Patrick, City Manager SUBJECT Glacier High School - Request for Preliminary Plat Approval - southeast Corner of West Reserve and Stillwater Road MEETING DATE: September 6, 2005 BACKGROUND: School District #5 is requesting preliminary plat approval for a one lot subdivision containing 60 acres of land located on the southeast corner of West Reserve and Stillwater Road. The school district is purchasing an easement from the State Department of Natural Resources for the purposes of constructing a second high school. The high school was approved by the residents of Flathead County in the November 2004 election and work has been moving forward ever since. The site will be accessed primarily from Stillwater Road via a new road internal to the property along the south boundary. A secondary access will be from West Reserve Drive with a right in right out turn lane only. Construction on the high school has started this summer. The Section 36 Neighborhood Plan and the Memorandum of Understanding between DNRC and the City of Kalispell does require that all long tern, easements such as proposed here be subject to the city subdivision review process. The Kalispell Planning Board held a public hearing on. August 9, 2005 regarding the proposal. The staff recommended approval subject to 12 conditions in the staff report. At the public hearing, representatives of School District #5 spoke in favor of the request noting that they found all staff conditions acceptable except for Condition #4 which obligated them to construct the south boundary road. They acknowledged that city and school staff had met earlier that week to develop some more workable language and applauded the staff efforts. They were still weighing the impacts of the modified language. A representative from DNRC also spoke supporting the need to develop the southerly access road as DNRC did not have the capitol funds to construct infrastructure, it was being left to those who develop along the road. There was no one else who spoke at the public hearing. After the public hearing the board discussed the project and incorporated the staff modifications for Condition #4. A motion was made and passed on a unanimous vote to recommend to the Kalispell City Council that the preliminary plat be approved subject to conditions found in Exhibit A attached to the transmittal letter. RECOMMENDATION: A motion to approve the preliminary plat would be in order. FISCAL EFFECTS: Minor positive impacts once fully developed. ALTERNATIVES: As suggested by the city council. WHEREAS, Kalispell School District No. 5 and the DNRC, the owners of the certain real property described above, have petitioned for approval of the Subdivision Plat of said property, and WHEREAS, the Kalispell City Planning Board and Zoning Commission held a public hearing on August 9, 2005, on the proposal and reviewed Subdivision Report #KPP-05-13 issued by the Kalispell Planning Department, and WHEREAS, the Kalispell City Planning Board and Zoning Commission has recommended approval of the Preliminary Plat of Glacier High School, subject to certain conditions and recommendations, and WHEREAS, the City Council of the City of Kalispell at its regular Council Meeting of September 6, 2005, reviewed the Kalispell Planning Department Report ##KPP-05-13, reviewed the recommendations of the Kalispell City Planning Board and Zoning Commission, and found from the Preliminary Plat, and evidence, that the subdivision is in the public interest. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA AS FOLLOWS: SECTION I. That the Findings of Fact contained in Kalispell PlanningDepartment Report #KPP-05-13 are hereby adopted as the Findings of Fact of the City Council. SECTION H. That the application of Kalispell School District No. 5 and the DNRC for approval of the Preliminary Plat of Glacier High School, Kalispell, Flathead County, Montana is hereby approved subject to the following conditions: 1. That the development of the site will be in substantial conformance with the approved preliminary plat which shall govern the general location of the lot, easements and roadways. (Kalispell Sub. Regs. Appendix C — Final Plat I(A) Contents of final plat.) 2. That a letter be obtained from the Kalispell Public Works Department approving the installation of the public infrastructure to the site. Certification from an engineer licensed in the State of Montana shall be submitted with the final plat stating that all of the improvements have been constructed accordingly. As built drawings shall be provided to the public works department prior to final plat submittal. (Kalispell Sub. Regs. Section 3.12 — 3.15). 3. That a traffic analysis be performed that assesses the impacts to all of the transportation systems in the immediate area under multiple jurisdictions with a single study done under the Montana Department of Transportation's Systems Impact Process through the Helena headquarters office. This would be a comprehensive review including but not necessarily limited to system capacity, signal warrants and access issues for West Reserve Drive, Stillwater Read and the Bypass including the new Citystreet along the southern boundaryof the property. Impacts and mitigation shall be clearly identified and the study shall be subj ect to acceptance by both MDOT and Kalispell Public Works Department. 