SUBJECT spring Prairie Center Phase 3 - Request for one-year preliminary
plat extension
MEETING DATE: November 17, 2008
BACKGROUND: This is a request by Goldberg Properties, Inc. for a one-year
extension for Phase 3 of the preliminary plat of spring Prairie Center. The
developer is requesting the extension in order to work with several potential
partners to solidify financing for this final phase. The spring Prairie subdivision is
a three phase commercial subdivision approved on December 1, 2003 by the
Kalispell City Council subject to 20 conditions. spring Pralrle Center is located on
the west side of Highway 93 between Deserve Loop and west Reserve Drive. The
subdivision. includes 29 lots on approXi'nately 54 acres with a zoning designation
of - / P D (Industrial -Commercial/ Planned grit Development).
The Kalispell City Council granted final plat approval. for Phase 1 on October 16,
2006 and for Phase 2 on November 6, 2006. Phase 3 would plat the remaining lots
on the north side of Treeline Road., between Treeline Road and Nest Deserve Drive,
Condition 20 of Spring Prairie Center required. subsequent phases to be filed
within two years of filing the final Plat for the first phase. This would require the
final plat for Phase 3 to be filed by November 6, 2008. A one-year- extension would
give the developer until November 6, 2009 to file the final plat.
RECOMMENDATION: A motion to adopt the resolution and grant a one-year
extension to the preliminary plat approval for Phase 3 of spring Prairie Center
Subdivision would be in order.
FISCAL EFFECTS, Minor positive impacts once fully developed.

RESOLUTION OLUTION APPROVING A ONE YEAR EXTENSION TO THE PRELIMINARY
PEAT OF SPRING PRAIRIE PHASE 3, LOCATED ON THE WEST SIDE OF HIGHWAY
93 BETWEEN RESERVE LOOP AND WEST RESERVE DRIVE.
WHEREAS, the City Council of the City of Kalispell granted final plat approval for Spring Prairie
Center} Phase I on October 16, 2006 and Phase 2 on November 6, 2006, and
WHEREAS, developer Goldberg Properties, Inc. now desires a one-year extension to the
preliminary plat for Phase 3 in order to work with several potential partners to
solidify financing for the final phase, and
WHEREAS, Section 2.06 of the Kalispell Subdivision Regulations and Montana Subdivision and
Platting Act allows the City Council to grant a one-year extension to the preliminary
Plat in addition to the original three year approval; and
WHEREAS, good cause exists for the request for extension by Goldberg Properties Inc. and it is in
the best interests of the City that the extension be given.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
ALI PEL , MONTANE. AS FOLLOWS.
SECTION It That the application of Goldberg Properties, Inc. for a one-year extension of
the prelirrAnary plat of Spring Prairie Phase 3, Kalispell, Flathead County,
Montana is hereby approved.

Dear Mr. Jentz,
We are requesting an extension .in time of 1 year to file for the final plat for Spfing Prairie
Center phase 111. This extension would extend the time frame to November 30, 2009.
The City of Kalispell has in its possession all the required documentation for the final
plat application except for the executed SIA and the bond requirement. we are currently
working with several potential partners to solidify financing for the project. once that is
complete, we will be able to provide the City with the final infonnation necessary to file
for the final plat. we don't antiei.pate any difficulty fulfilling the final requirements.
