SUBJECT: FY2019 Budget - Storm Sewer Maintenance District
MEETING DATE: August 20, 2018
BACKGROUND: The Storm Sewer Maintenance District Assessment is approved
annually to provide a levy to fund the costs of the City's Storm Sewer Maintenance. For fiscal
year 2019, staff is recommending implementing a 9% increase, approved by Resolution No.
5830 on August 21, 2017, in the assessment for all categories and caps. The amount of said tax
shall be levied proportionately on an area basis in an amount per square foot of lot or parcel of
land within the district, except public streets or rights of way.
RECOMMENDATION: It is recommended the City Council approve Resolution 5888
adopting the Storm Sewer Maintenance District assessment for fiscal year 2019.
FISCAL EFFECTS: Anticipated revenue to be generated by the assessment is
$1,3 90,000.

RESOLUTION NO.5888
A RESOLUTION LEVYING ASSESSMENTS FOR THE COST OF STORM SEWER
MAINTENANCE FOR THE FISCAL YEAR 2018-2019.
WHEREAS, the assessment cost of the Storm Sewer Maintenance District for the fiscal year 2018-
2019 is estimated to be $1,390,000.00, and
WHEREAS, at a public hearing held on the 2nd day of July, 2018, the City Council did consider
all objections made to said estimate and to the basis of levy and assessment for
payment for said cost.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA:
SECTION 1. That a tax be levied for the assessment cost, or $1,390,000 be in the
amounts set opposite the description of each lot or parcel of land, as shown by the
special assessment lists on file in the office of the City Finance Director.
SECTION 2. The amount of said tax shall be levied proportionately on an area basis
in an amount per square foot of lot or parcel of land within the district except public
streets or rights of way.
Category 1. $.004709/sq.ft. Vacant land up to 2 acres
Vacant land over 2 acres $410.23 maximum
Category 2. $.009105/sq.ft. Residential land up to %2 acre
Residential land over'/2 acre $198.31 maximum
Category 3. $.016334/sq.ft. Commercial (non-residential) up to 90% covered
Category 4. $.020418/sq.ft. Commercial 100% covered
Public and private parklands, as defined by Kalispell City Code 23-2-13, and cemeteries shall be
exempt from the assessment.

RESOLUTION NO.5830
A RESOLUTION ADOPTING AN INCREASE TO THE ASSESSMENTS ON REAL
PROPERTY WITHIN THE CITY OF KALISPELL FOR THE COSTS OF STORM SEWER
MAINTENANCE AND LEVYING ASSESSMENTS FOR THE COSTS FOR THE FISCAL
YEAR 2017-2018.
WHEREAS, the City of Kalispell, pursuant to the authority provided to it under MCA 7-12-4102
et seq., has established a storm sewer system, for which real property within the city
I is assessed costs for the maintenance and operation; and
�WHEREAS, all city residents derive significant benefit from storm sewer maintenance and the
! City Council therefore considers it prudent, within the existing statutory system, that
all property owners should pay some assessment for the benefits of the storm sewer
system; and
WHEREAS, it is prudent and necessary for the City Council, from time to time, to evaluate the
existing assessment structure, to review the maintenance requirements of the storm
water system and the adequacy and equity of the assessment schedule; and
WHEREAS, in addition to the increasing costs of materials due to inflation, the storm water
regulatory requirements of the State of Montana have increased dramatically in recent
years which have increased the costs to the City of maintaining compliant storm
water infrastructure; and
WHEREAS, at a public hearing held on the 7th day of August, 2017, the City Council did consider
all objections made to said estimate and to the basis of levy and assessment for
payment for said cost.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
KALISPELL, MONTANA:
SECTION 1. That the increase to the assessments on real property within the City of
Kalispell for the costs of Storm Water Maintenance as set forth in Exhibit
"A", attached hereto and by this reference made a part hereof, are found to be
just and are hereby established and adopted to be imposed for Storm Water
Maintenance to the inhabitants of the City of Kalispell as set forth in Exhibit
«A„
SECTION 2. That a tax be levied for the assessment cost, or $1,275,000 be in the
amounts set opposite the description of each lot or parcel of land, as shown by the
special assessment lists on file in the office of the City Finance Director.
SECTION 2. The amount of said tax shall be levied proportionately on an area basis
in an amount per square foot of lot or parcel of land within the district except public
streets or rights of way.
Category 1. $.004320/sq.ft. Vacant land up to 2 acres
Vacant land over 2 acres $376.36 maximum
Category 2. $.008354/sq.ft. Residential land up to 1/2 acre
Residential land over 1/2 acre $181.94 maximum