4. The future Citv Street indicated on the accgmpan3Lng site plan along the southern bounda of the property be fully developed as follows: a. The School district shall ac uire a 60 foot wide R/W for the entire length of the proposed southerly street extending from. Stillwater Road on the west to the Section 36 Connector on the east. This R/W shall be dedicated to the City of„Kalispell. b. The School District shall develop the westerly 300 feet of this R/W extending from Stillwater Road easterly. The Road shall be built to city standards with the design and construction approved by the Kalispell Public Works Department, C. The DNRC will be res onsible to ensure that the remainder of the R/W is develo ed as a city street over as development occurs along the R/W but no later than 2 years after the completion of the Section 36 amass connector. 5. The following requirements shall be met per the Kalispell Fire Department: (Kalispell Subdivision Regulations, Section 3.20). a. Water mains designed to provide minimum fire flows shall be installed per City specifications at approved locations. Minimum fire flows shall be in accordance with International Fire Code (2003) Appendix B. b. Fire hydrants shall be provided per City specifications at locations approved by this department, prior to combustible construction. C. Fire Department access shall be provided in accordance with International Fire Code (2003) Chapter 5. d. It should be noted that hazardous weed abatement shall be provided in accordance with City of Kalispell Ordinance 10-8. e. Street naming shall be approved by the fire department. 6. That landscaping of the site be done in accordance with a plan approved by the Kalispell Parks and Recreation Department. 7. All existing and proposed easements shall be indicated on the face of the final plat. Utility easements for City water and sewer shall be provided to allow for the logical extension of utilities from this subdivision to adjoining properties. A letter from the Kalispell Public Works Department shall be obtained stating the easement locations have been reviewed and approved. 8. Street lighting shall be located in accordance with Kalispell's Standards for Design and Construction. 9. Site lighting shall be accomplished through the use of a full -cut off lens and in accordance with the same standards as required under the development agreement between the City of Kalispell and the developers of the Spring Prairie site, to wit not to exceed 30 feet in height with the light fixture that does not shine above a 70 degree horizontal plane. 10. That a minimum of two-thirds of the necessary infrastructure for this subdivision shall be completed prior to final plat submittal. 1.1. All new utilities shall be installed underground. (Kalispell Sub. Regs. Section 3.17A). 12. That preliminary approval shall be valid for a period of three years from the date of approval. (Kalispell Sub. Regs. Section 2.04 (E (7)). SECTION III. Upon proper review and filing of the Final Plat of said subdivision in the office of the Flathead County Clerk and Recorder, said premises shall be a subdivision of the City of Kalispell. Jentz reported that he, representatives from School District #5, and DNRC had met earlier in the week to refine the language and requirements for the new road. GLACIER HIGH SCHOOL KALISPELL PLANNING DEPARTMENT SUEDWISION REPORT ##KPP-05-13 AUGUST 1, 2005 A report to the Kalispell City Planning Board and the Kalispell City Council regarding a request for preliminary plat approval of a one lot subdivision on DNRC's Section 36. A public hearing on this matter has been scheduled before the Kalispell Planning Board for August 9, 2005 beginning at 7:00 PM in the Kalispell City Council Chambers. A recommendation from the Planning Board will be forwarded to the Kalispell City Council for final action. BACKGROUND A. The property is generally described as a portion of Assessor's Tract 5 in Section 36, Township 29 North, Range 22 West, PMM Flathead County, Montana. C. Size: Total area: 60.00 acres Area in Lots: 60.00acres Area in Roads: NA D. Nature of the Request: The school district is purchasing an easement from the State Department of Natural Resources for the purposes of constructing a second high school. The 60 acre site is located on the southeast corner of West Reserve Drive and Stillwater Road. The site will be accessed primarily from Stillwater Road and a new road internal to the property along the south boundary. A secondary access will be from West Reserve Drive with a right in right out turn lane only. Construction on the high school will start this summer. The subdivision and easement agreement with the DNRC creating the parcel has been consummated. E. Existing Land Use: This property is currently undeveloped. F. Adjacent Land Uses: This property is part of the State DNRC's Section 36 property that was the subject of a neighborhood plan, annexation, zoning and subsequent lease and development agreements with lessees. North: Single family residential subdivision, County R-2 and City R-3 zoning South: Undeveloped, R-5 PUD zoning East: Undeveloped, B-5 PUD zoning West: Agricultural, County AG-80 WVO zoning G. Zoning: This property is zoned R-5 / PUD and is part of the Spring Prairie PUD for all of Section 36. The R-5 / PUD area of the property is mixed use residential. The school complies with the zoning for the property. H. Relation