RE: Review of KBID work -plan and proposed budget
BACKGROUND: On June 11, Council held a work session with the Downtown Business
Improvement District to review the budget request and work plan for the upcoming year.
Annually, the council approves the work plan and budget under Montana Code Annotated 7-12-
1132 and 7-12-1133 (included as attachments).
At a subsequent meeting, Council requested to have a follow-up meeting with the Business
Improvement District to further discuss the work plan and budget. Attached to this memo is the
work plan, budget, and resolution of assessment for Fiscal Year 2018, which was passed last year.
RECOMMENDATION: Review and discuss the submitted work plan and budget from the
Downtown Business Improvement District.

2018 -2019 BUDGET
The following is the proposed budget for the City of Kalispell Business Improvement District. This budget keeps
in mind the Mission, Vision and Purpose of the District. The past work plans and budgets together with the BID
assessment formula were reviewed. The new BID is not yet 1 year old and after discussion it was determined that
the assessment should remain the same as 2017 — 2018. A list of accomplishments and a work plan for 2018 —
2019 follows.
The Mission of the Kalispell Business Improvement District
To promote and foster economic growth and stability within the Business Improvement District while preserving
Downtown Kalispell's rich historic and cultural identity.
The Vision
By preserving historic charm, fostering growth, promoting a sense of community and improving image, Downtown
Kalispell will develop into an attractive location for investors, property owners, business owners, and residents, and
become a destination point for visitors.
KALISPELL BUSINESS IMPROVEMENT DISTRICT
The Purpose
To accomplish its vision of creating a vibrant and dynamic business district the BID works to:
• Build effective partnerships with businesses, institutions, property owners and city government to
maintain a clean and safe community.
• Attract, retain and promote quality businesses and retail segments too support our local economy.
• Promote Kalispell as a renowned destination point with a business, retail and institutional mix offering
unique products, services and events.
• Coordinate programs designed to promote Kalispell as the preferred place to shop, work, learn and live.
Accomplishments 2017 — 2018
Old and New BID Districts
• Successfully petitioned the City of Kalispell to establish the BID with an enlarged
district for 10 years
• Hired an independent contractor to design and implement a new website
• Farade Improvement Program — Reviewed the application process and program for
implementation in the 2018 — 2019 budget year
• Funded and supervised the Downtown Ambassador — keeping downtown clean &
friendly
• Downtown Ambassador contracted to clean downtown parking lots and decorative
garbage cans
• Flowers for the BID District purchased and planted
• Contracted to maintain a web presence through Facebook
• Received a grant from Montana Main Street & the Department of Commerce to
support the engineering for the CORE trail
• Supported downtown events; Chocolate Affair, Thursday!Fest, Taste of Kalispell,
The Holiday Art Walk & Stroll, Ladies Night
• Worked with new and potential propertylbusines s owners

assist with the larger Business Improvement District
• Provide 52 hanging plants and plants for 54 corner planters
• Award $15,000 in Fagade Improvement grants
• Work with the city to review and evaluate transportation issues downtown
• Work with the city to implement parking plans to add additional parking
opportunities
• Assist property owners/business owners resolve issues downtown
• Develop an web based program for property owners in the downtown to list

A RESOLUTION MAKING THE ANNUAL TAX LEVY FOR THE BUSINESS
IMPROVEMENT DISTRICT (BID) OF KALISPELL, MONTANA, FOR THE FISCAL
YEAR 2017-2018 AND LEVYING AN ASSESSMENT FOR THE BID FOR FISCAL 2017-
2018.
WHEREAS, the assessment cost of the Business District for the fiscal year 2017-20 18 is estimated
to be $41,637, and the levy revenue will generate $73,991 for a total of $115,628.
WHEREAS, at a public hearing held on the 17th day of January, 2017, the City Council did
consider all objections made to said estimates and to the basis of levy and
assessments for payment for said costs (included as part of the City of Kalispell
budget).
SECTION 1. That there is hereby levied upon each and every dollar of the taxable
valuation of the Business Improvement District of Kalispell,
Montana, for the fiscal year 2017-2018, the following levy:

Annual Budget And Work Plan -- Approval
Procedure -- Tax
7-12-1132. Annual budget and work plan -- approval -- procedure -- tax. (1) At a time
determined by the governing body, the board shall submit to the governing body for approval a work
plan and budget for the ensuing fiscal year.
(2) A board created for the purpose of 7-12-1102(4) in a municipality or county where a nonprofit
convention and visitors bureau, as defined in 15-65-101, is operating shall consult with the nonprofit
convention and visitors bureau in developing a work plan and budget for the ensuing fiscal year.
(3) Following public notice that a work plan and budget have been submitted and that the
governing body will levy an assessment to defray the cost of the work plan and budget, the governing
body shall hold a public hearing on objections to the work plan and budget. After the hearing, the
governing body may modify the work plan and budget as it considers necessary and appropriate.
(4) After approval of the work plan and budget and to defray the cost of the work plan and budget
for the next fiscal year, the governing body shall by resolution levy an assessment upon all of the
property in the district using as a basis one of the methods prescribed in 7-12-1133.
(5) A copy of the resolution must be delivered to the treasurer of the local government to be
placed on the tax roll and collected in the same manner as other taxes.

