Re: Ordinance 1821 — Second Reading - Amending Two Hour Parking in
Certain Areas of Downtown
Meeting Date: March 4, 2019
Background: As a result of a meeting with the Parking Commission, Downtown Business
Association, and a September 2018 Work Session with Council, Public Works will be moving
forward with the installation of diagonal parking in the Spring of 2019 in the following areas:
• 5th Street West (1st Avenue West to Main Street)
• 3rd Street East (2nd Avenue East to 3rd Avenue East)
Along with the recommendation for diagonal parking, removal of the 2-hour parking designation
was also recommended in the following areas:
• 5th Street West (2nd Avenue West to Main Street)
• 3rd Street East (2nd Avenue East to 3rd Avenue East)
• 3rd Street West (2nd Avenue West to Pt Avenue West
• 1st Street West (2nd Avenue West to 1st Avenue West)
City staff met with the Kalispell Parking Commission and adjacent local businesses and there
were no objections to the proposed removal of 2-hour parking in the areas listed above.
The City Council passed the first reading of Ordinance 1821 unanimously on February 19, 2019.
RECOMMENDATION: It is recommended that Council approve the second reading of
Ordinance 1821, an Ordinance amending Chapter 17-90 Overtime Parking Prohibited; Two Hour
Parking on Certain Streets.
FISCAL EFFECTS: There are no anticipated fiscal impact at this time.
ALTERNATIVES: Deny the request.

ORDINANCE NO. 1821
AN ORDINANCE AMENDING ORDINANCE NO. 1801 CODIFIED AT CHAPTER 17 OF
THE KALISPELL MUNICIPAL CODES ENTITLED MOTOR VEHICLES AND
TRAFFIC REGARDING TWO HOUR PARKING ON CERTAIN STREETS IN THE
CITY OF KALISPELL, DECLARING AN EFFECTIVE DATE AND AUTHORIZING
THE CITY ATTORNEY TO CODIFY THE SAME.
WHEREAS, it is in the best interests of the City and its residents and visitors that its ordinances
which regulate the parking of motor vehicles on the public streets within the City
of Kalispell be reassessed and updated from time to time to ensure that the purposes
of the regulation and the interests of the public are being properly served; and
WHEREAS, pursuant to Kalispell Municipal Code Chapter 17, entitled Motor Vehicles and
Traffic, the City of Kalispell regulates the parking of motor vehicles on public
streets for the purpose of ensuring that the public safety and welfare in the public
right-of-ways of the City are not compromised by such use; and
WHEREAS, the Kalispell City Council finds that the amendments to KMC Chapter 17 set forth
in Exhibit "A", attached hereto, are necessary and proper to protect the safety and
welfare of the public using the public right-of-ways in the City of Kalispell.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL AS FOLLOWS:
SECTION 1. The City of Kalispell Municipal Code is hereby amended asset forth
in Exhibit "A", attached hereto and incorporated fully herein by this
reference.
SECTION 2. The City Attorney is hereby authorized and directed to recodify this
Ordinance.
SECTION 3. This Ordinance shall take effect thirty (30) days after its final
passage.
PASSED AND APPROVED BY THE CITY COUNCIL AND SIGNED BY THE MAYOR OF
THE CITY OF KALISPELL THIS 4TH DAY OF MARCH, 2019.

EXHIBIT "A"
17-90 Overtime Parking Prohibited; Two Hour Parking on Certain Streets.
A. Overtime Parking Prohibited: It shall be unlawful and a violation of the provisions of this
article for any person to cause, allow, permit or suffer any vehicle registered in the name of or
operated by such person to be parked overtime or beyond the period of legal parking time
established for any parking meter zone as herein described.
B. Remaining Beyond Prescribed Period: It shall be unlawful and a violation of the provisions
of this article for any person to permit a vehicle to remain or be placed in any parking space
adjacent to any parking meter while such meter is displaying a signal indicating that the vehicle
occupying such parking space has already been parked beyond the period prescribed for such
parking space.
C. Two Hour Parking: It is unlawful and a violation of this article for any person to permit a
vehicle to remain parked continuously in any individual parking space for more than two (2)
hours between 8:00 a.m. and 6:00 p.m. on any day except Sunday or a legal holiday on the
following streets:
1. On Main Street between Center Street and Fifth Street;
2. On First Avenue East between Center Street and Fifth Street East;
3. On Second Avenue East between Second Street East and Third Street East;
4. On First Avenue West between Center Street and Fifth Street West;
5. On Second Street from Second Avenue East to Second Avenue West;
6. On First Street between First Avenue East and Seeend First Avenue West;
7. On Third Street between 444d Second Avenue East and Seeeffd First Avenue West;
8. On Fourth Street between Second Alley East and Second Avenue West;
9. On Fifth Street between Seeeffd "-,,fine Wes Main Street and Second Avenue East;
10. On the west side of Third Avenue East bounding Lions Park.
D. One Hour Parking: It is unlawful and a violation of this article for any person to permit a
vehicle to remain parked continuously in any individual parking space for more than one hour
between 8:00 a.m. and 6:00 p.m. on any day except Saturday or Sunday or a legal holiday on the
following street:
1. The east side of Fourth Avenue East between Ninth Street East and Eighth Street East.