to Growth Policy Map: This property lies within the jurisdiction of the Kalispell City Growth Policy and is the subject of the Spring Prairie Neighborhood Plan and associated agreements. I. Utilities: Water: City of Kalispell Sewer: City of Kalispell Electricity: Flathead Electric Cooperative (underground) Telephone: CenturyTel (underground) Solid Waste: City of Kalispell Fire: City of Kalispell Schools: School District #5, Kalispell Police: City of Kalispell REVIEW AND FINDINGS OF FACT This application is reviewed as a major subdivision in accordance with State statutory review criteria and the Kalispell City Subdivision Regulations. Note that while only one additional lot is being created, the parent lot, Section 36, has been the site of the Spring Prairie Subdivision and as such the cumulative number of lots created exceeds the minimum of 5 for minor subdivision review. A. Effects on Health and Safety: Fire: Access to the site will be via Stillwater Road, a road that lies both in the city and the county. An internal parking lot and driving lanes provide primary B. C. access to the school structure itself. A new station currently under construction will be able to increase the fire safety in the north section of Kalispell. The subdivision will be developed in accordance with the Uniform Fire Code and have access which meets City standards. The property does not have steep slopes or woody fuels. Hydrants will be required to be placed in compliance with the requirements of the Uniform Fire Code and approved by the Fire Chief. The fire access and suppression system should be installed and approved by the fire department prior to final plat approval because of potential problems with combustible construction taking place prior to adequate fire access to the site being developed. Flooding: According to the Kalispell FIRM (Flood Insurance Rate Map) Map, this area is not located in the 100 year floodplain nor does it have high ground water that would lead to flooding. Roads: The primary access to this site will be from Stillwater Road, a road that is generally in good condition for the current levels of traffic. A secondary access is proposed on West Reserve Drive with right in and right out only turn lanes. Additionally, a new City street corning from Stillwater Road is indicated along the southern boundary of the parcel but is not being proposed for development, merely the first 295 feet of this new City street is being proposed for initial construction that will provide access to the parking area for the school. The impacts associated with this use will be significant and beyond the ability of the staff to accurately assess. Therefore a recommendation for a full traffic impact analysis that identifies the type and volume of traffic and mitigation measures will be required not only by the City of Kalispell but also by the Montana Department of Transportation. The approach onto West Reserve Drive will need to be reviewed and approved by the Montana Department of Transportation while the approach onto Stillwater Road will need to be reviewed and approved by the Kalispell Public Works Department. The MDOT will require the proposed access be evaluated through the MDOT systems impact process and mitigation measures identified. Effects on Wildlife and Wildlife Habitat: The site is not mapped within any big game winter range and does not provide significant habitat to wildlife and does not host any significant or endangered wildlife. Effects on the Natural Environment: There are no significant environmental factors that would pose an impact on the natural environment of the area. D. Effects on Local Services: Sewer and Water: City of Kalispell water and sewer are being extended to the site as part of the development. Adequate capacities exist to serve proposed development. Stormwater management: Stormwater management will be accomplished with on, site retention of stormwater run off. This engineered drainage plan will need to be developed as part of the engineering for the site. Roads: Stillwater Road will provide primary access to the site. A new City street is identified but not proposed for development along the south boundary of the parcel. Only 295 feet of roadway is proposed for development and is not indicated on the preliminary plat but rather on the site plan. This will create a new intersection with Stillwater Road, a County road developed as a rural, two lane road. It does not appear that the proposed road is adequate to service the level of traffic that can be anticipated from a high school. The staff is recommending that the roadway indicated along the southern boundary of the property be developed in full to City standards with the potential for the district to eater into a development agreement with the City of Kalispell to recoup costs through a latecomers agreement as new development happens to the south and will need this road for access. It is the understanding of the staff that a full traffic analysis is being conducted by Stelling Engineers that will identify impacts and mitigation. This will be reviewed by both the Montana Department of Transportation and the Kalispell Public Works Department. Schools: This subdivisionn, is within the boundaries of School District #S. Because of its nature it will accommodate high school children. Parks: This subdivision is not subject to the