendment to Declaration of
Covenants, Conditions and Restrictions (No. 2000-273-
11080, Records of Flathead County); and
WHEREAS, Article IX, entitled Amendment, reads:
"This Declaration may be amended by an instrument signed
by the owners of seventy-five percent (75%) of the
land..."; and
WHEREAS, Northwest Healthcare Corporation owns at least 75% of the
land of Buffalo Commons, Medical/Professional Facilities,
and desire to amend the Covenants.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, AS FOLLOWS:
SECTION I. That the Declarations of Covenants,
Conditions, and Restrictions, Buffalo Commons,
Article VI, Section 2, Building Size, is
hereby amended by deleting it in its entirety
and replacing it as follows:
Section 2. Building Size. Each building or
other structure shall be constructed, erected
and maintained in strict accordance with the
approved plans and specifications. Maximum
building height shall be 35 feet, provided
that any hospital building height or structure

may have a maximum building height not to
exceed 60 feet.
SECTION II. All other parts and portions of Ordinance No.
1226, not amended hereby, shall remain the
same.
SECTION III. This Ordinance shall take effect from and
after 30- days of its passage by the City
Council.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL,

As per our discussion this day, I would like Site Plan Review to consider a request to amend the
"Medical/Professional Facilities" covenants of Buffalo Commons as follows.
Amend Article VI, Section 2, second sentence to read: "Maximum building height shall be 35
feet except a height not exceeding 60 feet shall be permitted for hospital structures, including
outpatient surgical centers."
This request is consistent with the 60-foot height allowance for hospitals in the H-1 district. If you view
this as a major change, i would appreciate your earliest consideration of this request by the City
Council.

Conditions and Restrictions (hereinafter referred to as "Covenants") was recorded
as Document No. 1998-055-12230, records of Flathead County, Montana,
establishing certain restrictions on the use of and for the benefit of the subdivision
development known as Buffalo Commons located as Parcel 4 of Certificate of
Survey No. 12409, and Parcel 4 of Certificate of Survey No. 13186, as recorded
among the land records of Flathead County, Montana; and,
WHEREAS, on the 291h day of September, 2000, a First Amendment to
Declaration of Covenants, Conditions and Restrictions was recorded as Document
No. 2000-273-11080, records of Flathead County, Montana, amending said
Declaration of Covenants, Conditions and Restrictions as more particularly set forth
in said First Amendment, and,
WHEREAS, Article IX, entitled Amendment, reads:
"This Declaration may be amended by an instrument signed by
