The City of Kalispell,
'Montana, will receive
sealed bids for all labor,
equipment and materials
necessary for construction
of Corporate -Way Road &
Utility Improvements (SID
No. 342), to meet or exceed
the minimum specifications
on file in the off"of the Di-
rector of Pubfic Works, City
Hall, Kalispell, Montana.
Bids will be removed by the
Clerk of. the City Council
until 11:00 a.m- .on Ithe 25th
day of September, 1995. All
bids will be opened by the
City Manager at an admin-
istrative session com-
mencing at 11:30 a.m. on
the 26th day of September
1995, in the Council Cham-
bers of City Hall, Kalispell,
Montana.
WORK TO BE PER-
FORMED WILL INCLUDE:
Extension of a water
main; installation of storm -
water drainage piping and
catch basins; reconstruction
of Corporate Way including
curbs & gutters and side-
walks; installation of street
lights and utility conduit.
Bids shall be addressed
to the Clerk of the Council,
P.O. Box 1997, Kalispell,
Montana, 59903-1997, and
must be sealed and entitled

The successful bidder
will be assessed the 'Man -
Lana Contractor's withhold-
ing tax.
Plans, Specifications,
Bidding, and Contract
Forms may be inspected in
the office of the Director of
Public Works, City Hall,
Kalispell, Montana and at
Carver Engineering. Inc.,
1995 Third Avenue East.
Kalispell, Montana. Copies
of these documents may be
obtained at Carver Engi- it
veering, Inc. upon payment
of $40.00 (partially refund-
able) for each complete set.
Any unsuccessful bidder,
upon returning such com-
plete set of Contract Docu-
ments in good condition and
within thirty (30) days of bid
opening, will be refunded
$20.0 of his or her pay-
ment. Any non -bidder will
not receive a refund. Mate-
rial suppliers and subcon-
tractors shall be required to
submit proof of quotes to
bidders to receive a refund.
Individual sheets of Con-
tract Drawings and Project
Specifications may be ob-
tained upon payment of
S2.00 per Contract Drawing
sheet or $0.25 per Project
Specification page. Pay-
ment for individual sheets/
pages shall not be refund-
able.
All bidders shall, as bid
security, accompany the bid
with lawful money of the
United States, a cashiers
check, certified check, bank
money order or bank draft,
drawn and issued by a na-
tional bank located in Mon-
tana or a bid bond, or bonds.
executed by a surety corpo-
ration authorized to do busi-
ness in Montana, in the
amount of ten percent
(10%) of the amount bid.
Any such bank instrument
shall be payable to the City
of Kalispell. If a contract is
awarded, the bidder whose
bond is accepted and who
shall thereafter refuse to
enter into and execute the
proposed contract, or pro-
vide sufficient performance
security, as stated in the
covenant, shall absolutely
forfeit such moneys or bank
instrument to the City, and
become immediately liable
on said bid bond in said
sum. The money. bank in-
strument or bid bond shall

be returned to the unsuc-
cessWI 'balers.
All bids must expressly
covenant that if the bidder is
awarded the contract the
bidder will, within ten (10)
days after the award, enter
into a formal contract and
give good and sufficient
bond to secure the perfor-
mance of the terms and
conditions of the contract;
otherwise, the bidder shall
pay unto the City of Kalis-
petl the difference between
the amount of the bid of the
said bidder and the amount
for which the City of Kalis-
pell legally contracts with
another party to perform
said work if the latter
amount is more than the
fDmwr, but in no event shall
bidder's liability or the
surety of such bidder
exceed the penal sum of
10%. All bidders shall, as
bid security, accompany the
bid with said sum in lawful
money of the- United States,
or a cashier's check, certi-
fied check, bank money or-
der or bank draft, in any
case drawn and issued by a
national banking association
located in the State of Mon-
tana, or a bid bond or bonds
executed by a surety corpo-
ration authorized to do busi-
ness in the State of Monta-
na, in the amount of ten (10)
percent of the Bid. Any such
bank instrument or -bond
shall be payable directly to
the City of Kalispell.
If a contract is awarded,
the bidder whose bid is ac-
cepted and who shall there-
after refuse to enter into and
execute the proposed con-
tract, as stated in said cov-
enant, shall absolutely for-
feit such monies or bank in-
struments to the City of Ka-
lispell, and become imme-
diately liable on said bid
bond to said sum. The
money, bank instrument or
bid bond, as the case may
be, shall be returned to
those bidders whose bid is
not accepted.
No bid shall be with-
drawn after the opening of
bids without the consent of
the City Council for a period
of sixty (60) days after the
scheduled time of receiving
bids.
The City will accept the
lowest responsible and re-
sponsive bid, but the Coun-
cil reserves the right to re-
ject any and all bids or to
waive any technicality or
informality and accept any
bid which may be deemed
In the best interest of the
Cit of Kalispell.
The successful bidder
will be required to abide by
State prevailing wage rate
and fringe benefit laws.
The successful bidder
will be required to furnish
an acceptable security for
the full amount of the con-
tract for faithful perfor-
mance thereof 'and payment
of labor, material. and sub-
contractor claims.