parkland dedication requirements because of its institutional nature as provided for in the Kalispell Subdivision Regulations and as under State Statute. Police Protection.: This development will be served by the Kalispell Police Department. According to the Kalispell Police Department, they will be able to adequately serve this area. FireProtection: This development will be served by the Kalispell Fire Department. The location and placement of fire hydrants needs to be addressed. Fire flows in the area are adequate to accommodate any necessary hydrants. RefuseDisposal: The subdivision will be served by the a private hauler of the City of Kalispell for solid waste disposal. Adequate space at the County landfill is available for the solid waste which will be generated by the subdivision. Medical Services: Kalispell Regional Medical Center is approximately two miles from the site. Ambulance services are available to serve this subdivision and access is good. E. Effects on Agriculture and Agricultural Water Users Facilities: This property is undergoing a conversion from agricultural to urban scale and density development. Because of its proximity to services and other commercial development, the proposed use is appropriate. The conversion of this property from agricultural to a public facility will not have a significant affect on agriculture or agricultural water users facilities. F. Compliance with the Growth Policy This property is included in the Spring Prairie Neighborhood Plan which is part of the Kalispell City Growth Policy. A wide range of uses is anticipated in this area and the high school complies with the neighborhood plan and the growth policy for the area. G. Compliance with Zoning Regulations This zoning for this property is R-5 / PLED a Mixed Residential district. The school district is asking for two amendments to the planned unit development and hence the zoning for the site. One is an increase in the height 35 feet to 55 feet. Additionally the district is requesting a variance to the required parking from 1,919 spaces to 1,140 spaces that will be handled as a separate request that will come before the Kalispell City Council for consideration concurrent with the preliminary plat. H. Compliance with the Subdivision Regulations The preliminary plat is in compliance with the State and City Subdivision Regulations. RECOMMENDATION Staff recommends that the Kalispell City Planning Board adopt staff report #KPP-45- 13 as findings of fact and recommend to the Kalispell City Council that the preliminary plat be approved subject to the following conditions: That the development of the site will be in substantial conformance with the approved preliminary plat which shall govern the general location of the lot, easements and roadways. The school will have a gym designed to accommodate bleachers for 3500 spectators at some point in time but will only be outfitted with bleachers to accommodate around 2000 spectators for the first few years. The auditorium will have seating for 550 spectators and the Black Box Theater area will have a nominal seating requirement (60-100 seats plus or minus). We have subsequently lowered the number of bleachers, due to budgetary requirements, that we will buy in the early years to just 2000 vs. 2600 we had initially hoped we could afford with the hope to grow to a 3500 seating capability in the out years. Our view of the use of the new high school in the early years based on the low likelihood of big events occurring during full school day occupancy periods and considering our ability to control and coordinate event timing for the first 5-7 years would drive us to calculate a need for parking at 620 (* student and staff/visitors and no event). There certainly are events that could drive a much higher spectator number such as once we reach a full gym bleacher capacity of 3500 that would drive a non -school day requirement for parking of 350015= 700 parking spaces for tournament level basketball games or gradation which are low frequency events that will occur for less than 5% of the year, perhaps even less than that. There also could be some less than 100% seating requirement type events in the gym or auditorium during a school. If we assumed a school day event and a 50% full gym event that would give us a requirement of 820 parking spaces **. Note we currently mitigate parking concerns for these type events at Flathead High School by seeking alternative parking locations to assemble people and then bus at our expense to the event location. We also have two dedicated school resource officers that advise us and coordinate special traffic issues as needed with city law enforcement staff. DISCUSSION It is our view that designing for the future is best but budgets often do not allow building all the needs for the future at one time, so phased approaches are omen a reasonable compromise. In our case we are designing the new high school infrastructure to accommodate larger student bodies and larger event populations but we do not see in the near term (5-7 years) reaching the larger numbers in either area. Thus our view is to allow room to grew and this includes the size of the parking area also. We have 60 acres of land and all will not be developed for the foreseeable future. Thus we have designed a balanced facility with flexibility to grow in time. To this end and