On July 27, 2015 and October 26, 2015 the City Council, in work sessions, reviewed these recommendations with Impact Fee Committee members, Police and Fire Department staff present. This resolution states the Council's intention to consider the adoption of the recommendations and the report findings as fact and to possibly accept the proposed impact fee schedule for these services. Pursuant to MCA 69-7-111 the City must publish a Notice of Intent and hold a public hearing for the benefit of those affected by the proposed changes, to take evidence at the public hearing and to consider such evidence prior to taking action. RECOMMENDATION: It is recommended that the Council pass Resolution No. 5743 calling for a public hearing to be held December 7, 2015 at its regularly scheduled meeting so that public comment and other evidence may be considered prior to deliberating upon the proposed regulatory amendments. ALTERNATIVES: The Council may decline to consider the proposed amendments or may make amendments to the recommendation as it deems appropriate. RESOLUTION NO. 5743 A RESOLUTION OF INTENT TO AMEND THE IMPACT FEES FOR CITY OF KALISPELL POLICE AND FIRE SERVICES PURSUANT TO MCA 7-6-1601 THROUGH 7-6-1604, SETTING A PUBLIC HEARING AND DIRECTING THE CITY CLERK TO PROVIDE NOTICE THEREFORE. WHEREAS, pursuant to the authority granted by 7-6-1601 to 7-6-1604, MCA to municipalities to charge impact fees to fund capital improvements, and particularly the mandate of Section 7-6-1602(2)(k)(4), MCA that impact fees be reviewed every five years, the City of Kalispell considers it proper and necessary to amend the fees imposed for police and fire services to its inhabitants and other persons served by the City of Kalispell police and fire departments; and WHEREAS, therefore the duly appointed Kalispell Impact Fee Committee met in noticed public meetings, reviewed the staff report and recommendations on the police and fire fees and issued its recommendations for a change to the impact fee schedule based upon adjustments to the capital improvement plan and updated cost analysis; and WHEREAS, it is the intent of the City Council to consider the recommendations of the Kalispell Impact Fee Committee and to possibly adjust the police and fire impact fees imposed on users; and WHEREAS, prior to adjusting the impact fees on the police and fire services, the City has determined to hold a public hearing on the matter after giving due and proper notice of said hearing. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, AS FOLLOWS: SECTION 1. That there is hereby set a Public Hearing on the 7th day of December, 2015, at 7:00 o'clock p.m. in the Council Chambers, City Hall, Kalispell, Montana, to discuss a proposal to adjust the impact fees for police and fire services as recommended by the Kalispell Impact Fee Committee. SECTION 2. The City Clerk is hereby authorized and directed to make, publish and distribute notices of said Public Hearing in conformity with Section 69-7-111, MCA. The City Clerk shall further make the report containing the recommended impact fee schedule, data sources and methodology supporting adoption and calculation of the impact fees to the public upon request. ATTEST: Aimee Brunckhorst, CMC City Clerk Mark Johnson Mayor NOTICE OF PUBLIC HEARING PROPOSED AMENDMENT TO POLICE AND FIRE IMPACT FEES NOTICE IS HEREBY GIVEN that the City Council of the City of Kalispell shall hold a Public Hearing on a proposal to amend impact fees for police and fire services of the City of Kalispell on Monday, December 7, 2015, at 7:00 P.M. in the Council Chambers of City Hall, 201 1 st Avenue East, Kalispell, Montana. It is the intent of the City Council to consider the recommendations of the Kalispell Impact Fee Committee to amend the police and fire impact fees for users creating an additional demand on those facilities. Any person wishing to address the proposed amendment to the police and fire impact fees may appear at this hearing and make oral statements or present same in writing. Written comments may also be submitted for Council consideration by delivering the same to the City Clerk prior to the hearing by mail at P.O. Box 1997, Kalispell, MT 59903, by email to cityclerk(c�r�,kalispell.com or in person at City Hall, 201 First Avenue East.