7-12-1133. Assessment of costs -- area, lot, taxable valuation, square footage, and flat -fee
options -- provisions for property classifications. (1) At the same time that the board submits the
annual budget and work plan to the governing body as provided in 7-12-1132, the board shall also
recommend to the governing body a method of levying an assessment on the property within the
district that will best ensure that the assessment on each lot or parcel is equitable in proportion to the
benefits to be received.
(2) The governing body shall annually assess the entire cost of the district against the entire
district using a method that best ensures that the assessment on each lot or parcel is equitable in
proportion to the benefits to be received. In determining the method of assessment to be used, the
governing body shall consider the recommendations of the board. The governing board shall levy the
assessment using one of the following methods:
(a) each lot or parcel of land within the district may be assessed for that part of the whole cost
that its area bears to the area of the entire district, exclusive of streets, avenues, alleys, and public
places;
(b) if the governing body determines that the benefits derived by each lot or parcel are
substantially equivalent, the cost may be assessed equally to each lot or parcel located within the
district without regard to the area of the lot or parcel;
(c) if the governing body determines that benefits derived by each lot or parcel are proportional,
the governing body may use standard criteria, such as individual occupancy or daily use, and make
the assessment on a flat -fee basis based on the criteria;
(d) each lot or parcel of land, including the improvements on the lot or parcel, may be assessed
for that part of the whole cost of the district that its taxable valuation bears to the total taxable
valuation of the property of the district;
(e) each building may be assessed for that part of the whole cost of the district that the occupied
or income -producing area of the building above the first floor bears to the area of the entire district;

(f) if the governing body determines that benefits derived by each lot or parcel are
disproportional, the governing body may use classification criteria, such as location within the district,
economic impact, or any other measurable criteria, in conjunction with methods of assessing fees
outlined in this subsection (2). Each classification must have its own rate. There may not be more
than six classifications upon which a charge is imposed.

(3) If a district is expanded, the land within the expanded area or property with a similar purpose
in the district must be assessed as provided for in subsection (2) for the duration of the district.

Agriculture Education Center Extension of Sewer Service
July 30, 2018 (Work Session)
BACKGROUND: On July 12, 2018, staff received a letter from Morrison Maierle requesting a work
session with the Council regarding extension of sanitary sewer service to the existing Agriculture Ed-
ucation Center, without annexation. Typically, projects located within the City's annexation boundary
are required to annex as part of the city providing city services. Morrison Mairle has been contracted
by the School District for improvements to the Agriculture Education Centers, which were approved
as part of the 2016 Kalispell High School bond election. The improvements consist of an expansion,
remodeling of existing spaces and new veterinary sciences building. The Agriculture Education Center
is located on FFA Drive east of Willow Glen Drive and the County Shops and Bus Barn facilities.
With the proposed expansion, there is a need to provide additional wastewater treatment, as the existing
private sewage disposal system is not adequate. The request for sewer service without annexation
would coincide with two previous County projects (County Shop Complex and Eagle Transit), located
in the vicinity, that were provided sanitary sewer without annexation in 2010. At that time, the Council
determined that providing services to the County buildings without annexation was appropriate. In lieu
of providing sewer service, Waiver of Right to Protest Annexation were filed for each property, which
would give the city the ability to annex the properties at any time.
RECOMMENDATION: It is recommended that the Kalispell City Council hold a work session on
the Morrison Maierle request.

Re: City Council Work Session Request, Discussion of Extension of Services for Kalispell
School District Agricultural Education Center
Dear Mr. Russell,
The purpose of this letter is to formally request a meeting to discuss extension of sanitary sewer
only municipal services from the City of Kalispell to the existing Agricultural Education (Ag-Ed)
Center located on FFA Drive east of Willow Glen Drive.
Background: As part 2016 Kalispell High School Bond Election, improvements to the existing
Ag-Ed Center were authorized by voters. These improvements consisted of expansion and
remodeling of existing classroom spaces and of new veterinary sciences building. The facility
is part of the high school district, providing educational opportunities centered on agricultural
with three core areas: classroom/ laboratory instruction, supervised agricultural experience
programs, and FFA student organization activities/ opportunities.
Need for Municipal Service: With the proposed expansion, there is a need to provide
additional wastewater treatment of generated sanitary waste. The existing facility is served
with a drainfield that was constructed in the 1970's, This drainfield no longer meets current
regulations and would need to be replaced to meet the additional demands of the proposed
expansion. The site is served with a shared public water supply with the Flathead County
Weed Department offices sharing the same water system. The existing public water supply
has adequate capacity to meet current and future demands.
During preliminary design efforts, construction and permit fees were evaluated for both a new
onsite drainfield and a connection to the City of Kalispell. The City of Kalispell Public Works
Department assisted during this process reviewing potential connection points, connection
details and providing impact fee estimates for the project. Near the end of this collaboration,
a discussion was held with Tom Jentz regarding the City's Growth Policy and process for
extension of services.
The Growth Policy provides a path for extension of municipal service through the request of
annexation and initial zoning. During a conversation with both the Planning Director and the
City Attorney it was discussed that a potential alternative would be to request inclusion in a
City Council Work Session for discussion.
There are two Flathead County facilities (County Shop Complex and Eagle Transit) that have
recently been provided sanitary sewer only service from the City of Kalispell. These two
properties were no required to annex. It appears that these services were provided prior to
the most recent adoption of the Growth Policy update and as such may or may not have
completed the request for annexation and initial zoning process.

Request: Discussion during a City Council Work Session would allow the school district an
opportunity to further present the request. The property is located at the end of FFA Drive,
other properties along FFA Drive are owned by Flathead County and Stillwater Christian.
These facilities and the property owned by Kalispell School District are tax exempt facilities.
During initial discussions with City Staff it does not appear that the cost of services in this area
would be beneficial to the City and thus annexation at this time would not likely be warranted.
During the meeting City Staff could listen to the Council and get direction on the requested
extension of service and any requirements such as waivers of protest. The requested
outcome would be a clear path forward for the school district on this project.
It would be requested that this topic be included on the next available City Council Work Session,
we appreciate City Staffs assistance in this matter and propped format for open discussion and