specifically relating to the number of parking spaces we feel that our calculation of 820 spaces will more than satisfy the spirit and intent of the planning documents and meet the needs of the students and taxpayers that will patronize the new high school after hours for the majority of the calendar year. We feel that as the managers of this public institution we currently schedule events in a prudent manner and will continue to do so in the future in order to maximize satisfaction by parties involved and minimize disruption to the community to the maximum extent possible. We do not want to see anyone hurt or greatly inconvenienced as we too are members of this community. RECOMMENDATION Therefore we offer the following parking management plan for consideration: 1) Build for the start of school year 2007-2008, 820 paved parking spaces including the appropriate spaces for ADA issues, parent drop off areas, bus drop of areas and paved access 360 degrees around the main school for easy access by all emergency vehicles. 2) Build the parking areas in accordance with PUD requirements (paving, curb, lighting, landscaping, etc.) 3) Allow room for parking expansion based on future expansion of the facilities. K 4) Implement an inter -local Parking Management Program between School District #5 and the City of Kalispell to monitor, record and report periodically (at SD#5 cost) the average and peak parking uses at this new high school. 5) Implement controlled parking areas with a pass, permit or some other measure to ensure that the available parking spaces are being utilized appropriately. 6) Implement a parking enforcement system that has appropriate signage to warn vehicle users of consequences and then actively enforce these rules and cite and tow violators. 7) Implement active, visible parking management staff for high parking events to direct traffic, allow vehicles with appropriate passes/permits to park and direct those without proper permits to alternative parking locations. 8) Issue a report at the conclusion of each high traffic event on the lessons learned and take corrective action to prevent reoccurrences of negative parking/traffic concerns (by better communication with parties that will participate in these events). 9) Work with the City to develop a phased trigger process that once the demand begins to exceed (on some higher percentage basis) what is currently in place for parking, that within some reasonable period of time (probably 5 years to allow for accrual of funds for construction) additional paved parking will be added. 10) Hold a periodic meeting of the parties to communicate the status of successful or unsuccessful implementation of these parking management program items for planning of the next step with reports being offered to the Board of Trustees and the City Council by the appropriate official of the other organization (i.e. the SD#5 official will report to the City Council and the City Representative will report to the School Board). 3 1� Ik Ness Aissst rs _ _. < }—Future Future 1 .. NOTICE OF PUBLIC NEARING KALISPELL CITY PLANNING BOARD AND ZONING COMMISSION August 9, 2005 The regular meeting of the Kalispell City Planning Board and Zoning Commission is scheduled for Tuesday, August 9, 2005 beginning at 7:00 PM in the Kalispell City Council Chambers, Kalispell City Hall, 312 First Avenue East, Kalispell. The planning board will hold a public hearing and take public comments on the following agenda items. The Board will make a recommendation to the Kalispell City Council who will take final action. 1. A request by Heritage Investors for a conditional use permit to allow the expansion of Heritage Place, a nursing home located at 171 Heritage Way Kalispell- The applicants propose to expand the existing 114 bed facility by adding an additional 28 beds. The property is zoned H--1, Health Care, which lists nursing homes as a conditionally permitted use. The property is located at the northwest corner of Heritage Way and Windward Way and can be described as Heritage Place Subdivision in a portion of Government Lots 5 and 6 in Section 6, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana. 2. A request by the School District No. 5 for prehminary plat approval of Glacier High School., a one lot subdivision containing approximately 60 acres. This one lot subdivision is intended for development of the new Glacier High School. The property can be described as a portion of Assessor's Tract 5 located in the NW quarter of Section 36, Township 29 North, Range 22 West, P.M.M., Flathead County, Montana. 3. A request by the Seventh Day Adventist Church for a conditional use permit to allow the expansion of a non -conforming use, a community service center, located at 494 Ninth Ave EN. The applicants propose to expand the existing approximately 2,233 square foot center by adding an additional 1,109 square feet. The property is zoned R-3, Urban Single Family Residential, which is intended primarily for residential uses. The community service center operates as a non- conforming use and as such may be expanded up to 50 percent subject to the issuance of a conditional use permit. The property is located on the west side of Ninth Ave DIY, north of Oregon Street and can be described as Lot 1, Block I Northeast Addition in Section 8, Township 28 North, Range 21 West, P.M.M., Flathead County, Montana.
