On May 20, 2013 City Council approved Resolution 5622, granting a two-year extension of the preliminary plat until August 18, 2015. Kalispell Subdivision Regulations, Section 28.2.06.E.7.b, allows the applicant to request one final two-year extension of the preliminary plat. An extension of the plat would allow the developer until August 18, 2017, to file a final plat; no further extensions would be permitted. The Willow Creek subdivision was approved on July 6, 2010, and proposes a total of 471 lots, 397 single family lots and 74 townhouse lots, to be constructed over 8 phases. Willow Creek is located on the north side of Foys Lake Road generally between the intersections of Valley View Drive and Learn Lane. The eastern boundary of the subdivision abuts the Highway 93 Alternate Route R/W. The 140 acre site can be legally described as Tracts 6-12 of the Certificate of Survey 18086 and is located with the N1/2 and the N1/2 of the S1/2 of Section 13, Township 28 North, Range 22 West, P.M.M., Flathead County, Montana. RECOMMENDATION: It is recommended that the Kalispell City Council adopt the resolution and grant a final two-year extension to the preliminary plat approval for Willow Creek Subdivision. WHEREAS, the city council of the City of Kalispell granted preliminary plat approval for Willow Creek Subdivision on July 6, 2010; and WHEREAS, the city council of the City of Kalispell granted a two-year extension of the preliminary plat for Willow Creek on May 20, 2013; and WHEREAS, Wayne Turner, the owner, has requested an additional two-year extension to the preliminary plat of Willow Creek Subdivision due to economic conditions; and WHEREAS, Section 28.2.06.E.7.b of the Kalispell Subdivision Regulations states that if a final plat has not been filed at the end of the additional two-year extension period, the owner may appeal to the city council in writing for one final extension not to exceed two years provided certain conditions are met; and WHEREAS, Wayne Turner has met the certain conditions and it is in the best interests of the city that the two-year extension be given. NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF KALISPELL, MONTANA AS FOLLOWS: SECTION 1. That the application of Wayne Turner for an additional two-year extension of the preliminary plat of Willow Creek Subdivision, Kalispell, Flathead County, Montana is hereby approved. As you know Willow Creek was granted Preliminary Plat on July 6, 2010. The project was granted a two year extension on May 20, 2013. I am now requesting an additional two year extension. This request is required due to the extraordinary economic conditions that have been experienced by the Flathead Valley and the entire nation over the last 7 years. The economic conditions have made it irresponsible to continue with the construction of Willow Creek. Moreover, the public would benefit from this extension through the economic activity that it will generate. As out -fragile economy continues to recover a housing development of this size and scope would create a significant positive impact. Also, some construction and earthmoving has begun on the project. This extension would allow for that work to continue and eventually be completed. Achieving final stabilization on the property would benefit the community aesthetically as well as eliminate a source of potential pollution to the watershed. Without a time extension, this work may never be completed. Further, granting an extension will not adversely impact the surrounding neighborhood. There have been no significant changes to the surrounding properties in the last five years. A few new homes have been constructed, but all of them were built with the knowledge and understanding that Willow Creek would be built. Finally, there is no regulatory reason not to grant an extension. To my knowledge there are no new or changed policies or regulatory schemes adopted by the City that would prevent Willow Creek from moving forward. Thank you for your consideration of this request.
