3. Draft 911 Interlocal AgreementI= - Post Office Box 1997 - Kalispell, Montana 59903 Telephone: (406) 758-7701 Fax: (406) 758-7758 February 11, 2009 TO: Mayor and City Council FRM: Interim City Manager RE: Draft 911 Interlocal Agreement Attached is a draft interlocal agreement that will establish policy for the new 911 center to be constructed this year. The parties to the agreement are the county and three cities. Basically the agreement establishes a governing board, an advisory committee and general policies on finance, staff, and property. Mayor Kennedy, CM Larson and I have been attending meetings discussing this draft. The new 911 building is anticipated to be complete by the end of this year and operational by the start of FY2011 (1 July 2010). Estimated operational costs financed by the agreement participants, $1.5 million/year. During the last meeting the following issues were discussed: There is disagreement on the makeup of the governing board. Some feel the board should be balanced 3-3 between the cities and county. Others feel a seventh member is necessary to prevent deadlock. How this seventh member should be chosen and maintain a city/county balance is difficult. Some suggestions were: have the initial 6 select a seventh member from the general public, have the chair of the advisory committee sit on the governing board, rotate a seventh member between a person chosen by the county and someone from the cities. ® There was some discussion on what population base should be used to determine the financial contribution of each participant. The agreement refers to a MCA but this MCA does not provide specific population numbers. Other alternatives were to use census base numbers i.e. 2000, 2010 or the census estimates that are provided each year. The BOARD and the County will share all maintenance costs for the building, including major maintenance items such as roof and furnace/boiler replacement, in the proportion of square footage allotted to staff carrying out dispatch functions and to staff carrying out the County's responsibilities for the Office of Emergency Services and the Flathead County E Fire Service Area. The withdrawal of a party from this agreement, pursuant to Paragraph IX, shall not result in any change of ownership of any property owned by the BOARD; any party, by withdrawing, shall waive any claim it might have to property owned by the BOARD. TERM AND WITHDRAWAL OF A PARTY 7 After approval and appropriate filing, this agreement shall become effective and shall endure until terminated by law or by mutual agreement of the parties. A party may withdraw from this agreement only upon lawful resolution of the governing body of that party and service of written notice thereof on the remaining party or parties hereto at least 180 days prior to the first day of July of any year.
